SOLICITATION FOR BIDS
SEALED PROPOSALS for the REHABILITATE RUNWAY 2-20 AND TAXIWAY “E” SOUTH (FAA AIG No. 3-05-0024-065-2026 and FAA AIP No. 3-05-0024-065-2026) at the Fort Smith Regional Airport, Fort Smith, Arkansas will be received by Fort Smith Airport Commission (Owner) in the Conference Room on the Second Floor of the Terminal Building, 6700 McKennon Blvd., Fort Smith, Arkansas, 72903 until 10:00 A.M. CDT on Tuesday, April 28, 2026 at which time the sealed proposals will be publicly opened and read aloud. Sealed proposals submitted prior to the bid opening time should be sent to the Fort Smith Regional Airport, ATTN: Lindsay Conley, 6700 McKennon Blvd., Fort Smith, AR 72903.
A NON-MANDATORY PRE-BID MEETING will be held at the Fort Smith Regional Airport Fort Smith, Arkansas in the Conference Room on the Second Floor of the Terminal Building, 6700 McKennon Blvd., Fort Smith, Arkansas, 72903 at 10:00 A.M. CDT on Tuesday, April 21, 2026. There are no limits on number of participants, but prospective bidders are encouraged to limit participation to necessary personnel. In lieu of attending the meeting in person, prospective bidders may attend virtually.
THE PROJECT generally consists of the rehabilitation of Runway 2-20 and Taxiway E South per FAA specifications, including, but not limited to, profile milling, asphalt overlay, reconstruction of a section of Runway 2-20, earthwork, pavement markings, taxiway lighting and sign modifications, among other related items of work.
THE CONTRACT DOCUMENTS ARE ON FILE at the office of the ENGINEER, Halff Associates, Inc. at 5704 Euper Lane, Suite 200, Ft. Smith, Arkansas. Addendums to the bid package will be issued through QuestCDN only, therefore all Prime Bidders shall be responsible for registering and downloading the bid documents to be included on the Plan Holders List on QuestCDN. No paper copies will be issued by the Engineer or Fort Smith Regional Airport.
PROPOSALS shall be accompanied by a proposal guaranty in the form of a bid bond executed by a reliable Surety Company, or a certified or cashier’s check drawn on a National Bank or a bank having membership in the Federal Reserve System. The proposal guaranty shall be in an amount not less than five percent (5.0%) of the total amount bid made payable without recourse to the Fort Smith Airport Commission as a guarantee that the Bidder will enter into a contract, including execution of payment and performance bonds, within fifteen (15) calendar days after notice of award of a contract by the Owner.
Required contract provisions required for FAA AIP construction projects are included in the contract documents and include the following provisions, among others: Affirmative Action Requirements, Buy-American Preference, Civil Rights – Title VI Assurances, Davis-Bacon Labor Provisions, Debarment and Suspension, Disadvantaged Business Enterprise, Federal Fair Labor Standards Act, Foreign Trade Restriction, Lobbying Federal Employees, Prohibition of Covered Unmanned Aircraft Systems (UAS), and Procurement of Recovered Materials.
The requirements of 49 CFR Part 26 including any amendments thereto apply to this contract. It is the policy of the Fort Smith Airport Commission to practice nondiscrimination based on race, color, sex, or national origin in the award or performance of this contract. The Owner encourages participation by all firms qualifying under this solicitation regardless of business size or ownership.
The Owner’s award of this contract is conditioned upon Bidder or Offeror satisfying the good faith effort requirements of 49 CFR § 26.53 to subcontract a minimum of 12.65% of the dollar value of the prime contract with small businesses owned and controlled by socially and economically disadvantaged individuals (DBE).
The Contractor shall provide written notification to the Director of the Office of Federal Contract Compliance Programs (OFCCP) within 10 working days of award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation.
The notification shall list the name, address, and telephone number of the subcontractor; employer identification number of the subcontractor; estimated dollar amount of the subcontract; estimated starting and completion dates of the subcontract; and the geographical area in which the subcontract is to be performed. As used in this notice and in the contract resulting from this solicitation, the “covered area” is Arkansas, Sebastian County, City of Fort Smith.
All contracts and subcontracts that result from this solicitation incorporate by reference the provisions of 29 CFR Part 201, et seq, the Federal Fair Labor Standards Act (FLSA), with the same force and effect as if given in full text. The FLSA sets minimum wage, overtime pay, recordkeeping, and child labor standards for full and part-time workers. The Contractor has full responsibility to monitor compliance to the referenced statute or regulation. The Contractor must address any claims or disputes that arise from this requirement directly with the U.S. Department of Labor – Wage and Hour Division.
Davis-Bacon Act wage rules shall apply. Mechanics and Laborers on the project shall be paid not less than the minimum hourly rates set forth in Davis-Bacon Decision Number AR20260172, a copy of which is included in the contract documents. All laborers and mechanics employed by contractors and subcontractors on projects funded directly by or assisted in whole or in part by and through the Federal Government shall be paid wages at rates not less that those prevailing on projects of a character similar in the locality as determined by the Secretary of labor in accordance with the subchapter IV of Chapter 31 of Title 40, United States Code. The Department of Labor provides all pertinent information related to compliance with labor standards, including prevailing wage rates and instructions for reporting. Refer to www.wdol.gov .
No Proposal may be withdrawn within ninety (90) calendar days after the date of opening of Proposals.
The awarding of this contract work is contingent upon the Fort Smith Airport Commission’s receipt of sufficient funding from the Federal Aviation Administration.
The Fort Smith Airport Commission reserves the right to reject any or all bids, to waive technicalities/irregularities in the bids.
The successful bidder must furnish a payment and performance bond upon the form provided in an amount equal to one-hundred percent (100%) of the total contract price from an approved surety company licensed in the State of Arkansas to act as a surety, or other surety acceptable to the Owner.
