Description: The City of Broken Arrow, Oklahoma (the "City") is seeking proposals from qualified professional consulting firms or teams with demonstrated expertise in municipal land use regulation, particularly regarding large-scale, utility-intensive uses such as data centers. The selected consultant will support the City’s Data Center Study Committee in developing permanent zoning standards and related regulatory amendments in response to Ordinance No. 3929, adopted June 15, 2026. Ordinance No. 3929 established a temporary moratorium on new data center development applications through December 31, 2026 (or until permanent regulations are adopted). This six-month window provides a critical opportunity to study the unique impacts of data centers, engage the public, review best practices from peer jurisdictions, and develop tailored permanent zoning standards that protect public health, safety, and general welfare while appropriately managing this emerging land use. A detailed Operational Plan for the regulatory study was prepared by the Data Center Study Committee (dated June 17, 2026) and is incorporated herein by reference. The Plan identifies key study areas including infrastructure capacity (especially electric power coordination with Public Service Company of Oklahoma – PSO), and Regional and local Water and Wastewater providers, land use and siting, operational/environmental/quality-of-life impacts (noise, traffic, visual, air quality), economic/fiscal considerations, and development of a comprehensive regulatory framework (definitions, use regulations, performance standards, permitting pathways, monitoring, and enforcement). The City desires to complete this work in a transparent, evidence-based, and defensible manner that balances potential economic development opportunities with protection of infrastructure capacity, neighborhood compatibility, and quality of life for Broken Arrow residents.
