Description:

This is a notice of intent, not a request for a quotation. A solicitation document will not be issued, and quotations will not be requested.



The National Institutes of Health, Clinical Center, Office of Purchasing and Contracts on behalf of the Center Cellular Engineering (CCE), intends to issue a firm-fixed priced contract to Becton, Dickinson and Company to perform preventative maintenance services on the BD FACSLyric Flow Cytometers Systems for a base year and four options.



The Center for Cellular Engineering requires continued preventative maintenance services on the following instruments:

The BD FACSLyric™ Clinical Flow Cytometry Systems automatically identify cell population of clinical engineered cell products for research and development to guide and improve cell product administrated to the patient and generate data that is required for providing guidance to improve immunotherapy efficiency of the cellular therapy product.



Becton, Dickinson and Company is the original equipment manufacture of the BD FACSLyric™ Clinical Flow Cytometry Systems, BD Universal Loaders and BD Lyse/Wash Assistants (LWAs). Becton, Dickinson and Company is the sole service provider and does not have any authorized third-party service providers of its proprietary instruments. Becton, Dickinson and Company is the only source capable of performing instrument software updates. Becton, Dickinson and Company software is proprietary in nature and is the only source capable of providing authorized and trained service technicians with the knowledge and expertise to perform the preventative maintenance services and supplier of original equipment manufacturer parts. Any failure due to service errors could potentially harm patients or if the instrument becomes operable would result in the loss of extensive research efforts. A preventative maintenance agreement is required to maintain and ensure the instruments are fully operational. Use of unauthorized parts may cause the instrument to malfunction and may comprise the performance of the instrument. Furthermore, any service or repair performed by unauthorized technician may invalidate the warranty or any existing service agreement. Becton, Dickinson and Company has been approved as the service provider for these listed equipment by the Center for Cellular Engineering Quality Assurance and Administration Teams.



This acquisition is being conducted using policies unique to the Federal Acquisition Regulation (FAR) Part 13.5 – Simplified Acquisition Procedures, Subpart 13.106-1(b)(1). For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstance of the contract action deem only one source reasonably available. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements.



Interested Parties:

Interested parties capable of providing the same or similar products or services described in this notice may submit a capability statement outlining their capability to perform the described work. Capability Statements must be received within the time set forth in this synopsis to be considered by the Government. The determination to compete this proposed contract based on responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
