The City of Fort Morgan is accepting sealed unit price bids for 2026 On-Call HBP Paving Services
until 3:00 p.m. (our clock) on May 16, 2026 at City Hall located at 110 Main Street, Fort Morgan,
Colorado 80701. If delivered, they are to be sent to 110 Main Street, Fort Morgan, CO 80701. If mailed,
the address is PO Box 100, Fort Morgan, CO 80701. If emailed, the address is
cfm.bids@cityoffortmorgan.com.
Bids must be received at City Hall by 3:00 p.m. (our clock) on May 16, 2026.
All questions regarding this bid should go to Jim Willis, Streets Superintendent in writing and can be e-
mailed to jim.willis@cityoffortmorgan.com. The cut-off date and time for questions is Monday, May
12, 2026, at 9:00 a.m. It is the responsibility of the prospective bidders to contact Jim Willis, Streets
Superintendent at (970) 542-3987 to verify receipt of questions. Based upon such inquiry, the City
may choose to issue an Addendum.
Opening Date: The opening will not be a public bid opening as it will be subject to staff review of costs,
options, qualifications, possible short list and/or interviews.

All bids, whether delivered, mailed or emailed, must use the attached city Bid Form and adhere to all
other instructions in this Invitation to Bid. The City reserves the right to reject any bids that do not
comply with the instructions outlined herein.

I. GENERAL INSTRUCTION
1. Authorized Representative. All bids must be properly signed by an authorized representative of
the company with the legal capacity to bind the company to the contractual agreement.
2. Withdrawal. Bid(s) may be withdrawn up to the date and time set for closing upon written, faxed
or e-mailed notice to the City. Negligence upon part of the bidder in preparing their bid(s) shall not
constitute a right to withdraw a bid(s) after the bid opening. A conditional or unqualified bid may
be cause for rejection.
3. Acceptance of Bid. Only bids properly received will be accepted. Each bid, deposits and
applicable documentation as requested must be submitted in a sealed envelope, if mailed or
delivered, clearly identifying on the outside of the envelope:

II. TERMS AND CONDITIONS
1. During normal maintenance and minor street/utility projects, the Streets Department occasionally
requires services deemed urgent and/or beyond the capabilities of “in-house” resources.
2. The City intends to create a roster of qualified Contractors willing to contract with the City of Fort
Morgan on an as-needed basis and to establish in advance the unit pricing for compensation for
such services.
3. No minimum amount of work is implied or guaranteed under this Invitation.
4. By seeking Bids from Contractors, the city does not represent that it will utilize the Contractor's
services or that it will utilize the Contractor’s services any guaranteed number of times over the
course of the year.
5. All Bidders must be properly licensed and/or registered in the services being performed.
Photocopies of company and employee licenses and/or registrations must be submitted with a
properly executed Bid Form. The Bidder/Contractor is responsible for updating information as
necessary.
6. Bid(s) shall be in unit pricing, inclusive of all management, operators, tools, supplies, equipment
and labor necessary to ensure timely performance of the required services on an as-needed basis.
Fueling and vehicle service will not be provided by the city.

