I. Introduction
The City of Bangor (City) requests proposals for the furnishing and placement of asphaltic surface
treatments, commonly known as chip seal or stone seal, on selected streets that have been prepared
previously by the Bangor Public Services Department.
II. General Information
Available at the following web address: www.bangormaine.gov/proposals on the City’s website. By
submitting a response to this solicitation, the Proposer accepts the responsibility for downloading,
reading, and bidding by the terms and conditions set forth in the City’s “General Information for
Vendors.”
In your proposal, please specify whether you currently have, or are in the process of developing, a
domestic violence policy. If you do not have such a policy, let us know if you would like to receive a
copy of the City of Bangor's policy as a reference.
III. Submission
For consideration, submit the Bid Form (page 11) electronically or in an envelope via submission
methods listed below. The envelope or subject line must be clearly marked as "Proposal No. P26-49:
CY 2026 Chip Seal Program."
Submissions must be received by 2:00 P.M. on Wednesday, April 22, 2026.

Bangor, ME 04401 (proposal must be received by the deadlines).
All submissions should reference “Proposal No. P26-49: CY 2026 Chip Seal Program.” Proposals will
be publicly opened at the time stated above in the Paul Bumyan Room (first floor near the side
elevator) 73 Harlow Street, Bangor, Maine.
A tabulation of all received proposals will be posted on the City's website as soon as possible after the
opening date. Visit www.bangormaine.gov/bids for results. The "Show Closed/Awarded/Cancelled
Bids" box must be checked to see the proposal information.
IV. Questions
Any questions must be directed in writing to bids@bangormaine.gov no later than 4:30 P.M., Friday,
April 3, 2026.
The City will provide a response by 4:30 P.M. on Friday, April 10, 2026. This response will be in the
form of an addendum, accessible on the City's website. Notifications will be sent to those who have
signed up to receive notifications at www.bangormaine.gov/bids through NotifyME. Notifications will
be sent when new addenda are released.
V. Late Proposals
It is the responsibility of the Proposer(s) to see that their proposals have sufficient time to be received
by the Purchasing Department before the submittal deadline. Any proposal, portion of a proposal, or
requested proposal revision received at the City Purchasing Department after the time and date
specified will be returned to the Proposer unopened or, if by electronic submission, deleted without
being opened.
VI. Withdrawal of Proposals
No Proposer may withdraw their proposal for a period of ninety (90) days from the date of opening.
All proposals shall be subject to acceptance by the City during this period.
To withdraw a proposal prior to the opening, the Proposer shall request the withdrawal in writing. All
costs associated with the withdrawal (i.e., mailing fees) will be borne by the Proposer.
VII. Rejection
The City reserves the right to reject any proposals, waive any informalities or defects in proposals, or
accept a higher-cost proposal if it is deemed to be in the best interest of the City. The City also reserves
the right to request clarification of any details from the successful Proposer. Conditional proposals
will not be accepted.

VIII. Information for Proposers
A. Tax Exclusion: All Federal and State taxes must be excluded from the proposal price. Upon
request, a tax exemption certificate for the City of Bangor shall be furnished to the successful
Proposer.
B. Acceptance: The awarded Proposer agrees that if their proposal is accepted, they will contract
with the City to provide all necessary materials, machinery, tools, apparatus, and other means
of construction to do all the work in accordance with all specifications within this request and
according to the requirements of the Public Works Director. Payment for the work will be
based on unit prices submitted on the Bid Form (page 11).
C. Bid Form: The Bid Form (page 11) must be completed and returned with the proposal to be
considered responsive.
D. Required Insurance: Proposers are required to maintain the following insurance policies
throughout the life of the project and name the City of Bangor as an additional insured where
applicable and may be required to provide proof:
1. Worker’s Compensation Insurance
2. Employer’s Liability Insurance
3. Comprehensive Automobile

