the Mobile County Comm.ission, Mobile, Alabama, will receive bids on the following items:
ANNUAL ULTRA LOW SULFUR DIESEL, UNLEADED E-10 GASOLINE AND UNLEADED E-10 MID GRADE
GASOLINE BID FOR MOBILE COUNTY PUBLIC WORKS DEPARTMENT AS PER ATTACHED SPECIFICATIONS:
NOTE: PRICES MUST REMAIN FIRM FROM OCTOBER 1, 2026 THROUGH SEPTEMBER 30, 2027.
Any questions or comments concerning the bid requirements must be brought to the attention

Out of State Corporations shall furnish a Certificate of Authority to transact business in
the State of Alabama. Out of State limited liability companies shall furnish proof of
registration to transact business in this state. Alabama law requires that a successful
bidder, if it has employees in the State of Alabama, provide proof of enrollment in E-
Verify prior to the award of a contract. (See enclosed notice which must be completed,
signed and returned with your bid. )
If applxcable to a contract resulting from this invitation the successful bidder must
comply with the Contractor Felony Investigation Policy, available in the Purchasing
Department or at www.mobilecountyal.gov.

FOR MOBILE COUNTY PUBLIC WORKS DEPARTMENT
Purpose: The purpose of this Invitation to Bid is to award a contract for delivery of
regular and diesel fuel-to-fuel tanks at the locations noted below,
Term: The term of the contract will commence on October 1, 2026 and continue until September 30,
2027, Prices must remain firm during the entire term.
Local Office: The vendor must have an office located within Mobile County with a loca l telephone
number and 24-hour emergency contact.
Delivery: Fuel must be delivered within 24 hours after receipt of order, during regular business
hours as follows:
MONDAY - FRIDAY 7:00 a.m, - 3:00 p.m.
For the following locations:
Mobile County Garage #4 - 560 Virginia St.
Government Plaza 205 Government St.
Metro Jail - 450 St, Emmanuel St.
E911 - Zeigler Boulevard
Cyress Creek Golf Course-3700 St. Andrews Lane N Mobile, Al 36693

MONDAY-THURSDAY 7:00 a.m, - 3:00 p.m,
For the following locations:
Camp I Howells Ferry Rd. & Schillinger Rd.
Camp II - McDonald Rd.
Camp III - Citronelle, AL.
Delivery slips are required at the time of delivery, reflecting the date of delivery,
product and number of gallons. Fuel will be purchased at the net amount delivered.

Quantitya The exact quantity of fuei to be purchased is unknown. Quantities set out herein
are estimates only, Mobile County does not guarantee any certain quantity will be
purchased.
Pricing: The contract will be awarded to the responsible bidder having the lowest mark-up above the
daily OIL PRICE INFORMATION SERVICE (OPIS) prices.
Payment will be made using OPIS PADD 3 (five-day average) for the week of fuel purchase. Mobile
County uses a Friday through Thursday week.
Payment: Purchases will be paid at the contract mark-up price per gallon plus all applicable taxes and
fees, and less all credits to which Mobile County is entitled, as per federal, state and local laws, which
must be reflected on billing invoices.
Taxes, fees, credits, etc.: Mobile County is exempt from payment of sales tax by Section 40-
23-4(a) (11), Code of Alabama (1975). In addition, the County is licensed under the Alabama
Terminal Excise Tax Act to purchase gasoline and diesel fuel tax-free. The awarded vendor is
responsible for notifying the County of all other applicable federal, state, and local taxes and
fees which the County is required to pay, and of all credits to which it is entitled, and to notify
the County if and when such taxes, fees, or credits change.
Reminder: The mark-up price must be per gallon and must not include applicable taxes, fees, or
credits.
Bid response: Bid response must consist of an original, so marked, and minimum or one exact
copy, so marked. The vendor identification sheet and all price pages must be returned. The
vendor identification sheet must be signed by a person authorized to bind the vendor. Mark-ups
must be printed in ink or typed on price pages. Faxed or emailed responses will not be accepted.
Bid must remain firm for thirty (30) days to permit evaluation of responses and award of a
contract,
Beason-Hammon Alabama Taxpayer and Citizen Protection Act: Acts 2011-
535 and 2012-491 require the following provision in all contracts with Mobile County:
"By signing this contract, the contracting parties affirm, for the duration of any
agreement that they will not violate federal immigration law or knowingly employ,
hire for employment, or continue to employ an unauthorized alien within the State
of Alabama. Furthermore, a contracting party found to be in violation of this provision
shall be deemed in breach of the agreement and shall be responsible for all damages resulting
therefrom

Verification of enrollment in the E-VeriFy program will be required prior to any award to a
vendor who employs one or more employees in the State of Alabama. Failure to provide
documentation within five (5) calendar days after notification will result in rejection of your
