The Contractor guarantees that the work to be done under this Contract and the
materials furnished by him and used in the construction of the project are free
from defects or flaws. The guarantee is for a term of one (1) year from and after
the date upon which the final estimate of the Project Manager is formally
approved by the party of the first part. It is hereby agreed and understood that
this guarantee shall not include any repairs made necessary by any cause or
causes other than defective materials furnished by or defective work done by the

otherwise. Should the Contractor, however, be substantially delayed in the
prosecution and completion of the work by any changes, additions, or

such workmen, or by the neglect, delay, or default it of any other
contractor of the town, then the Contractor may, within five (5) days after the
occurrence of the delay for which they claim allowance, notify the
Project Manager in writing, and thereupon, and otherwise, the Contractor
shall be allowed such additional time for the completion of the work,
as the Project Manager in his discretion shall award in writing, and his
decision shall be final and conclusive upon the parties. Such additional
time shall be the sole and exclusive remedy for any delay claimed by the
Contractor.