IX. Bid Security
Each Proposer must submit with their proposal a certified check or bid bond in the amount of 5% of
their total bid price as a guarantee that the Proposer will enter into a contract if awarded. Once the
City has completed the review of all proposals, said check or bid bond will be returned to all except
the two (2) lowest qualified Proposers. The remaining sureties will be returned after the City and
Proposer have executed the contract.
X. Scope of Services
The work contemplated under the terms of this request consists of the furnishing and placement of
either a standard or rubberized chip seal treatment on various streets in existing paved areas that
have been previously cleaned and prepared. Paving is contemplated in two (2) locations with a total
estimated length of two (2) miles.
The successful Proposer shall be responsible for paving aprons/approaches of streets, intersecting
streets to be paved, and around such catch basin and manhole structures as may exist in the paved

traveled way, to the extent necessary to provide a smooth transition as determined by the Public
Works Director or their appointed designee.
XI. Award
The contract will be awarded to the lowest qualified proposal. In the event the Proposer submitting
the low proposal is found to not be properly qualified to carry out the work, the contract will be
awarded to the next lowest qualified Proposer.
XII. Proposer’s Obligation
At the time of the opening of the proposals, it will be presumed that each Proposer will have
thoroughly familiarized themselves with the RFP documents, including the specifications and any
addenda that may have been issued. Failure of the Proposer to receive and examine any form,
instrument, or document or to visit and examine the site itself will not in any way relieve the successful
Proposer from any obligation in respect to their proposal or to the terms of the contract.
XIII. Bid Security Forfeited
Should the Proposer to whom the contract is awarded fail for any reason to execute the contract and
to furnish a satisfactory bond within the time specified, the City may determine that the Proposer has
abandoned the contract, that their proposal shall be considered null and void, and that the surety
accompanying the proposal shall be forfeited to and be retained by the City as liquidated damages,
and the contract may be awarded to another Proposer. After the execution of the contract and
acceptance of the bond by the City, the surety accompanying the successful Proposer’s proposal shall
be returned.
XIV. Performance Bond and Labor and Materials Bond
The successful Proposer shall deliver with the contract an executed Performance Bond and an
executed Labor and Materials Bond (each in the amount of 100% of the total proposal price) as
security for the faithful performance of the contract and for payment of all persons performing labor
or furnishing materials in connection therewith. These bonds shall be on the prescribed forms and
shall be furnished by a surety company or companies listed on the current Circular 570 of the U.S.
Treasury Department which company or companies shall also have a record of services satisfactory
to the City, shall be authorized to do business in the State of Maine, and shall be independent of the
Proposer.
XV. Bangor Public Works Department
This project will be administered by the Bangor Public Works Department (PW). PW will inspect all
items that are delivered to the project site under the contract to assure the City that all items are of
first-quality materials and workmanship. Any items found to be visibly defective will be rejected, and
the Proposer will be required to remove and replace such defective items.

Neither the fact of such inspection nor the omission thereof will imply acceptance by the City of any
or all of the work performed under the contract or relieve the Proposer of any responsibility for the
successful completion of all the terms of the contract subject to final inspection and review by the
City.
XVI. Time of Completion
All work described in these specifications shall commence as soon as weather allows in the spring of
2026 and be substantially complete by November 1, 2026.
XVII. Preparation of Streets and Shimming
The City shall be responsible for removal of all thermoplastic traffic markings, cleaning, and flush filling
all cracks and joints greater than 1/4” wide and placing a leveling course on a planed, milled, or
existing surface, if required, prior to the application of the chip seal treatment.
The selected Proposer shall cover all manhole covers, water boxes, gas boxes, catch basins, and other
such utility structures with plastic or building felt. Reference each for location and uncovering after
application.
The selected Proposer shall thoroughly clean the surface by sweeping immediately prior to application
of the emulsion. Prior to sweeping, the City shall have removed all vegetation and soil that is bound
to the roadway surface.
XVIII. Specifications
The work covered consists of furnishing all labor, equipment, plant, and materials in performing all
operations in connection with the chip seal treatment on a previously prepared base, complete and
subject to the terms and conditions of the contract.
A. Liquid asphalt grades shall be CRS-2L, CRS-2P, RS-2L (2% Latex), or MC-3000 conforming to
AASHTO specifications M316, M140, or M82.
B. The latex additive shall be Butonal NX 1129 (Anionic) or Butonal NX 4190 (Cationic) or an
equivalent conforming to the following specifications. It is required that the latex be co-milled
at the bulk emulsion facility to ensure complete and balanced blending. The emulsion
manufacturing plant must be open to inspection by the awarding authority.
