RFP INSTRUCTIONS AND CONDITIONS
PAPER GOODS & SUPPLY PRODUCTS 2026/2027 SY
SUBMITTING PROPOSALS: Each Proposal must be received in the Nutrition Services Department, San
Jacinto Unified School District, 221 Bissell Place, San Jacinto, California, 92582 no later than Tuesday,
May 12, 2026 at 8:00 AM. Envelopes containing a Proposal must be sealed, prominently marked with
the RFP number, RFP title, RFP opening time/date, and name of the bidder.
RESPONSIBILITY: All Proposal documents shall be signed with the firm name and by a responsible officer
or employee, as acknowledgment that all documents were received and reviewed.
CORRECTIONS: All prices and notations shall be typewritten or in ink. No erasures will be
permitted. Mistakes must be identified and corrected prior to the final date and time. Mistakes may be
crossed out and corrections made adjacent and shall be initialed, in ink, by the person signing the
proposal. Verify your proposals before submission.
ACCEPTANCE: Propose each item separately. Prices shall be stated in units specified. The Board will not
be responsible for errors in extensions. The right is reserved to reject any or all Proposals; to waive any
irregularities or informalities in any Proposal; and to accept or reject any items in the Proposal. No Proposer
may withdraw their Proposal for a period of sixty (60) days after the date set for opening thereof.
TIE PROPOSALS: Whenever Proposals are equal, preference shall be given to firms with whom the District
has had satisfactory business relationships.
CONFLICT OF INTEREST: The Proposer shall not, under penalty of law and immediate disqualification of the
Proposal, offer or give any gratuities, favors or anything of monetary value to an officer, employee, agent,
or Board of Education of the District for the purpose of influencing favorable disposition toward a
submitted Proposal or for any reason while a Proposal is pending or during the evaluation process.
RFP PROTEST PROCEDURE: Any Proposer may file a bid protest. The protest shall be filed in writing with the
District's Assistant Superintendent, Business Services not more than five (5) business days after the date of
the RFP opening. By filing the protest, the Proposer protesting consents to receipt of e-mail notices for
purposes of the protest and protest related questions and protest appeal, if applicable. The protest shall
specify the reasons and facts upon which the protest is based.
A. Resolution of RFP Controversy: Once the RFP protest is received, the apparent lowest responsible
proposer will be notified of the protest and the evidence presented. If appropriate, the apparent
low proposer will be given an opportunity to rebut the evidence and present evidence that the
apparent low proposer should be allowed to perform the work. If deemed appropriate by the
District, an informal hearing will be held. The District will issue a written decision within fifteen (15)
calendar days of receipt of the protest, unless factors beyond the District's reasonable control
prevent such resolution. The decision on the RFP protest will be copied to all parties involved in
the protest.
B. Appeal: If the protesting Proposer or the apparent low Proposer is not satisfied with the decision,
the matter may be appealed to the District's Assistant Superintendent, Business Services, or their
designee, within three (3) business days after receipt of the District's written decision on the RFP

protest. The appeal must be in writing and sent via overnight registered mail with all
accompanying information relied upon for the appeal and an e-mail address from which
questions and responses may be provided to:

C. Appeal Review: The District's Assistant Superintendent, Business Services or their designee shall
review the decision on the RFP protest with the Director of Nutrition Services and issue a written
response to the appeal, or if appropriate, appoint a Hearing Officer to conduct a hearing and
issue a written decision. The written decision of the District's Assistant Superintendent, Business
Services or the Hearing Officer shall be rendered within fifteen (15) calendar days and shall state
the basis for the decision. The decision concerning the appeal will be final and not subject to any
further appeals.
WITHDRAWAL OF PROPOSAL: Withdrawal of RFPs prior to due date: Any proposal may be withdrawn, either
personally or by written request, at any time prior to the scheduled closing time for receipt of RFPs. No
proposer may withdraw an RFP submission for a period of sixty (60) calendar days after the date set for
the opening of the RFPs.
SUBSTITUTIONS: Use of patent or proprietary names or the names of manufacturers in these specifications
shall be deemed to be used for the purpose of facilitating a description and shall be deemed to be
followed by the words "or equal" unless the Proposal specifically requires no substitutions. When submitting
Proposals on brands other than those specified, the Proposer must state on the Proposal the brand,
quality, code number, or other trade designation on each item Proposal other than "as specified".
