The Town of Acton, Massachusetts, invites sealed bids for the 17 Woodbury Lane Renovation and Addition, Bid No. 12/05/2024-1112, located at 472 Main St, Acton, Massachusetts, 01720, in accordance with Contract Documents prepared by Bargmann Hendrie + Archetype, Inc., 9 Channel Center Street, Suite 300, Boston, MA, 02210.
Bidding procedures shall be in accordance with the provisions of M.G.L Chapter 149, Section 44A through Section 44H, inclusive, and Chapter 30, Section 39M, as amended.
In order to be eligible and responsible to bid on this project, all Filed Sub-Bidders and General Bidders shall submit with their bid a current Certificate of Eligibility issued by the Division of Capital Asset Management and Maintenance, DCAMM, together with an Update Statement as required by M.G.L. Chapter 149, Section 44D.
Filed sub-bids will be required and taken for the following classes of work:
SECTION 040001 – MASONRY
SECTION 070002 – ROOFING AND FLASHING
SECTION 090007 – PAINTING
SECTION 220000 – PLUMBING
SECTION 260000 – ELECTRICAL

General Bids for the for the 17 Woodbury Lane Renovation and Addition, Bid No. 12/05/2024-1112 will be received no later than eleven (11:00) o’clock, AM, on Thursday, December 5, 2024.

Contract Documents will be available after two (2:00) o’clock PM on Thursday, October 31, 2024.
Bid Security shall be at least five percent (5%) of the greatest possible bid amount, considering all alternates.
The Bid Security in the form of a Bid Bond shall be:

In lieu of an insurance Bid Bond certificate, Bid Security in the form of cash, or a certified check, treasurer’s, or cashier’s check issued by a responsible bank or trust company and made payable to the Owner, and a completed Cash Bid Bond Affidavit form must be received by the Owner before the bidding deadline at the Town Manager’s Office, 472 Main Street, Acton MA 01720. In addition, the Bidder must also submit the completed Cash Bid Bond Affidavit form with their E-Bid online at

Each bidder is advised to visit the site of the proposed work, become fully acquainted with conditions as they exist, and thoroughly examine the Contract Documents. Failure of any bidder to visit the site, and to examine the Contract Documents shall in no way relieve the bidder from any obligation with regard to the bid as submitted. Arrangements for site visitation, during the bidding period, may be made in the manner set forth in the INSTRUCTIONS TO BIDDERS.
A non-mandatory pre-bid conference will be held at eleven (11:00) o'clock AM, at the site on Thursday, November 14, 2024.
The successful Bidder will be required to provide a labor and materials payment bond in the amount of 100 percent of the Contract Amount, issued by a company authorized to do business in Massachusetts and satisfactory to the Awarding Authority.
The minimum wages to be paid for all labor on the project are established in a schedule issued by the Commissioner of Labor and Industries, in accordance with Section 26A - 27D inclusive, of Chapter 149 of the M.G.L., as amended, said schedule being made a part of the Contract Documents and is included therein.
Materials, equipment and supplies to be used on this project are exempt from sales tax to the extent provided by M.G.L. Chapter 64H, Section 6(f).
The successful Bidder must agree to commence work upon receipt of Notice to Proceed, and to cause all work of this Contract to be Substantially Completed not later than 300 calendar days after the Notice to Proceed.
In case that the work is not certified by the Architect to be Substantially Complete, as defined in the GENERAL CONDITIONS within 300 calendar days after the Notice To Proceed, it shall be agreed and understood that the Owner may deduct from sums otherwise due and payable under the Contract, the amount of Two Hundred Fifty Dollars ($250.00) for each calendar day after which the Substantial Completion date, or authorized extension thereof, was required, up to and including the date that Substantial Completion of the work is certified by the Architect. This provision shall apply, not as a penalty, but as liquidated damages.
The bidder agrees that its bid shall be good and may not be withdrawn for a period of 30 days, Saturdays, Sundays and legal holidays excluded, after the opening of the bids.
The Awarding Authority reserves the right to waive any informalities, to accept or reject, in whole or in part any or all bids, or take whatever other action may be deemed to be in the best interest of the Town of Acton.
