Justification, Statutory Authority: AFFARS 5313.501 - 10 U.S.C. 3572, Implementation of Simplified Acquisition Procedures (41 U.S.C. 1901). IAW FAR 13.106-1(b)(2) For purchases exceeding the simplified acquisition threshold. The requirements at 13.501(a) apply to sole-source (including brand-name) acquisitions of commercial products and commercial services conducted pursuant to subpart 13.5.
The United States Air Force Test Center/Directorate of Contracting (AFTC/PZZG), Edwards AFB, CA awarded a sole source contract to The Mathworks, Inc (a Large Business), Cage Code 0C524, located at 3 Apple Hill Drive, Natick, MA., to support the MATLAB License Maintenance ToolBox. The contract was executed by means of other than full and open competition, as the Government did not entertain bids from authorized resellers because a 25% discount off the retail price was provided by MathWorks when purchasing new products directly from MathWorks. Additionally, authorized resellers add a surcharge on top of the retail price. Therefore, it is significantly cheaper to buy new products directly from the vendor instead of a reseller and the Contracting Officer found that it was in the best interest of the Government to issue a sole source award. Award to any other source would result in increase of costs to the Government that was not expected to be recovered through competition in fulfilling the Air Force's requirements.
