1. PURPOSE
The City of New Bern is seeking Statements of Qualifications from qualified Design-Build firms or teams
to provide design and construction services for a new concrete skate park at Seth West Parrott Park in
New Bern, North Carolina.
The selected Design-Builder will work with the City through public input, conceptual design, final design,
permitting, construction, project closeout, and warranty.
The City anticipates a project budget of approximately $300,000 and is targeting completion in Early
2027.
The project site is located within Seth West Parrott Park as generally shown on Attachment C - Site Map.
2. PROCUREMENT METHOD
The City intends to procure this project using the Design-Build project delivery method.
The Design-Builder will be selected through a qualifications-based process. Firms should not submit
project pricing, design fees, construction fees, or other fee proposals unless specifically requested by the
City during subsequent negotiations.
Design-Build firms will be selected based upon demonstrated competence and qualifications without
regard to fee at the initial selection stage. Project-specific design work product will not be solicited or
considered during the qualifications stage. Prior completed work and discussion of project approaches
and schedules may be considered.
2.1 Project-Team Selection
Respondents shall identify the licensed contractors and design professionals proposed for the project
and explain the project-team and subcontractor-selection approach they intend to use.
The proposed approach must comply with applicable North Carolina law.
Each respondent shall certify that each design professional proposed as part of the Design-Build team,
including subconsultants, was selected based upon demonstrated competence and qualifications.
2.2 Small-Business Participation
The City encourages a good-faith effort to recruit and select qualified small-business entities in
connection with this project.
Respondents shall briefly describe their approach to identifying, recruiting, and providing participation
opportunities to qualified small-business entities as part of their proposed project-team and
subcontractor-selection strategy.
The City has not established a project-specific small-business participation goal or percentage for this
RFQ. No minority- or women-owned business participation goal is established or required.

4. SCOPE OF WORK
The selected Design-Builder shall provide the following services:
* Participate in two public meetings to gather input on the proposed design and expected use
(skateboard, BMX, in-line skates, etc. ) of the skatepark.
* Develop three (3) conceptual design options, based on input from City staff, previous surveys, and
public meetings that can be implemented within the proposed budget parameters.
* Develop a complete project cost estimate to include all required services, costs and contingencies to
assure budget compliance
* Develop a complete set of construction drawings and specifications for the project that meet all
applicable code requirements.
* Plans must be sealed by a design professional licensed in the State of North Carolina.
* Obtain all required permits.
* Construct the facility according to the construction documents.
* Provide proper concrete curing systems or methods. The City of New Bern will conduct independent
verification and testing of materials as needed.
* Complete close-out of the project including punch list development and a two (2) year full warranty
coverage on all materials and workmanship. A written warranty shall be provided to the City of New
Bern at the completion of the contract.
* City of New Bern to provide a site ready pad for construction.
5. SCOPE CLARIFICATIONS
5.1 Project Budget
The anticipated project budget is $300,000.
The budget will guide conceptual design, cost estimating, value engineering, contract negotiations, and
development of the final project scope.
During negotiations, the selected Design-Builder may identify that the desired scope cannot reasonably
be delivered within the anticipated budget. If that occurs, the City may consider adjustments to scope,
value engineering, phasing, alternates, or additional authorized funding.

