Description
Notice of Intent to Sole Source

Description of Requirement:
The Department of Veterans Affairs intends to solicit and negotiate a Sole Source, Firm-Fixed-Price six (6) month contract with Set the Standard, who is a certified SDVOSB. This procurement is a bridge contract for urgently needed Sharps removal services for the New York Harbor VA Healthcare System. The anticipated award date is 10/17/2026. The North American Industry Classification (NAICS) code for this acquisition is 562112.

Background:
Department of Veterans Affairs, New York Harbor Health Care System
(NYHHCS) is seeking removal and disposal of regulated medical waste (RMW) services for each of three (3) campuses and two (2) associated outpatient clinics. RMW includes non-hazardous pharmaceutical waste, gen-ex cartridge waste, empty methadone bottles, pathological waste and trace-chemotherapeutic waste as well as reusable and disposable sharps exchange.
Scope:
The contractor shall provide all labor and materials necessary for the collection and
removal of RMW as well as reusable and disposable sharps exchange services for the Department of Veterans Affairs NY Harbor Healthcare System.
The waste shall be processed and disposed of off-site by the contractor at a facility in compliance with all Federal, State and Local requirements. Management and processing of regulated waste and completion of all services shall be in accordance with all Federal, State, and Local regulations.
Regulated Medical Waste Removal Services:
Regulated medical waste includes, but is not limited to items contaminated with blood and body fluids/waste, trace-chemotherapeutic wastes, pathological and microbiological waste, or other potentially infectious materials

Justification Rationale:
(FAR) Subpart 6.302-5, "Authorized or required by statute," and VAAR 819.7007, "Sole source awards to a verified service-disabled veteran-owned small business." The use of sole source awards to an SDVOSB is allowable as long as the anticipated value of the contract, including any options, does not exceed $5 million.

A determination by the Contracting Officer confirms that only one SDVOSB is capable of providing the required goods/services due to their unique qualifications, and an award is in the best interest of the government.

This notice satisfies the requirement at FAR 5.201(b)(1), to publicize the proposed contract action. This notice of intent is not a request for competitive proposals and no solicitation will be made available. Any responses received will only be considered for the purposes of determining the marketplace for future procurements. The Government will not pay for information submitted. This will be the only notice of the Government's intent to solicit, negotiate, and award to one source to satisfy this requirement.