Proposer shall furnish samples and/or full descriptive information covering the product proposed on,
properly marked and showing item number and page number on each sample or description before
closing time of Proposal.
QUALITY: All workmanship, materials, and articles incorporated in the items covered by this specification
shall be of the best available grade of their respective kinds for the purpose for which the items are to be
used. All equipment shall be new unless otherwise specified.
AUDITS AND INSPECTIONS: The Awarded Vendor shall submit to third party audits and/or inspections
initiated by the District during the term of the contract and for one year following the end of the contract.
Audits and/or inspections will serve to ensure compliance with contract terms, food safety guidelines,
pricing, and billing. The Awarded Vendor must take steps to correct findings identified during audits
and/or inspections, including financial restitution for any pricing or billing errors which may have occurred
during the length of the contract period.
SAMPLES AND TESTING: If the Proposer is proposing items/brands other than those specified or if no brand
is indicated in the RFP documents, the following shall apply:
A. Complete specifications, descriptions, and photographs/sketches shall be submitted with the
Proposal.
B. Samples will be requested after the preliminary bid review to evaluate products that conform to
the District's needs. Once samples are requested, the Proposer will have seven (7) calendar days to
submit to:

C. Samples must be submitted free of expense.
D. All packages containing samples must be clearly labeled with the Proposal number and each
sample shall be clearly identified, with the vendor name, and corresponding to the RFP line item to
be considered.
E. Samples which do not comply with these instructions may not be considered for award.
F. All samples become the property of the District unless the Proposer prearranges return
shipment.
The final decision as to whether the material or product is considered equal to a specified item shall be
made by the District. In all cases, when a sample is taken from a shipment and sent to a public testing
laboratory and the test shows that the sample does not comply with the specifications, the vendor shall
pay the cost of the tests. In all cases, the District reserves the right to test item/s as it deems necessary.
PATENT INFRINGEMENTS: The Proposer shall hold the San Jacinto Unified School District, its officers, agents,
servants and employees, harmless from liability of any nature or kind on account of use of any
copyrighted or uncopyrighted composition, secret process, patented invention, article, or appliance,
furnished or used, under this Proposal.
DELIVERY: It is understood that the Proposer agrees to deliver all items on which Proposals are
accepted. All costs for delivery, drayage, freight, or the packing of said articles are to be borne by the
Proposer. No additional fees shall be charged for small orders. A purchase order number shall appear
on all delivery receipts and invoices. All shipments shall be accompanied by a delivery receipt.
Additionally, all prices offered by the Proposer must include on site off loading and inside
delivery. Deliveries will be to the following site
* Nutrition Services Warehouse, 221 Bissell Place, San Jacinto CA 92582
Nutrition Services Warehouse receives deliveries on a first come first serve basis on Wednesday between
the hours of 6:00 a.m. - 12:00 p.m. Anytime other than what is stated in this RFP is subject to rejection by
the district.
In the event of an emergency, the below sites may also need a delivery:
* San Jacinto High School, 500 Idyllwild Drive, San Jacinto CA 92583, located approximately 1.60
miles from the Nutrition Services Warehouse
* North Mountain Middle School, 1202 E. 7th Street, San Jacinto CA 92583, located approximately
3.0 miles from the Nutrition Services Warehouse
* Monte Vista Middle School, 425 N. Lyon Avenue San Jacinto CA 92582, located approximately
1.40 miles from the Nutrition Services Warehouse
* San Jacinto Leadership Academy, 181 North Ramona Blvd. San Jacinto CA 92583, located
approximately 1.10 miles from the Nutrition Services Warehouse
COMMENCEMENT OF DELIVERIES: After receiving written notification of award, each Awarded Vendor
shall be required to commence with the delivery of all items, which have been awarded immediately
after receipt of a participating district purchase order.
PALLETS: All deliveries must be delivered on pallets. Pallets used for product delivery must meet the
following specifications:
* Deliveries shall be made on a standard wooden pallet 40"x 48" Construction/Grade Premium A
or Premium B

* Products and/or cases must have the identifying labels facing out, and all items shall be unitized,
e.g. all like items on the same pallet
* Different items must be separated by a pallet
Vendors not in compliance with this requirement will be required to transfer their product onto a District
provided 40"x 48" pallet at the time of delivery. Deliveries made on specified pallets will be exchanged
at the time of delivery.
