The North Carolina Department of Transportation is requesting bids for the project listed below. The availability date
for this project is August 1, 2026. The Interim completion date for this project is December 19, 2026 The completion
date for this project is July 31, 2027.

Under the provisions of this Program, your firm is required to be certified as a SBE Contractor with the Contractual
Services Unit of NCDOT, and be listed in the Directory of Transportation Firms, prior to bidding on this contract.
Prospective bidders who qualify for the SBE Program and are not currently certified should submit a completed
application packet prior to bid submittal to allow for review time. The application packet and additional information
on the program may be obtained online at: https://connect.ncdot.gov/business/SmallBusiness/Pages/default.aspx.
Under the provisions of this Program, a NC General Contractor’s License, Contract Payment Bonds and
Contract Performance Bonds are not required.
The Department of Transportation hereby notifies all bidders that it will affirmatively ensure that in any contract
entered into pursuant to this Invitation to Bid, Minority Business Enterprises will be afforded full opportunity to
submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, sex, or
national origin in compensation to this award.

Notice Regarding Upcoming Buy America Changes
On January 14, 2025, the Federal Highway Administration (FHWA) terminated its General Waiver for
Manufactured Products and established specific Buy America requirements for their use on Federal-aid highway
projects.
This means that as of the following dates, materials defined as manufactured products permanently incorporated
into Federal-aid highway projects will have to be manufactured in the United States.
Key Implementation Dates
• Phase 1: contracts obligated on or after October 1, 2025
o Final assembly of all manufactured products permanently incorporated into Federal-aid highway
projects must occur in the United States.
• Phase 2: contracts obligated on or after October 1, 2026
o Final assembly of all manufactured products permanently incorporated into Federal-aid highway
projects must occur in the United States.
AND
o The cost of U.S.-produced components in manufactured products must be greater than 55% of the
total cost of all components.
Definition of Manufactured Products
Manufactured Products are defined as articles, materials, or supplies that:
• Have been processed into a specific form and shape, or
• Have been combined with other articles or supplies to create a product with different properties than the
individual articles, materials, or supplies.
This places greater emphasis on using domestically produced materials on these projects and is consistent with the
Build America, Buy America Act (BABA) under the Bipartisan Infrastructure Law (BIL).
