I. STATEMENT OF PURPOSE:
1. Overview and Goals
The goal of this solicitation is to secure a source to purchase Siltation Removal for the Public Works
Department of the City of Tulsa.
2. Term of Contract
The City intends to award a one-year annual contract. The City may offer the Seller the opportunity
for additional one-year terms. The City also reserves the right to make multiple or partial awards. To
do business with the City, You must agree to the terms and conditions of the City’s standard
Purchase Agreement, indicated by Your Authorized Agent’s signature on the Purchase Agreement.
Capitalized terms used in this IFB and not defined in the Purchase Agreement shall have the
meanings as ascribed to them in Title 6, Chapter 4 of the Tulsa Revised Ordinances.
The entire Invitation for Bid (IFB), including any additional information submitted by Bidder and
Accepted by City will be included as part of the Agreement between Seller and City. All sheets of
this IFB (including Sections I-VI) must be submitted.
Authorized Agent
Several parts of the Bid (Affidavits, Purchase Agreement) must be signed by an “Authorized
Agent.” An Authorized Agent means an agent who is legally authorized to bind the Seller under the
law of the state in which the Seller is legally organized. For instance, under Oklahoma law, the
Authorized Agent for each of the following types of entities is as stated below:
o Corporations the president, board chair or board vice chair (or the vice president if the corporation
was formed in Oklahoma) can sign; others can sign if they have and provide the City with (i) a corporate
resolution giving them authority to bind the Seller, and (ii) a recent certificate of secretary indicating
the authority is still valid and was in full force and effect on the date of the signature. (See IFB Section
VI for sample of a Certificate of Secretary)
o General Partnerships any partner can sign to bind all partners.
o Limited Partnerships the general partner must sign.
o Individuals no additional authorization is required, but signatures must be witnessed and notarized.
o Sole Proprietorship the owner can sign. Any other person can sign if s/he provides a recent Power
of Attorney, signed by the owner, authorizing him/her to bind the sole proprietorship.
o Limited Liability Company (LLC) any manager of the LLC elected by the members of the LLC, or
any member signing as manager of the LLC. All other signers will need a Consent of Members signed
by all the Members of the LLC authorizing their signature on or up to 30 days before the date of their
signature. (See Section VI for sample of a Consent of Members)
Entities organized in states other than Oklahoma must follow the law of the state in which they are
organized.

II. SCOPE OF SERVICES AND SPECIFICATIONS
1. Scope of Services
The City is requesting Bids for Siltation Removal for use by the Public Works Department.
Delivery Requirements
All prices quoted shall be based on delivery F.O.B. Tulsa, Oklahoma or to any other points as may
be designated in the Specifications, with all charges prepaid by Seller to the actual point of delivery.
Bids must state the number of Days required for delivery under normal conditions.
Absolutely no items over 500lbs. may be directly shipped to the City requiring the City personnel to
unload from the shipping truck or trailer. The City carries no responsibility for any damages incurred
during an unloading occurrence. All unloading shall be the responsibility of the Seller and/or shipping
entity.
2. Specifications
The Bid must meet or exceed the following Specifications.
All Bidders are required to provide references for past work, equipment, and personnel lists
with their Bid.
The Seller will be responsible for compliance with all applicable federal, state, and municipal laws
and ordinances.
REQUIREMENTS:
1. Seller will provide unclassified excavation and/or clearing and grubbing services for projects as
directed in writing by the Public Works Department Representative. Services may include the use
of a survey level.
2. Seller is responsible for the use and maintenance of any grades existing on the project, and any
alteration of such grades must be agreed upon with the City representative in writing.
3. A minimum bed grade of .005 (one-half percent) to be maintained, if possible, on projects where
new grades are established.
4. Side slopes of the channels and creeks are to be constructed on a minimum of 3 horizontal to 1
vertical slope whenever possible.
5. Seller shall be responsible for any construction materials left or washed in the channels and
creeks. No obstruction to flow shall be left at the end of the work shift unless authorized by the City
in writing.
6. Finished grade must be able to receive sod application with no further preparation required.
7. The City will assume responsibility for re-vegetation of excavated areas as it deems necessary.
The excavated materials shall become the property of the Seller until disposal of in a pre-approved
designated area.