Product delivered on standard wood pallets MAY NOT HAVE any of the following conditions:
* Broken top or bottom boards
* Broken stringer/s
* More than one repaired stringer (including the metal 'studs')
* Thin deck boards (less than 34 inch)
* Double stringers that a forklift or pallet jack cannot be used to move the pallets
Any product that fails to be delivered within these parameters will be rejected.
NON-PROPOSERS: If a Proposal is not made, please submit the "No Submittal Response" form and notify
the District if you wish to remain on the mailing list.
INTERPRETATIONS OF PROPOSAL DOCUMENTS: All interpretations of the Proposal conditions and/or
specifications shall be made only by written addendum. The District shall not be responsible for any other
explanation or interpretation of the Proposal document.
PROPOSAL NEGOTIATIONS: A Proposal response to any specific item of this Proposal with terms such as
"negotiable", "will negotiate", or similar, will be considered non-responsive to that specific item.
INTERVIEWS: The District may, at its option, conduct interviews after receipt of proposals.
METHOD OF AWARD: In accordance with Senate Bill 544, the District reserves the right to contract with any
Vendor responding to this RFP, to reject any proposal as non-responsive, and to not contract with any
Vendor for the services described herein, whichever is determined to be in the best interest of the District.
A successful bidder must be able to deliver the items within the required delivery schedule in order to be
declared responsive to this proposal. As indicated, additional criteria will be utilized in evaluating the
proposal award which could result in the proposal not being awarded solely on lowest price and the
District shall not be obligated to accept the lowest priced proposal. Evaluation criteria may include, but
is not limited to:
* Pricing - 30 points
* Qualifications and Experience - 25 points
* Technical Abilities - 20 points
* Quality and Completeness of Proposal - 20 points
* Small business, Minority-owned, Woman-Owned & Disabled Veteran Business - 5 points
TOTAL POINTS POSSIBLE 100
The decision resulting from the evaluation process as to which proposal best meets the needs of the
District remains the sole responsibility of the District and is final.
NON-EXCLUSIVITY AND MULTIPLE AWARDS: Any contract resulting from this RFP is non-exclusive. The District
reserves the right to make no awards or award one or more contracts, in part or in whole, to a single
Vendor or to multiple Vendors.

COMMUNICATION OF AWARD: Proposal awards made by the Board of Education shall not become
binding upon the School District until communication in writing to the successful Proposer.
LEGAL REQUIREMENTS: All Proposers are required to comply with and be bound by all applicable
provisions of law whether or not referred to herein.
DRUG-FREE WORKPLACE CERTIFICATION: Pursuant to Government Code Sections 8350 et seq., the
successful Proposer will be required to execute a Drug-Free Work Place Certificate prior to execution of
the agreement. The Proposer will be required to take positive measures outlined in the certificate in
order to insure the presence of a drug-free workplace. Failure to submit a proposal with the conditions
set forth in the Drug-Free Workplace Act could result in penalties including termination of the
agreement or suspension of payment thereunder. Failure to submit this form, included in this Proposal,
may result in your Proposal being rejected.
DEPT. OF EDUCATION-CHILD NUTRITION DIVISION FORMS: Per the California Department of Education,
Child Nutrition and Food Distribution Division, and the School Nutrition Programs Unit, the attached forms
must be completed and submitted with proposal:
* Debarment, Suspension and Other Responsibility Matters
* Certification Regarding Lobbying & Disclosure of Lobbying Activities
* Iran Contracting Act Certification Form
* Buy American Certification
Proposals received without these forms/certifications may not be considered.
BUY AMERICAN PROVISIONS: Pursuant to Section 12(n) of the National School Lunch Act (NSLA) (42 United
States Code Section 1760[n]), as added by Section 104(d) of the William F. Goodling Child Nutrition
Reauthorization Act of 1998 (Public Law 105-336), San Jacinto Unified School District will purchase
domestic commodities or products to the maximum extent practical.
San Jacinto Unified School District will comply with 7 CFR, sections 210.21[d] and 220.16[d], and CDE
Buy American Provision Management Bulletin SNP-01-2025, including the definitions defined below,
when purchasing food products served in the school meals programs.
Pursuant to Title 7 CFR, sections 210.21(d) and 220.16(d), SJUSD defines "domestic commodity or
product" as an agricultural commodity that is produced in the United States (U.S.), and a food product
that is processed in the U.S. substantially using agricultural commodities produced in the U.S. USDA
Policy Memorandum SP 38-2017 specifies that a product's food component (defined in 7 CFR, section
210.21) is considered the agricultural product.
