Description

Purpose



This notification is being provided to alert industry to the Veterans Affairs Acquisition Regulation (VAAR) Class Deviation (CD) that was announced under Acquisition Policy Flash! 25-06. The purpose of this VAAR CD is to require contractor compliance with E.O. 13899, Combatting Anti-Semitism, by means of a new VAAR clause, 852.222-71, Compliance with Executive Order 13899.



What to Expect:



Effective April 01, 2025, VAAR clause 852.222-71 will be included in all solicitations for contracts that will use appropriated funds and exceed the simplified acquisition threshold (SAT); and any existing contract that exceeds the SAT and is not otherwise physically complete (See FAR 4.804-4) or has more than six (6) months remaining until the ultimate expiration date.



VA will undergo formal rulemaking to incorporate this CD into the VAAR. The public is invited to participate in that rulemaking process once it commences.
