Notification of Intent to Sole Source Additional Requirement

The United States Agency for International Development’s Mission to Timor-Leste (USAID/Timor-Leste) intends to make a noncompetitive modification to USAID/Timor-Leste Trade Governance Activity, Task Order #72047222F00001 for the purpose of extending the period of performance by three years and increasing the Total Estimated Cost (TEC) of the Task Order by $10 million.
The statutory authority permitting this contract modification without providing full and open competition is AIDAR 706.302-70(a)(2) based on the authority provided by 40 U.S.C. 113, which provides an exception to full and open competition when it would impair or otherwise have an adverse effect on programs conducted for the purposes of foreign aid, relief, and rehabilitation. This authority, pursuant to AIDAR 706.302- 70(b)(5), may be used for “an award for the continued provision of highly specialized services when awarded to another resource would result in substantial additional costs to the Government or would result in unacceptable delays.”
The contractor was awarded the above referenced Task Order under an IDIQ Number 7200AA18D00011 and has provided highly specialized services to the Government of Timor-Leste. The current award period is April 1, 2022 - August 7, 2025, with a TEC of $10,260,296. This modification will extend the task order for three years beyond the current completion date, resulting in a new date of August 7, 2028. The proposed modification is within the general scope of the current contract. During the extension, USAID expects the Contractor to build on the progress made during the existing contract period of performance, continuing to provide critical technical assistance to the Timor-Leste’s Customs Authority, other government agencies, and private sector. The Contractor will continue to support ongoing efforts in trade governance, operations, and facilitation, helping to institutionalize a well-governed, modern trade system that is professional, transparent, accountable, efficient, effective, and responsible to the Timorese people, while adhering to international standards and obligations. The Contractor will also continue to assist the Government of Timor-Leste’s Customs Authority, and other government agencies in meeting the Association of Southeast Asian Nations (ASEAN) membership requirements, the World Customs Organizations (WCO), and the World Trade Organization (WTO) post- accession requirements and obligations.
This notice of intent is not a request for competitive proposals. As a result, no solicitation package will be issued for the extension in time and cost.
