SPECIAL PROVISIONS
The following Special Provisions supplement the “Standard Specifications for Road and Bridge
Construction of the State of Illinois”, adopted January 1, 2022, and the Supplemental Specifications and
Recurring Special Provisions, adopted January 1, 2026, along with the “Standard Specifications for Water
and Sewer Main Construction in Illinois”, 8th edition, adopted in 2020, and the Illinois Department of
Transportation Central Bureau of Materials Manual of Test Procedures for Materials, December 1, 2022
Edition, which govern the OUTER BELT WEST WATER MAIN AVENUE OF MID-AMERICA TO
KELLER DRIVE PROJECT, City of Effingham, Illinois, and in case of conflict with any part or parts of
said Specifications, the said Special Provisions shall take precedence and shall govern.
LOCATION OF PROJECT
The proposed work for this project is to be located along Outer Belt West between Keller Drive and Avenue
of Mid America in the City of Effingham, IL 62401. Please see location map on the title sheet of the
construction plans for additional details.
DESCRIPTION OF WORK
The project consists of constructing approximately 2,400 linear feet of 10-inch water main along Outer
Belt West. The work includes installation of new water main, hydrants, valves, tapping sleeves, bends,
and a street crossing as shown in the plan and profile sheets. Construction also includes restoration of all
disturbed areas back to their original condition. Construction shall not commence until all required
easements have been secured and the Illinois EPA permit has been obtained.
LIQUIDATED DAMAGES
It is understood and agreed that time is of the essence in the performance of the Contract and that failure
on the part of the Contractor to complete the contract work in the time herein set forth will result in certain
loss and damages to the Owner. Failure on the contractor’s part to complete such work shall be considered
just cause for forfeit of his/her surety bond.
No street closures are anticipated for this project. If any street closures become necessary, the Contractor
must first coordinate with the City of Effingham or the Illinois Department of Transportation, as applicable,
and complete all closures in a timely manner. Any roadway or driveway pavement removed during
construction shall be replaced with permanent or temporary pavement prior to reopening the area to traffic.
If the Contractor fails or neglects to meet these requirements, the Contractor shall pay to the Owner any
sums due under the Contract, at the rates specified in the Standard Specifications for Road and Bridge
Construction.
In case the Contractor of the work shall fail or neglect to have substantial completion of the project on or
before October 30, 2026 then said Contractor shall and will pay to the Owner such sums as may be due
to him under the terms of the Contract at the rate specified in the Standard Specifications for Road and
Bridge Construction. Substantial completion shall be defined as completion of all work necessary to place
the water main into service and receipt of an Illinois Environmental Protection Agency (IEPA) Operating
Permit. If the IEPA Construction Permit is not issued by July 15, 2026, the Contract Time shall be extended
on a day-for-day basis for each day of delay beyond that date, as determined by the City.
COMMENCEMENT OF WORK / PERMITS AND EASEMENTS
Construction shall not begin until all required permits, including the Illinois Environmental Protection
Agency (IEPA) construction permit and the IDOT Utility Permit, have been obtained and all necessary
easements have been secured by the City. Issuance of the Notice to Proceed shall be contingent upon
completion of these requirements. The Contractor shall not be entitled to additional compensation for
delays related to permit acquisition or easement procurement and shall coordinate all construction
activities in accordance with the timing established by the City.

JOINT UTILITY LOCATING INFORMATION FOR EXCAVATORS (J.U.L.I.E.)
This work shall be done in accordance with Article 107.39 of the Standard Specifications except as herein
modified.
If any of the location marks placed by a utility company in conformance with this procedure are destroyed
by Contractor operations, the Contractor shall immediately notify the utility owner and bear the costs of
remarking the facilities at his own cost and expense. Compliance with this special provision shall be
considered incidental to the contract and no additional compensation will be allowed for any costs incurred.
CONTRACTOR RESPONSIBLE FOR LOCATING UTILITIES
Before beginning work, it shall be the Contractor’s sole responsibility to coordinate with the utility owners
and to determine the actual location of all such facilities. The Contractor shall also obtain from the respective
utility owners detailed information relative to the location of their facilities and the working schedules of the
utility owners for removing or adjusting them.
If utilities are encountered that differ from those shown on the plans or interfere with the proposed
construction, the Contractor shall immediately notify the Engineer and no work shall proceed in the affected
area until direction is provided. The Contractor shall perform all work necessary to avoid damage to existing
utilities, including had excavation as required. All utility coordination, delays, adjustments to construction
operations, and protection of existing facilities shall be considered incidental to the contract, and no
additional compensation will be allowed.
COOPERATION BETWEEN CONTRACTORS
There is a possibility that other Contractor operations may be ongoing within the proposed project limits at
the same time as the work included in this contract is being performed. The Contractor for this Section
shall cooperate with any other Contractors performing work adjacent to this project in accordance with
Article 105.08 of the Standard Specifications. Any inconveniences or delays caused the Contractor in
complying with this requirement shall be considered incidental to the contract and no additional
compensation will be allowed.
LOCATION OF UTILITIES NOT SHOWN ON PLANS
The Contractor is advised that various underground and surface utilities and structures may or may not
be correctly shown on the plans. Such facilities are shown on the plans for the information of the
Contractor, but information so given is not to be construed as a representation that such facilities will be
found or encountered exactly as shown.
Additional underground utilities, including but not limited to electric, lighting conduit, communications, fiber
optic facilities, and other private or public utilities may exist within the project limits but are not shown on
the plans. Other utilities and structures may also be encountered which are not shown on the plans.
The Owner and its Engineer assume no responsibility whatever in respect to the sufficiency or accuracy
of the information shown in the plans relative to the presence or location of such facilities.
MAINTAIN UTILITIES IN OPERATING CONDITION
The Contractor shall maintain in operating condition all utilities encountered in the work. The Contractor
shall be entirely responsible for all damages to water pipes; electrical conduits; existing drains or sewers;
gas pipes; and poles carrying electrical current, telephone or television lines during the prosecution of the
work and shall be liable for damages to public or private property resulting there from, which amount may
be deducted from any monies due the Contractor for work done. Any damage to existing utilities as a result
of the Contractor’s construction operations shall be repaired to the satisfaction of the utility owner at the
Contractor’s expense, whether or not said utilities are shown in the plans.