Regulations define substantially to mean that food products must consist of over 51 percent of
agricultural commodities that were grown domestically. USDA policy further clarifies foods that are
unprocessed must be domestic, and foods that are processed must be 1) processed domestically, and
2) comprised of over 51 percent domestically grown items by weight or volume.
In addition, San Jacinto Unified School District procurements for harvested fish will meet the following
requirements: 1) Farmed fish must be harvested within the U.S. or any territory possession of the U.S.; 2)
Wild caught fish must be harvested within the Exclusive Economic Zone of the U.S. or by a U.S. flagged
vessel.

San Jacinto Unified School District will require a certification of domestic origin for products that do not
have country of origin labels.
San Jacinto Unified School District may purchase non-domestic foods when it is determined that one of
the following limited exceptions is met:
1. The product is listed on the Federal Acquisitions Regulations (FAR) Nonavailable articles list found
at 48 Code of Federal Regulations (CFR), Section 25.104 and/or is not produced or
manufactured in the U.S. in sufficient and reasonably available quantities of a satisfactory
quality; or
2. Competitive bids reveal the costs of a domestic product are significantly higher than the non-
domestic product.
* Beginning in School Year (SY) 2025-26, the non-domestic food purchases cap will be
10 percent.
* Beginning in SY 2028-29, the non-domestic food purchases cap will be 8 percent.
* Beginning in SY 2031-32, the non-domestic food purchases cap will be 5 percent.
CLEAN AIR ACT: Clean Air Act ( 42 U.S.C. 7401- 7671q.) and the Federal Water Pollution Control Act
( 33 U.S.C. 1251- 1387), as amended - Contracts and subgrants of amounts in excess of $150,000 must
contain a provision that requires the non-Federal award to agree to comply with all applicable
standards, orders or regulations issued pursuant to the Clean Air Act ( 42 U.S.C. 7401- 7671q) and the
Federal Water Pollution Control Act as amended ( 33 U.S.C. 1251- 1387). Violations must be reported to
the Federal awarding agency and the Regional Office of the Environmental Protection Agency (EPA).
SMALL BUSINESS, MINORITY-OWNED, WOMAN-OWNED, AND DISABLED VETERAN BUSINESS ENTERPRISES
(MUST BE SUBMITTED WITH PROPOSAL IF APPLICABLE): Small Business, minority, woman and disabled veteran
business enterprises are encouraged to participate in this RFP solicitation opportunity. Qualified Proposers
that meet federal requirements shall submit documentation of qualification and copy of certification with
proposal.
IRAN CONTRACTING ACT: Pursuant to Public Contract Code 2204 (a) A public entity shall require a person
that submits a proposal or proposal to, or otherwise proposes to enter into or renew a contract with, a
public entity with respect to a contract for goods or services of one million dollars ($1,000,000) or more to
certify, at the time of the proposal is submitted or the contract is renewed, that the person is not identified
on the list created pursuant to subdivision (b) of Section 2203, as a person engaging in investment
activities in Iran described in subdivision (a) of Section 2202.5, or as a person described in subdivision (b)
of Section 2202.5, as applicable. Failure to do so will deem your proposal as non-responsive.
SAFETY REGULATIONS: All equipment and supplies furnished, and/or all work performed, shall meet all
applicable safety regulations of the Division of Occupational Safety and Health of the State of
California and Safety and Health Codes of the State of California (Cal Code).
AFFIRMATIVE ACTION: The Proposer shall certify that it is an Equal Opportunity Employer and has made a

NON-COLLUSION DECLARATION: A signed Non-Collusion Declaration must be completed by the
Proposer and submitted as part of proposal. Proposals without a signed Non-Collusion Declaration
cannot be accepted (form enclosed).
EQUAL EMPLOYMENT OPPORTUNITY: Bidders shall comply with all equal employment opportunity
provisions of federal, state and local non-discrimination laws, orders, regulations and guidelines as may
be applicable to the bidder and be in effect during the performance of the Contract. The bidder shall
certify that he is an Equal Opportunity Employer and has made a good faith effort to improve minority
employment and agrees to meet federal and state guidelines. No discrimination shall be made in the
employment of persons upon public projects because of the sex, race, color, national origin or ancestry,
religion, or handicap of such persons.
INSURANCE: Without in any way affecting the indemnity obligations required under the Purchase
Agreement Form ("Agreement" or "Contract"), the bidder shall secure and maintain throughout the
Agreement the following types of insurance with limits as shown.
