4th of July Fireworks Display – Pittsburg, Kansas
Request for Proposals for the City of Pittsburg’s annual 4th of July fireworks display
will be received in the City Clerk, office, City Hall, 201 West 4th Street, P.O. Box
688, Pittsburg, Kansas, until 2:00 p.m. on Tuesday, March 3rd, 2026 , and
then publicly opened and read aloud in City Hall Upstairs Conference Room.
Enclosed are minimum specifications with which the RFP must comply. All
proposals will be referred to City staff for recommendation. The successful
candidate will be contacted when their proposal is accepted. Proposals received
after the designated closing time will be returned unopened. Proposals shall be
addressed to the Deputy City Clerk, at the above address, and the envelope shall
be plainly marked, “RFP: FIREWORKS DISPLAY”. The City’s budget for this
display is $30,000 with an add alternate display with the budget of $40,000.
The City of Pittsburg reserves the right to accept the best bid, reject any and/or
all proposals and the right to waive any irregularity in any proposal.

Minimum Specifications
Fireworks Display Synchronized to Music
$30,000 has been budgeted for this display (Exhibit A)
$40,000 Add Alternate Display (Exhibit B)
Proposals shall include the following minimum specifications:
1. Qualifications of firm and pyrotechnicians.
2. The number, size and description of shells for the opening, main show and
finale.
3. Amount of discount offered to City.
4. Shoot fee charged to City.
5. Ability to begin show promptly at 10:00 pm.
6. The proposed length of the show (in minutes).
7. Ability to synchronize the show to music working with a local radio station.
8. Insurance Requirements:
* Seller shall procure and keep in force during the term of this contract
insurance liability coverage against claims for bodily injury, death
and property damage with single limits coverage of not less than
$10,000,000.00 per incident for bodily injury and death and property
damage, with an insurer in good standing and licensed to do
business in the State of Kansas.
9. Any other information you feel is appropriate to assist in the evaluation and
selection process.
* Representatives from the selected firm will enter into a contract with the
City of Pittsburg (an example is attached).
FIREWORKS DISPLAY CONTRACT
This Contract is entered into as of the _____ day of _______, 2026 by and
between ________________, designated herein as the Seller and CITY OF
PITTSBURG, KANSAS, designated herein as the Purchaser.
For and in consideration of the covenants herein, the parties agree as
follows:
Seller will secure, prepare and deliver the fireworks specified in Exhibit A/B
attached hereto, or will make necessary substitutions of equal or greater value.
Seller will include the services of a licensed pyrotechnic operator and other agents
to take charge of, set up, and fire the fireworks display, along with such help as
Seller deems necessary to perform the fireworks display safely, and in accordance
with Federal, State and Local laws and regulations.
Seller’s operator and agents will check the display area after the
presentation of the fireworks display for any “duds” or other material which might
not have ignited or which could cause injury. In the event any agent of Purchaser
shall find any “duds” or other material, the Seller will be advised so that its operator
and agents may take possession of same for safekeeping or disposal.
Seller will determine and establish the minimum safety distances from the
location of the fireworks display as proscribed by Federal, State, and Local laws
and regulations. Thereafter, the Purchaser will mark the minimum safety distances
as established by Seller and furnish adequate police and city personnel to maintain
said safety distances. Purchaser also agrees to have one fire unit on location in
the near vicinity of the display area.
It is agreed and understood that the Purchaser will pay the sum of
$_______________ for the fireworks display. The Purchaser will pay a down
payment equal to 25% of the total price by or on June 26, 2026 (the sum of
$______). The remainder of the $_____________ is to be paid within ten (10)
days following the presentation of the display on July 4, 2026.
Seller will donate $_______________ in product for the year 2026.
Purchaser and Seller acknowledge that any amount past due for an excess
of 30 days is subject to a finance charge computed on the basis of an annual
percentage rate of 10%. Should either party terminate this contract for any reason
other than Force Majeure, as herein defined, then in that event,

(i) if terminated by Seller, Seller shall return Purchaser’s down payment
and
(ii) if terminated by Purchaser, Purchaser shall pay Seller an additional
sum of $800.00
In the event of inclement weather, which causes postponement of the
display, it is agreed and understood that the display will be presented July
5, 2026, if weather permits, or at some future date mutually agreeable to
the Seller and Purchaser.
FORCE MAJEURE. Neither Seller nor Purchaser shall be required to
perform any term or condition of this contract if such performance, after
the exercise of due diligence to perform, is delayed or prevented by acts of
God, acts of war, civil riots, organized labor disputes, governmental
restrictions, or in the event Purchaser, due to budget constraints is unable
to pay for such fireworks display.
Seller shall defend, indemnify and save Purchaser harmless from and
against any and all claims, liability, and expense, including reasonable
attorney fees, for injuries, damages and death to any person or property
arising out of the acts or neglect of Seller’s operator, its agents and
employees, but excluding liability due to Purchaser’s negligence or willful
misconduct.
Seller shall procure and keep in force during the term of this contract
insurance liability coverage against claims for bodily injury, death and
property damage with single limits coverage of not less than
$10,000,000.00 per incident for bodily injury and death and property
damage, with an insurer in good standing and licensed to do business in
the State of Kansas. Further, upon receipt of the down payment, Seller
shall deliver to the City Clerk of Pittsburg, Kansas, a certificate of insurance
confirming such insurance coverage.
