SECTION 1: OVERVIEW AND SCHEDULE OF EVENTS
1. Executive Summary
1.1. Introduction
The Department of Safety (DOS) is one of the largest State agencies in New Hampshire, with
more than 1,500 full-time, part-time, non-classified, and seasonal employees functioning in
both uniformed and civilian capacities throughout the State. The Department regularly
partners with local, state and federal agencies to protect the lives of all New Hampshire
residents and visitors. DOS is tasked with enforcing criminal and motor vehicle/boating laws,
providing for fire safety, fire and emergency medical training, emergency communications, and
disaster planning.
The Division of Motor Vehicles (DMV), Bureau of Registration operates within the DOS and one
of its responsibilities is administering the State's inspection and maintenance (I/M) program
that includes a second-generation On-Board Diagnostics (OBD) test, and on-demand
inspection sticker printing capabilities for purposes of New Hampshire's State Implementation
Plan ("SIP") pursuant to the Clean Air Act. The DMV works collaboratively with the New
Hampshire Department of Environmental Services (DES), whose primary responsibility is for
air quality related programs and policies, in designing and implementing the NH I/M Program.
On December 24, 2025, DES submitted to the United States Environmental Protection Agency
("EPA") a request to amend New Hampshire's SIP to remove the I/M program requirements as
well as a Clean Air Act 176A Petition to remove New Hampshire from the Ozone Transport
Region. Until EPA approves an amendment to the State's SIP discontinuing the I/M program
(expected to take at least 12 months), DOS requires the services of an I/M vendor to implement
the requirements of the I/M program as required by the State's SIP.
By effect of HB2 (2025) 141:244-141:256, the New Hampshire legislature repealed certain
statutory provisions mandating the inspection of motor vehicles in the State and providing for
the enforcement thereof. The repeal of these statutory provisions is the subject of active
litigation in the United States District Court for the District of New Hampshire (see Docket No.
1:25-cv-00508-LM-AJ Gordon-Darby Holdings, Inc. v. NH Department of Safety, Commissioner
et al). On January 27, 2026, the District Court for the District of New Hampshire issued an
Order requiring NHDOS to "take all steps necessary to resume and ensure the continued
implementation and enforcement" of the I/M program. The State disputes that it currently has
adequate legal authority to implement the I/M program as ordered and the State is still actively
litigating this issue and others.
The issuance of this RFP, the execution of any resulting contract, and any statements or
actions by the State or its officers and employees in furtherance of this RFP process shall not
constitute any waiver or admission related to the above-mentioned litigation. The State hereby
reserves its right to make any and all applicable claims and arguments notwithstanding its
issuance of this RFP or any subsequent engagement in this RFP process.

The State reserves the right to stay any contract negotiations, cancel this RFP, or postpone the
issuance of any award to any winning bidder of this RFP as the State, in its sole discretion,
deems necessary and in consideration of the above-referenced litigation.
1.2. No bidder or eventual approved vendor may utilize equipment or services on the State

Equipment and Services. Scope of Work (SOW) Overview
The purpose of this Request for Proposal (RFP) is to provide for the implementation of the NH
I/M Program as required by the State's Implementation Plan.
The Vendor will be responsible for all aspects of the program, to include:
* Successful implementation of the emissions portion of the New Hampshire I/M
program as described in the SIP
* Migration of existing data from current Motor Vehicle Inspection Management System
* Project Management, Testing, Training and other activities as outlined in the RFP
* Communication and Migration Plan for existing I/M program users
* Ongoing support, system maintenance and training for the I/M program solution
* All services, hardware and software configuration and development associated with
the implementation of the I/M program system
* Ongoing system maintenance of the I/M program system and its associated interfaces
2. Schedule of Events
The following table provides a Schedule of Events for this RFP through contract finalization and
approval. The Agency reserves the right to amend this Schedule at its sole discretion and at any
time through a published Addendum.

1. Proposal Submission
Physical Proposals and Electronic Proposals submitted in response to this RFP must be received
no later than the time and date specified in the Schedule of Events, herein.
The Price Proposal must be labeled clearly and submitted separately from the Technical Proposal.
Late submissions will not be accepted. Delivery of the Proposals shall be the Vendor's
responsibility. The time of receipt shall be considered when a Proposal has been officially
documented by the Agency, in accordance with its established policies, as having been received at
the location or via email as designated below. The Agency accepts no responsibility for damaged,
mislabeled, or undeliverable mailed or emailed Proposals.

4. Number of Proposals
Vendors are permitted to submit One (1) Proposal with a unique solution in response to this RFP.
The original and all copies shall be bound separately, delivered in sealed containers, and
permanently marked as indicated above. A Vendor's disclosure or distribution of its Proposal other
than to the State will be grounds for disqualification.
5. Vendor Inquiries
All inquiries concerning this RFP, including but not limited to, requests for clarifications, questions,

The Agency intends to issue official responses to properly submitted inquiries on or before the date
specified in the Schedule of Events section, herein. The Agency may consolidate and/or
paraphrase questions for sufficiency and clarity. Oral statements, representations, clarifications,
or modifications concerning the RFP shall not be binding upon the Agency. Official responses by
the Agency will be made only in writing by the process described above.
The Agency will require the selected Vendor to execute a Contract using the P-37 State of New
Hampshire General Provisions and any attached exhibits. To the extent that a Vendor believes that
exceptions to the standard form contract will be necessary for the Vendor to enter into the
Agreement, the Vendor must submit those exceptions during the Vendor Inquiry Period.
6. Restriction of Contact with Agency Employees
From the date of release of this RFP until an award is made and announced regarding the selection
of a Vendor, all communication with personnel employed by or under contract with the Agency
regarding this RFP is prohibited unless first approved by the RFP Points of Contact listed herein.
Agency employees have been directed not to hold conferences and/or discussions concerning this
RFP with any potential Contractor during the selection process, unless otherwise authorized by the
RFP Point of Contact. Vendors may be disqualified for violating this restriction on communications.
7. Validity of Proposal
Proposals must be valid for one hundred and eighty (180) days following the deadline for
submission of Proposals in the Schedule of Events, or until the Effective Date of any resulting
Contract, whichever is later.
