EPIC Management
1) Question: Current Bid Forms make no mention of DPMC requirements, however you attached RFIs
and responses from prior bid cycles, which seem to advise that DPMC is required. Please review and
confirm whether Bidders and named prime-subcontractors must have DPMC or not. Is the project
subject to DPMC or is it not.
Response: DPMC classification for General Contractor and Prime sub-contractors is required to
submitted at time of bid. See revised Bidder Checklist.
2) Question: Please issue a specification for the green/vegetative roof as detailed.

Addendum #1(Rebid)
Brockwell & Carrington RFI #1:
1) Question: Contract time: 510 working days vs 600 calendar days (ITB 6.D vs 011000 1.2.C /
A101 §3.3.1) and anticipated award/NTP.
Instructions to Bidders Paragraph 6.D state 'The total number of working days shall be 510 working
days.' Specification Section 011000 Paragraph 1.2.C and AIA A101 Paragraph 3.3.1 state that
Substantial Completion shall be achieved within 600 calendar days from the date of commencement.
Please confirm which duration governs Substantial Completion and for purposes of liquidated
damages under A101 Paragraph 4.5. Please also confirm the anticipated award and Notice to Proceed
dates following the 30 October 2026 bid opening (the Bidder Questions and Responses #1 refers to a
22 September 2026 opening and an approximate award date of 15 November 2026), and confirm that
the Contract Time commences on the date stated in the Notice to Proceed.
Response: Contract time is 600 calendar days. Contract time commences at the date of formal Notice-
to-Proceed. Bid award will be made within 60 days of bid opening.
2) Question: Allowance and unit-price conflicts (A101 §§4.3, 4.4 vs 012100 and Bid Form)
AIA A101 Paragraph 4.3 lists a General Contingency Allowance of $1,200,000.00, whereas Specification
Section 012100 Paragraph 3.3 and the Bid Form identify Allowance No. 1 of
$1,500,000.00 and Allowance No. 2 of $150,000.00 (shown on the Bid Form as Bid Contingency #1 and
#2). Paragraph 4.4 of the A101 lists no unit prices, whereas the Bid Form requires a unit price for Rock
Excavation. Please confirm the governing amounts and that the A101 will be conformed to the Bid Form
and Specification Section 012100 before execution. Please also confirm the percentage of retainage
stated in A101 Paragraph 5.1.7.1 (blank) is 2% as stated on the Bid Form.
Response: Allowance #1 – General Contingency Allowance is $1,500,000. Allowance #2 is confirmed
as $150,000.
3) Question: Rock excavation unit price - definition, measurement, direction of adjustment and bid
evaluation (02300 3.4.B; Bid Form)
Q&A #1, response to item 17, states that Subparagraph B (Classified Excavation) governs, that a base
of 500 CY of rock removal is included in the Contract, and that the Bid Form unit price will account for
actual rock removal 'greater than or less than 500CY.' Please confirm: (1) the definition of 'rock' for
classification under Section 02300 Paragraph 3.4.B (including whether material removable by ram
hammer or ripping is earth, as Paragraph 3.4.B.1 provides); (2) the method of measurement (in-place
cubic yards by survey of the top-of-rock before and after excavation) and who performs and approves
the measurement; (3) that the unit price applies both as an addition above 500 CY and as a credit
below 500 CY; (4) that the unit price includes drilling, mechanical removal, crushing and reuse or
export, and disposal; and (5) how the Bid Form unit price will be considered in the determination of
the lowest responsible bidder, given that the total on the Bid Form is the Base Bid plus Bid
Contingencies.
Response: Rock excavation shall consist of diabase or other igneous, metamorphic, or sedimentary rock
in solid ledges, sheets, or masses in its original position which cannot be excavated without drilling and
blasting or the continuous use of hydraulic or pneumatic rock breakers. Material shall be classified as
rock only if, in the judgment of the Engineer, it cannot be removed as follows: (a) in open excavation, by
ripping with a crawler tractor of not less than 300 net flywheel horsepower and 80,000 lb operating
weight, equipped with a single-shank hydraulic ripper in good condition and operated in first gear, at a
rate of at least 150 bank cubic yards per hour; or (b) in trench or confined excavation, by a hydraulic
excavator of not less than 45,000 lb operating weight equipped with a rock bucket with sharp teeth.
Material meeting this definition shall be classified as rock and removed by rock breakers. Diabase
Town of West New York
New Recreation Center
Addendum #1(Rebid)
boulders and corestones exceeding 1.0 cubic yard in open excavation, or 0.5 cubic yard in trench
excavation, shall also be classified as rock.
Weathered or decomposed diabase, saprolite, and fractured rock that can be removed by the equipment
described above, with or without intermittent breaking, shall not be classified as rock, nor shall hardpan,
cemented gravel, frozen material, or existing concrete or masonry. Upon encountering material believed
to be rock, the Contractor shall notify the Engineer and shall not remove it until the Engineer has
examined, classified, and cross-sectioned it. Rock shall be measured in place to the limits shown on the
Drawings, or, where no limits are shown, to 6 inches below subgrade and 12 inches outside the pipe
barrel or structure. Material removed without the Engineer’s classification shall be paid as unclassified
excavation.
