10 U.S.C. 3204(a)(1) FAR 6.302-1(a)(2)(ii) – Only one responsible source and no other supplies or services will satisfy agency requirements.
The Maritime Buoyant Plate (MBP) is a critical safety item currently used by U.S. Navy Afloat Forces in support of Antiterrorism Force Protection (ATFP) and Visit, Board, Search, and Seizure (VBSS) missions. The MBP is used in conjunction with the Maritime Armor System (MAS) to provide increased ballistic protection for the wearer. NSWC PCD is designated as the in-service engineering agent for this effort by NAVSEA PMS 408. In 2020, NSCW PCD competitively awarded four indefinite delivery, indefinite quantity contracts to the following business entities:
Atlantic Diving Supply, Inc. – N61331-20-D-0015, Mountain Horse, LLC – N61331-20-D-0014, Point Blank Enterprises, Inc. – N61331-20-D-0013, Integris Composites, Inc. – N61331-20-D-0011
The qualification and eligibility for the production delivery orders under these contracts were contingent upon the contractor’s successful completion of First Article Test (FAT) in accordance with NQ/PD 16-04 Maritime Buoyant Plate Purchase Description. Three contractors successfully passed the FAT and subsequent delivery orders were competitively awarded, (one pending). An additional purpose of using this contractual approach was to generate a pool of qualified vendors that can fulfill the required quantities, meeting or exceeding required, stringent delivery schedules. The previous award effort consisted of strict testing parameters that permitted for competition but derived the best qualified sources available in this peculiar industry. These contracts are now expired. The U.S. Navy has a current need to procure additional quantities of the same design MBP in FY25 to continue sustainment of Ballistic Personal Protective Equipment (BPPE) to the Fleet. The required delivery date is 120 days after award.