7. All Bids must be made on the required Bid Form. All blanks’ spaces for Bid prices must be filled in,
in ink or typewritten, and the Bid Form must be fully completed and executed when submitted. Only
one copy of the Bid Form is required. Should the Bidder not provide certain services, or desire not
to bid certain items, the Bid price shall be filled in as “N/A”.
8. The Bidder agrees that by submitting its Bid as set forth in its Bid Form, the Bid price will remain in
effect through December 31, 2026.
9. Bidder participants, whether general contractor, prime contractor, joint venture contractor or sub-
contractor, shall provide documented evidence of having completed projects of a similar nature to
the project being bid. Bidder shall be required to submit references of previous projects for which
City verify references. This experience documentation shall be submitted as a requirement for,
being considered for award of the contract for the subject project.
10. No bid bond or performance bond will be required.
11. A two-year Maintenance Warranty or Letter of Credit to cover defective workmanship and materials
may be required for a project, as defined by the Work Order and accepted Notice to Proceed from
the Contractor(s) utilized no later than at the end of the contract year.
12. Successful Contractor(s) will be notified of their placement on the roster by a Notice of Acceptance
within ten (10) days of the bid opening.
13. Each Contractor who receives a Notice of Acceptance will be required to execute the Agreement
and provide current Workman’s Compensation Insurance verification and proof of liability insurance
naming the City of Fort Morgan as an additional insured within ten (10) calendar days from the date
when the Notice of Acceptance is delivered to the Bidder(s). THE PRIMARY GENERAL
CONTRACTOR IS RESPONSIBLE FOR VERIFICATION OF WORKMEN’S COMPENSATION
INSURANCE REGARDLESS OF THE BID PRICE FOR ALL SUBCONTRACTORS.
14. The Notice of Acceptance shall be accompanied by the necessary Agreement and sample Bond
forms. In case the Contractor fails to execute the Agreement, the City reserves the right to exercise
its option to consider the Contractor in default, in which case the City will remove the Contractor
from the roster and will not consider the Contractor for any as-needed services pursuant to this
Invitation.
15. Contractors placed on the roster will generally be utilized in order of rate per unit for the services
needed. The City reserves the right; however, to consider responsiveness as well as past
performance in determining which Contractor will be contacted first and given the opportunity to
perform the work. Should the first contacted Contractor be unable or unwilling to perform the
needed service, the City will proceed down the roster as necessary to meet the needs of the city.
16. Contractors who are placed on the roster and who undertake the work will be required to perform
services pursuant to the terms described herein.
17. The City shall retain the right to remove any Contractor from the roster if the Contractor fails to meet
and maintain the terms described in this Invitation or fails to provide services that meet the
standards set in the industry within the demands and time constraints established by the City for the
project.

18. Contractor shall be knowledgeable and comply with all federal, state, and local laws, rules,
regulations and ordinances that may be applicable to the operation of the equipment provided by
Contractor for HBP Paving services.
19. The Contractor shall give adequate attention to the faithful prosecution and completion of this
contract and shall keep on the worksite, during its progress, a competent superintendent and any
necessary assistants. The superintendent shall represent the Contractor in his absence and all
directions given to him shall be as binding as if given to the Contractor.
20. The City reserves the right to inspect all equipment at any time.
21. Invoice: Contractor shall invoice the City within thirty (30) days after the work has been completed.
The City shall make payment within thirty (30) days of receipt of the invoice.
22. Independent Contractor: Contractor must be and remain an independent Contractor with respect to
all services performed under this Invitation. Contractor accepts full and exclusive liability for the
payment of any and all contributions of taxes for social security, worker's compensation insurance,
Medicare, unemployment insurance, or old age retirement benefits, pensions or annuities, now or
hereafter imposed under any state or federal law, salaries or other remuneration paid to persons
hired, including deposits of income tax withholding amount due, and it agrees to indemnify and save
harmless the City from any claims for contributions, taxes or liability thereof.
Contractor’s employees shall not be deemed employees of the City for any purpose and shall at all
times be recognized as the Contractor's employees and work under Contractor's control and
supervision. The Contractor’s employees shall not acquire any rights or benefits provided for
employees of City of Fort Morgan. However, the Contractor's supervisors shall, in the performance of
services herein requested, comply with the written or verbal instructions received from the Contract
Manager. Supervisors shall then be directly responsible for transmitting this information to the
Contractor’s employees.
The Contractor and their personnel are required to adhere to all Federal, State and Local laws that
apply to the provisions of the services under this Contract, as well as those laws that regulate the
public.
23. Provisions: By submitting a Bid Schedule, the Contractor agrees to the following:
a. Worker Without Authorization: Contractor warrants that it does not knowingly hire or engage any
persons not authorized to work in the United States; it takes steps to verify that it does not hire or
engage any persons not authorized to work in the United States; and that any misrepresentation
in this regard or any employment of person not authorized to work in the United States
constitutes is material breach and shall cause for termination of its contract.
b. Insurance: Contractor shall carry such public liability and property damage insurance that will
protect them and the City of Fort Morgan from claims for damages for bodily injury, including
accidental death, as well as for claims for property damages, which may arise from operations
under this Contract whether such operations be by themselves or by anyone directly or
indirectly employed by either of them. The contractor warrants and guarantees that it maintains
adequate insurance with minimum limits of $1,000,000.00, for activities undertaken pursuant to
this Invitation and meet the Insurance Certificate Requirements included with this Invitation.
c. Workers’ Compensation: Contractor shall carry Workers’ Compensation insurance in amounts
sufficient to cover those obligations imposed by the Workers’ Compensation Act of Colorado,
