BID INVITATION FOR: Heating Oil Season 2026-2027

Unless specifically amended or deleted by the Purchasing Office, the following General Terms and Conditions apply to this Bid and any resulting

Purchase Order or Contract.

GENERAL TERMS AND CONITIONS:

BIDS. Bids must be received at the Purchasing Office before the date

and time specified for the opening. Bids must be submitted on this

bid form or exact copies and must be typed or clearly printed in ink.

Corrections must be initialed. Bids are to be made less Federal Excise

Tax and no charge for handling unless required by law. Bids will be

made available to the public after the time of award. Bid results will

be given by mail only if requested in writing and accompanied by a

self-addressed, stamped business size envelope.

SPECIFICATIONS. Vendors must submit on items as specified.

Any changes in specifications must be noted on the "Specifications

Exception Form". Vendors shall be notified in writing if any changes

to the specifications are made.

PERSONAL LIABILITY. The responding vendor agrees that in the

preparation of this bid or the execution of any resulting contract or

order, representatives of the City of Laconia shall incur no liability of

any kind.

PROOF OF COMPLIANCE. The responding vendor may be

required to supply proof of compliance with bid/proposal

specifications. When requested, the responding vendor must

immediately supply the Purchasing Office with certified test results

or certificates of compliance. Where none are available, the City of

Laconia may require independent laboratory testing. All costs for

such testing, certified test results or certificates of compliance shall

be the responsibility of the responding vendor.

A WARD. The award will be made to the responsible vendor

submitting a conforming Bid meeting specifications at the lowest cost

unless other criteria are noted in the Request for Bid. Unless

otherwise noted, the award may be made by individual items. If there

is a discrepancy between the unit price and the extension, the unit

price will prevail. When identical low bids are received the award

will be made to the local vendor. If identical low bids are received by

local vendors, or non-local vendors, the award will be determined by

the toss of a coin. Discounts will not be considered in making award

but may be offered on the invoice for earlier payment and will be

applicable on the date of completion of delivery or receipt of invoice,

whichever is later.

ASSIGNMENT PROVISION. The responding vendor hereby

agrees to assign all causes of action that it may acquire under the

antitrust laws of New Hampshire and the United States as the result

of conspiracies, combinations, or contracts in restraint of trade which

materially affect the price of goods or services obtained by the city

under this contract if so requested by the City of Laconia.

FORM OF CONTRACT. The terms and conditions set forth in any

additional Terms and Conditions by the Purchasing Office are part of

the bid and will apply to any contract awarded to the responding

vendor unless specific exceptions are taken and accepted and will

prevail over any contrary provisions in Terms and Conditions

submitted by the responding vendor.

OFFER. The undersigned hereby offers to sell to the City of Laconia

the commodities or services indicated in the following page(s) of this

Bid at the price(s) quoted in complete accordance with all conditions

of this Bid.

CITY'S OPTIONS. The City of Laconia reserves the right to reject

or accept all or any part of any bid, to determine what constitutes a

conforming bid, to award the bid solely as it deems to be in the best

interest of the City, and to waive irregularities that it considers not

material to the bid.

PUBLIC INFORMATION. The responding vendor hereby

acknowledges that all information relating to this bid and any

resulting order (including but not limited to fees, contracts,

agreements, and prices) are subject to the laws of the State of New

Hampshire regarding public information.

legally obligate the responding vendor. A signature on this document

indicates that all City of Laconia terms and conditions are accepted

by the responding vendor and that any and all other terms and

conditions submitted by the responding vendor are null and void,

even if such terms and conditions have terminology to the contrary.

The responding vendor shall also be subject to City of Laconia

contract and purchase order terms and conditions.