Any final contract obligation is subject to legally available and authorized funds.
5.2 City-Provided Site Ready Pad
The City will provide a site-ready pad for construction.
Before execution of the final Design-Build agreement, the City and selected Design-Builder will confirm
the limits and existing condition of the site-ready pad and establish responsibility for any additional site
preparation, grading, drainage, compaction, utilities, or related work necessary for construction.
Work not included within the City's site-ready-pad responsibility will be addressed as part of the
negotiated project scope and cost.
6. STATEMENT OF QUALIFICATIONS REQUIREMENTS
Respondents should organize Statements of Qualifications in the following order.
6.1 Company Information
Provide general information about the company including but not limited to: Years in business, history
and experience in similar or larger skate park projects, number of projects completed, similar projects,
litigation, etc.
Include resumes of key Professional and Managerial Personnel, which shall clearly identify the role that
the professional and managerial personnel played in previous design and construction projects within the
last three (3) years.
Briefly describe other projects executed by your firm that demonstrate relevant experience, specifically
highlighting experience with designing/constructing skate parks, and incorporating street/plaza style
elements for multi-users (i.e. skateboards, inline, BMX, etc...).
List public sector clients for whom you have performed similar work in the past five (5) years, including
project budget and if the project was completed on time and within budget.
Demonstrate experience leading complex public process with a variety of stakeholders and interests,
particularly communities building a skate park for the first time.
Highlight experience with local involvement, community outreach, and engagement during the
design/construction/completion of the project.
For each project mentioned, include name and contact information for a person who can be contacted
regarding your performance on that project.
Note all skate park projects you have completed in North Carolina.
Provide a minimum of five (5) references. (municipalities preferred).
6.2 Project Schedule
The City desires completion of the project in Early 2027.
Confirm your firm's availability to perform the work and provide a proposed project schedule showing
general activities and anticipated durations, including a realistic anticipated start and completion
schedule.

The proposed schedule will be considered as part of the City's evaluation and ranking.
6.3 Guarantee and Warranty
Describe any guarantee or warranty provided to the City on the concrete skate park. Describe the
remedies available for the correction of any defective skate elements or flatwork, including moisture and
other potential defects.
6.4 Conceptual Design
Include up to six designs of similar project scope that your firm has built in the last five years. Brochures
or other materials that may be helpful in evaluating your firm may be included in an appendix of the
Statement of Qualifications.
For purposes of this RFQ, this requirement is limited to examples of prior completed work.
Respondents shall not prepare or submit a project-specific conceptual design for the City of New Bern
skate park as part of the Statement of Qualifications.
This protects the qualifications-based nature of the selection process; applicable law allows prior
completed work but prohibits project-specific work product or design from being solicited or considered
as part of this stage.
6.5 Design-Build Team and Team Selection
Provide information concerning the proposed Design-Build team, including:
* Identification of the proposed Design-Builder.
* Identification of the North Carolina licensed general contractor.
* Identification of the design professionals and other key firms or personnel proposed for the project.
* Roles and responsibilities of key team members.
* An explanation of the proposed project-team and subcontractor-selection strategy.
* A certification that each design professional proposed as part of the Design-Build team, including
subconsultants, was selected based upon demonstrated competence and qualifications.
* Evidence of the firm's ability to furnish the required performance and payment bonds.
7. QUESTIONS, ADDENDA AND SUBMISSION REQUIREMENTS
7.1 Questions
Questions concerning this RFQ shall be submitted in writing to:

Questions must be received no later than Friday, August 28, 2026 at 12:00 noon.
Responses determined by the City to require clarification or modification of the RFQ will be issued by
written addendum.
Only information issued by the City through a written addendum shall modify or supplement the RFQ.

7.2 Submission Requirements
Respondents shall submit five (5) copies of the Statement of Qualifications in a sealed package.
The package shall be clearly marked: SKATE PARK DESIGN-BUILD SERVICES - RFQ

Statements of Qualifications must be received no later than Tuesday, September 8, 2026 at 2:00 p.m.
Electronic and fax submissions will not be accepted.
Late Statements of Qualifications will not be considered.
7.3 Attachment A
A completed and signed Attachment A - Statement of Qualifications Submission and Certification Form
shall be included immediately following the cover letter, if a cover letter is provided.
Failure to submit the required signed certification may cause the Statement of Qualifications to be
determined nonresponsive.
7.4 Price and Fee Information
Respondents shall not include:
* Project price;
* Design fees;
* Construction fees;
* Fee proposals; or
* Other project-specific cost proposals,
unless specifically requested by the City consistent with applicable law.
The project schedule and information concerning prior project budgets may be provided as expressly
requested elsewhere in this RFQ.
8. GENERAL TERMS AND CONDITIONS
8.1 Contract
The selected Design-Builder will be required to enter into a written agreement with the City of New Bern.
Respondents should review the City's Purchase Order Terms and Conditions included as Attachment B
before submitting qualifications.
The final agreement will establish the complete scope, compensation, schedule, responsibilities,
insurance, bonding, and other contractual requirements.