Workers' Compensation (According to Labor Code Section 3700) - A program of Workers'
Compensation insurance or a State-approved Self-Insurance Program in an amount and form to meet
all applicable requirements of the Labor Code of the State of California, including Employer's Liability in
accordance with the laws of the state of California, however, such amount shall not less than One
Million Dollars ($1,000,000), covering all persons providing services on behalf of the bidder and all risks to
such persons under the Agreement.
If bidder has no employees, it may certify or warrant to District and provide written evidence that it does
not currently have any employees or individuals who are defined as "employees" under the Labor
Code and the District's Risk Manager may waive the requirements for Workers' Compensation
coverage.
With respect to bidders that are non-profit corporations organized under California or Federal law,
volunteers for such entities are required to be covered by Workers' Compensation insurance. If the
District's Risk Manager determines that there is no reasonable priced coverage for volunteers, evidence
of participation in a volunteer insurance program may be substituted.
Comprehensive General and Automobile Liability Insurance with limits of not less than One Million Dollars
($1,000,000) combined single limit, bodily injury and property damage liability per occurrence,
including:
i. Owned, non-owned and hired vehicles;
ii. Blanket contractual;
iii. Broad form property damage;
iv. Products/completed operations; and
v. Personal injury.

ADDITIONAL NAMED INSURED: All policies, except for the Workers' Compensation, Errors and Omissions
and Professional Liability policies shall contain additional endorsements naming the District and its
officers, employees, agents and volunteers as additional named insured with respect to liabilities arising
out of the performance of services hereunder.
POLICIES PRIMARY AND NON-CONTRIBUTORY: All policies required above are to be primary and non-
contributory with any insurance or self-insurance programs carried or administered by the District.
PROOF OF COVERAGE: The bidder shall immediately furnish certificates of insurance and additional
insured endorsements to the District evidencing the insurance coverage, including the additional
insured endorsements above required, prior to the commencement of performance of services
hereunder, which certificates shall provide that such insurance shall not be terminated or expire without
thirty (30) days written notice to the District. Bidder shall maintain such insurance from the time bidder
commences performance of services hereunder until the completion of such services. Within sixty (60)
days of the commencement of this Agreement (or sooner if requested by the District), the bidder shall
furnish certified copies of the policies and all endorsements.
NOISE, DRUGS, TOBACCO, AND ALCOHOL: Trade Contractor shall take all steps necessary to ensure that
employees, Subcontractors and vendors employees do not use, consume, or work under the influence
of any alcohol, tobacco or illegal drugs while on the Project. Trade Contractor shall further prevent any
of its employees or its Subcontractor employees from playing any recorded music devices or radios or
wearing any radio headphone devices for entertainment while working on the Project. Likewise, Trade
Contractor shall prevent its employees or Subcontractor's employees from bringing any animal onto the
Project. Trade Contractors shall not violate any written school policies.
FINGERPRINTING (APPLICABLE ON ALL PROJECTS WHERE WORKERS WILL COME IN CONTACT WITH PUPILS):
If applicable, Contractor shall comply with the applicable provisions of Education Code section 45125.1
in a method as determined by the District. Pursuant to Education Code section 45125.1, Contractor
shall either conduct criminal background checks of all employees of Contractor assigned to the Project
site, and shall certify that no employees who have been convicted of serious or violent felonies, as
specified in Education Code section 45125.1, will have contact with pupils, by utilizing the Certification
Regarding Background Checks and the corresponding Attachment "A" as found in the Contract
Documents or shall be separated by a physical barrier from students.
If it is determined that Contractor must provide certification of employees, as part of such certification,
Contractor must provide the District with a list of all employees providing services pursuant to this
Agreement, and designate which sites such employees will be assigned. In performing the services set
forth in this Agreement, Contractor shall not utilize any employees who are not included on the above-
referenced list.
At District's sole discretion, District may make a finding, as authorized under Education Code section
45125.1, that Contractor's employees will have only "limited contact" with pupils. Contractor's failure to
comply with this law shall be considered a material breach of this Agreement upon where this
Agreement may be terminated, at District's sole discretion, without any further compensation to
Contractor.
In the case of new construction Projects where there are no students, if the Project Schedule provides
for Beneficial Occupancy or portions of the Project or if the Project should be delayed, then Contractor,
at no additional costs, shall meet the requirements of either fingerprinting or providing a physical barrier
as required by the District.