Heating Oil Season 2026-2027

General Terms and Conditions

The City of Laconia ("City") requests sealed bids for No. 2 Heating Oil for the time period beginning October 1,

2026, to September 30, 2027. Bids clearly marked "Heating Oil Season 2026-2027" will be received until 2:30pm

Thursday September 3, 2026, at the purchasing office 45 Beacon Street East, Laconia NH 03246. Postmarks and

other timestamps will not be accepted in lieu of actual delivery. They will be opened and publicly read per the

following General Terms and Conditions:

1. Purpose

The purpose of this bid is to establish a contract for No. 2 Fuel Oil to be supplied to the

City of Laconia as needed, during the term of the contract, in accordance with the

requirements of this bid. All bids must be submitted on the attached Bid Schedule.

2. City's Options

The City reserves the right to make additions or deletions to the list of delivery points as

outlined in paragraph 11, as may be necessary, during the contract period.

3. Contract Term

The term of the contract shall be from October 1, 2026, through September 30, 2027.

4. Estimated Usage

The quantity of fuel indicated in section 11 under "Consumption Estimate" is an estimate

only. These quantities are indicated for informational purposes only and shall not be

considered minimum or maximum requirements.

5. Delivery

Buildings should be put on automatic fill to avoid emergency situations unless otherwise

specified. Otherwise, deliveries are to be made within three (3) working days of order,

between the hours of 7:00 AM and 3:00 PM. All deliveries are to be metered. Vendor

further agrees to deliver in less time in case of emergencies to the best of his ability. If

delivery requirements are not met, the City reserves the right to purchase elsewhere,

charging any additional costs to the contractor. A copy of either the delivery slip or the

oil burner service work order will be left at the site upon each delivery service or call.

With the exception of Laconia Water Works locations, all City tanks should be topped

off by May 31, 2027, and put on a call basis for the remainder of the contract period.

Deliveries shall not be made after May 2027 unless authorized by the purchasing

specialist.

Representatives of the Laconia Welfare Office may authorize emergency deliveries of

100 gallons to needy Laconia residents on an as needed basis. Delivery addresses will be

given at the time of authorization. The Welfare Department anticipates approximately 5

of these emergency authorizations over the course of the season. Welfare emergency

orders are to be delivered the same day the call is made for delivery of heating oil.

6. Bid Pricing:

Prices shall be firm fixed for the duration of the contract period. In connection with this

Agreement, the City does not agree to pay the cost of any fees or taxes, including any

environmental, super fund, or excise fees or taxes, for which the vendor may be deemed

responsible. The City will, however, complete a Certificate of Exemption furnished by

the successful bidder in support of a claim for credit or payment under Section #6427 of

the Internal Revenue Code.

7. Contract Award

Award will be made to the "Responsible Bidder or Offeror" as defined by Laconia Code,

Article IV, Section 5-35, with the lowest cost per gallon and/or based on what is deemed

to be in the best interest of the City. Offers of cash discounts will not be considered in

making the award. In the event of tie bids, the award will be determined by the toss of a

coin. The City may cancel this request for bids at any time for any reason.

8. Invoicing

Invoicing shall be made on the completion of each delivery. The bidder shall render

separate invoices for each delivery to the City. Invoices shall clearly indicate the quantity

delivered, description of product delivered, date of delivery, location and contract price

excluding all State/Federal taxes and fees. In cases of emergency delivery, authorized

by the City Welfare Department, invoices must also show the "voucher number"

that authorizes the purchase.

Payment will be due and payable within thirty (30) days from completion of designated

delivery of merchandise or receipt of invoice, whichever is later. Vendor may offer a cash

discount for early payment of invoices.

9. Requirements and Specifications

All fuel furnished shall conform to Federal Standard VV-F-815A, as amended. The

maximum sulfur content of No. 2 Fuel Oil is 0.4%. In the event of a change in Federal

Standard, sulfur content will not exceed whatever is mandated.

10. General Liability Insurance

The contractor shall obtain Comprehensive General Liability Insurance and shall

maintain the same in full force and effect throughout the duration of the term of the

Agreement. The contractor shall arrange to have the City included as an Additional

Insured on said policy of insurance. The City shall be given at least thirty (30) days'

advance written notice of any cancellation of this insurance. The insurance company shall

be licensed to do business in New Hampshire.
