This is a notice of intent, NOT a request for a quotation. A solicitation document will NOT be issued, and quotations will NOT be requested.

The National Institutes of Health (NIH) intends to award a fixed price purchase order to procure a BD Instrumentation package and reagent kits from Becton. Dickinson, & Company of San Jose, California 95131-1807. The period of performance is from January 1, 2025, to December 31, 2029.

The purpose of this acquisition is to procure an instrument rental, reagent kits, quality control materials, and supplies for the Hematology Flow Cytometry Service from Becton, Dickinson & Company of San Jose, California. These supplies are essential for the operation of the instruments and play a crucial role in analyzing patient care and research specimens in the flow cytometry section of the Department of Laboratory Medicine.

The Department of Laboratory Medicine offers cutting-edge laboratory testing to support patient care at the Clinical Center and aims to be a leader in research and training within the field. To meet the growing demands of patient care and research testing, it is essential to maintain sufficient resources to manage the increasing workload. Without an adequate supply of the necessary proprietary reagent kits and supplies, we would be unable to deliver critical results promptly, which are essential for both patient care and research.

BD Biosciences is the sole manufacturer and trademark holder of the specified proprietary reagent kits which are the only known reagents compatible with the existing BD Rhapsody™ single cell analysis system currently located in the Department of Laboratory Medicine.

This acquisition is being conducted using policies unique to the Federal Acquisition Regulation 13.501 Special documentation requirements for sole source acquisitions exceeding the Simplified Acquisition Threshold. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements.

Interested parties may identify their interest and submit capability statements in response to this posting. The determination by the Government not to compete the proposed requirement based upon responses to this notice is solely within the discretion of the Government.