8.2 Funding
The anticipated project budget is approximately $300,000.
Any contractual obligation is subject to legally available, authorized, and unencumbered funds.

8.3 Purchase Order and Contract Documents
A City purchase order will be issued following successful negotiations, execution of the required
agreement, and completion of applicable financial approvals.
The City of New Bern Purchase Order Terms and Conditions, included as Attachment B to this RFQ,
shall be incorporated into and made a part of any resulting agreement and City purchase order, except to
the extent expressly modified by the final written agreement and permitted by applicable North Carolina
law.
8.4 Insurance
Unless otherwise approved by the City based upon the final scope and project risk, the selected Design-
Builder shall maintain applicable insurance meeting the City's requirements, including:
* Commercial General Liability: $1,000,000 per occurrence. The City of New Bern shall be named as
an additional insured.
* Professional Liability: $1,000,000 per occurrence for applicable professional services.
* Workers' Compensation: Statutory limits.
* Employers Liability: $500,000 each accident; $500,000 each employee for disease; and $500,000
policy limit for disease.
* Automobile Liability: $1,000,000 per occurrence.
8.5 Bonding Capacity
Respondents are not required to submit executed performance or payment bonds with the Statement of
Qualifications.
Respondents shall provide evidence demonstrating the ability to obtain the required bonds.
Before construction begins, the selected Design-Builder shall furnish performance and payment bonds in
accordance with applicable North Carolina law.
The City's anticipated contract requirement is:
* Performance Bond: 100% of the construction contract amount
* Payment Bond: 100% of the construction contract amount
The surety shall be authorized to transact business in North Carolina.
Bond costs shall be included in the negotiated contract amount.
8.6 Payment Terms
Payment terms are Net 30.
The City will not pay late charges or finance charges except where expressly authorized by law and
agreed to by the City.

8.7 Availability of Funds and Preaudit
No obligation may be incurred unless sufficient authorized and unencumbered funds are available.
Any written contract or agreement requiring payment of money must comply with applicable preaudit
requirements under the North Carolina Local Government Budget and Fiscal Control Act.
8.8 Licensing
The Design-Builder and members of its proposed team shall maintain all licenses, registrations,
certifications, and permits required to perform their respective portions of the work in North Carolina.
Plans shall be sealed by a design professional licensed in the State of North Carolina as required by the
Scope of Work.
8.9 Other City Requirements
The selected Design-Builder shall comply with applicable City contract requirements, including as
applicable:
* Indemnification;
* Termination;
* North Carolina governing law;
* E-Verify requirements;
* Independent contractor requirements;
* Public records requirements;
* Confidential information requirements;
* Nondiscrimination requirements;
* Applicable taxes;
* Written amendments and change orders;
* Applicable building codes;
* Permitting;
* Accessibility requirements; and
* Professional and contractor licensing requirements.
9. EVALUATION AND RANKING
Statements of Qualifications determined to be responsive will be evaluated using the following criteria.

9.2 Rating Definitions
Excellent - Exceptional response demonstrating highly relevant qualifications, experience, and capability
with little or no meaningful weakness.
Good - Strong response that fully addresses the criterion, demonstrates relevant qualifications and
experience, and contains only minor weaknesses.
Acceptable - Meets the criterion and demonstrates adequate capability, but contains limited
distinguishing strengths or identifiable weaknesses.
Marginal - Partially meets the criterion and contains significant weaknesses, concerns, or insufficient
information.
Unacceptable - Does not adequately address the criterion or demonstrate the capability necessary to
perform the work.
Evaluators shall use whole-number scores only.
9.3 Mandatory Compliance Review
Before numerical evaluation, the City may review each Statement of Qualifications for compliance with
mandatory submission requirements, including:
* Received by the required deadline;
* Required sealed copies provided;
* Signed Attachment A provided;
* Required North Carolina licensing demonstrated;
* Design-professional qualifications certification provided;