Rock excavation will be measured in bank cubic yards in its original position, between the rock surface
surveyed jointly by the Contractor and the Third-Party Engineer before removal and the pay limits shown
on the Drawings. Where the Drawings show no pay limits, the limits are 6 inches below subgrade or
bottom of footing; 12 inches outside footings, walls, and structures; and, for trenches, a width equal to
the pipe outside diameter plus 24 inches (30 inches minimum) to a depth of 6 inches below the pipe
barrel. Boulders and corestones that qualify as rock will be measured individually by their three greatest
dimensions times a shape factor of 0.6. No payment will be made for swell, overbreak, material outside
the pay limits, or rock removed before the Engineer has classified and Third Party surveyed it. Payment
will be made at the Contract unit price per cubic yard. That price is full compensation for all labor,
equipment, blasting or breaking, monitoring, surveys, overexcavation backfill, and disposal.
4) Question: Federal funding source and applicable federal provisions (ITB 34; Appendix A and B)
Instructions to Bidders Paragraph 34 states that the contract is partially funded by Federal Funds and
attaches the State of New Jersey Federal Rider (rev. 11/12/2020). Please identify the federal agency
and program, the federal award identifier, and which provisions of the Federal Rider apply to this
Contract (including Davis-Bacon Act wage determinations, any domestic-preference or Buy America
requirement, and subcontract flow-down requirements). Bidder Questions and Responses #1, Dobco
RFI #2 item 3, states only that NJ Prevailing Wage applies; please confirm whether Davis-Bacon rates
are also required and, if so, which wage determination governs where the two differ.
Response: The higher wages shall apply.
5) Question: Work hours - weekend work (011000 1.4.B.1 vs Q&A #1 item 27)
Specification Section 011000 Paragraph 1.4.B.1 states 'There are no restrictions on weekend hours,'
whereas Bidder Questions and Responses #1 item 27 states that Saturday work hours 'may be
permitted on a case-by-case basis per Town approval.' Please confirm which governs and whether
Saturday work for non-disruptive activities requires approval for each occurrence.
Response: Saturday work between 7am and 4pm is non-restrictive. Town approval is required for work
outside of these hours, Monday thru Saturday.
6) Question: Offsite parking and utility-company fees (015000 3.4.D-E; Alna RFI #3)
Specification Section 015000 Paragraphs 3.4.D and 3.4.E require the Contractor to provide temporary
offsite parking for construction personnel and offsite storage and staging. The Owner has made the
parking lot in front of the site available for staging. Please confirm whether the Owner will also
provide or permit any area for Contractor personnel parking, and confirm who bears utility-company
fees for connections, protection and relocations (response to Alna RFI #3 states only that an
allowance will not be included).
Town of West New York
New Recreation Center
Addendum #1(Rebid)
Response: Town will coordinate with Contractor to provide parking as needed, during construction.
7) Question: Builder's risk / property insurance terms (A201 §11.2; A101 §8.5.1)
Bidder Questions and Responses #1 states that Builder's Risk insurance will be provided by the
Owner. AIA A101 Paragraph 8.5.1 refers to Exhibit A, Insurance and Bonds, which is shown as deleted
in Article 9. Please confirm the form, limits, perils, deductible and loss payee of the Owner's property
insurance, and that the Contractor bears no deductible.
Response: Builder’s Risk insurance will be provided by the Town, once the bid has been awarded and the
full scope of the project has been obtained.
8) Question: Subcontractor documentation timing (Bid Checklist vs Q&A #1 Dobco RFI #2 items 17-18)
The Bid Checklist does not list DPMC classification, Business Registration Certificates or Public Works
Contractor Registration certificates for subcontractors, whereas Bidder Questions and Responses #1
requires DPMC classification for the bidder and prime subcontractors in addition to the other
documents. Please confirm which documents must accompany the bid and which are due prior to
award (ITB 8.A and 24).
Response: BRC and Public Works Contractor Registration are not required to be submitted at time of
bid, but must be provided prior to contract award. DPMC classification 008 plus all Prime Trades
(Structural Steel, HVAC, Plumbing, Electrical) are required to be submitted at time of bid. See attached
Bid Checklist which has been revised accordingly.
DMR Construction Services, Inc.
1) Question: Refer to Structural Sheet S-101 and Sketch SKS-S101:
a. It is anticipated that the costs associated with the underpinning, SOE and soil
improvement scopes will vary significantly among bidders in the absence of
defined design parameters. To provide a level bidding environment, we
respectfully suggest including a bid allowance to cover the engineering
calculations and design of the required ground improvements, implementation of
the selected improvements, and all associated noise, vibration, and displacement
monitoring. This approach would also allow for value engineering of the ground
improvement solution and may result in a system that is less disruptive to the
adjacent buildings, such as micropiles or other alternative foundation
improvement methods.
b. Note on S-101 reads: “See typical elevator pit section on sheet S-201 for
additional information”. However, S-201 does not show such detail.
c. 24” and 50” concrete mats along column lines 10.0 and 11.0 overlap. Taking into
consideration the top elevations are -8.00 and -8.25 respectively, shouldn’t they
be poured monolithically as a single mat?
d. There is an area centered on B.0 + 1.0 that resembles a mat foundation but with
no information as far as thickness, reinforcement, etc. Please provide.
e. Retaining wall details for RW-1 and RW-3 are provided on details 5 and 6 on S-
202. However, details for and extent of wall RW-2 are not provided.
Response:
a. No allowance is being provided.
b. Refer to Dwg. S-200.
c. Refer to revised Dwg. S-101 (attached)
d. Refer to Schedule on S-002.
e. Refer to Section 11/S-202.
2) Question: Please clarify the note on Detail 4/S-202 stating, "Lean concrete as required." and