8. Transport
A. The City will direct the Seller to transport all dirt and excavated materials from the work site to the
City’s Land Reclamation Site (2100 N. 145th E. Ave) for work performed in the scope of this
Agreement. No dumping fees will be charged to the Seller for this site. The Seller may propose in
writing an alternate disposal site. If the City approves the site, the City will not incur additional
expense. All other material such as stumps, metal, asphalt, or tires shall be disposed of in a certified
landfill at the Seller’s expense.
B. The City will direct the Seller to transport all woody material to the City’s Land Reclamation Site.
No dumping fees will be charged at this site.
9. Utility locations are the responsibility of the Seller. Utility locates shall be requested at least 48
hours prior to any excavation. The City will not be liable for any damages involving the Seller’s work
where utility lines have been marked or not marked. Seller must use best practices such as potholing
around marked or suspected utilities to avoid damages and down-time. Work hours shall be at the
discretion of the Seller provided this work does not cause prolonged inconvenience to the public.
Work shall be done from 7:00 a.m. to 5:00pm Monday through Friday and not on Saturday, Sunday
or legal holidays (“Normal Hours”). The Public Works Department recognizes that minor overruns
beyond 5:00 p.m. may occur due to circumstances beyond the Seller’s control. The Public Works
Department’s inspector may waive this requirement on a specific day when, in their opinion, the
Seller was adequately prepared but was delayed by circumstances beyond their control. Work
scheduled outside Normal Hours must be pre-approved on a case-by-case basis by the Public Works
Department. Interference with traffic shall be kept to a minimum. The Seller will be required to adhere
to all federal, state, and municipal standards for traffic control. All associated costs shall be included
in the Bid price. On a case-by-case basis, the City of Tulsa will evaluate and determine if the Seller’s
traffic control is adequate. The City of Tulsa reserves the right to obtain safety traffic control
evaluations and estimates from a third-party vendor which must be implemented at the City’s
discretion and included on project invoices.
10. Street Repair:
A. DAMAGE TO STREETS
The Seller is responsible for restoring utilized streets to at least pre-construction condition. This shall
include all repairs, removal of mud or construction debris, etc. resulting from their construction
activities. No payment shall be made for this work; it shall be subsidiary to other items.
B. DUST CONTROL
The Seller shall take all necessary measures to control the incidence of airborne dust. This shall
include maintaining all haul areas in moist condition. No payment shall be made for this work; it shall
be considered to be subsidiary to other items.
C. MAINTENANCE OF DRAINAGE
The Seller shall schedule and execute work in such a way that the drainage area through the project
is, at no time, no less than that drainage area which currently exists. Diversion dikes, swales, dams,
etc. will be constructed in such a way that high water will wash them out of the way, thus ensuring
the free flow of water through the project and excluding any damage upstream due to construction

activities. The Seller shall be responsible for any damages occurring upstream of the project
because of their construction activities.
11. All Survey notes record, reproducible copies of maps and drawings shall be delivered to and
become property of the Public Works Department upon completion of the work.
12. The City and the Seller will agree in writing on the number of calendar days that Seller will need
to complete the work. Weather and ozone days will be used to adjust the completion date. If the
Seller consistently fails to complete a project within the approved timeframe, this will be cause to
move to the Secondary Seller.
13. The City will issue a letter of authorization to the Seller giving the location, the type of work to be
performed, and any necessary documents. The Seller will be required to begin work within seven
(7) workdays after receipt of authorization.
14. The Seller will perform the authorized work keeping the City notified of where and when Seller
will be working so that progressive inspections can be made. If the Seller takes exception to any
phase of the work, Seller should resolve those differences with the inspector before proceeding.
15. The City will progressively inspect the work.
16. The Seller will invoice City when all work on that authorization has been completed and
inspected on a calendar monthly basis. City inspector will review and authorize payment once
quantities or amounts have been agreed to or verified by the City.
17. The City will provide access to Seller to all City channels and creeks.
18. All vehicles to be used by Seller in performance of work under this Agreement shall bear signs
with the following wording:
COMPANY NAME
Contractor for City of Tulsa
The signs shall be posted in conspicuous locations, one on each side of the truck, as a minimum.
Signs and lettering shall be of a size which may be read from a distance of 50 feet. Signs must be
approved by City’s representative prior to commencement of work. These signs may be temporary
or removable magnet style or other as long as they are durable and remain visible during operations.
REPORTING
Seller will provide daily, weekly, and project completion reports on all equipment, services, and
products sold to the City of Tulsa.
