SOLE SOURCE ACQUISITION

1. Synopsis of the Requirement



The Government hereby submits a notice of intent to award a sole-source, firm-fixed-price contract/purchase order to the proposed contractor identified below. It is the belief of the Government that this organization is the sole source to fulfill the need of one responsible source to satisfy the agency’s requirement. (See attached justification).

2. Regulatory and Statutory Authority



This sole-source contracting action is conducted in accordance with Federal Acquisition Regulation (FAR) Class Deviation / Revolutionary FAR Overhaul (RFO) guidelines. Under the RFO, simplified procedures for commercial acquisitions are consolidated under RFO FAR Part 12 (specifically RFO FAR 12.201-1 (Simplified procedures) and RFO FAR 12.102(a) for acquisitions valued at or below the Simplified Acquisition Threshold).



The statutory and regulatory authorities permitting other than full and open competition are:




  • Regulatory Authority: RFO FAR 6.103-1, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”

  • Statutory Authority: 10 U.S.C. 3204(a)(1) [or applicable authority for DoD/Coast Guard].

Requirement Summary:



To develop a model that simulates coast guard cutter boats. The use of PANSHIP will provide the Coast Guard with state-of-the-practice simulation capability to evaluate the dynamic stability of boats and cutters in moderate to severe seaways.



4. Submission Instructions to Interested Parties



This hereby constitutes a synopsis of the items included in this requirement. This notice is NOT a request for competitive quotes or proposals, and a written solicitation will not be issued. However, responses to this notice demonstrating clear and convincing evidence that competition would be advantageous to the Government, would not be cost or time prohibitive, and would not hinder critical mission objectives will be considered.



The determination not to compete this proposed contract action is solely within the discretion of the Government. Information received will be considered solely for the purposes of determining whether to conduct a competitive solicitation for future requirements regarding this program. The Government will not be responsible for any costs incurred by responding to this notice.
