Provision of Local Screenings fill
The Town of Bedford's Public Works Department (DPW) occasionally has the need to obtain
local screenings fill. The sieve size and percentage of the gravel particles that make up this material
that is required specifically corresponds to the "Local Screenings" specifications that are attached to
this document. Vendors who are bidding on material to be picked up at their facility must be located
within 15 miles of the Bedford DPW facility at 301 Adams Street, Bedford NY 10507. The town of
Bedford typically utilizes several hundred tons of this material in any given year. Pricing is to remain
in effect until September 30, 2027 (it can be extended by mutual agreement of Bedford DPW & vendor
for up to four (4) more years). The Commissioner of Public Works may allow for annual price
adjustment for extension periods based upon the annual percentage change of CPI as published by the
United States Department of Labor for the Northeastern Section of United States. The increase will be
based upon the September reported figures for each year.

Materials shall be delivered in accordance with the itemized specifications on the order of the
Public Works Commissioner or designee, Town of Bedford, in quantities as ordered.
Unit prices bid shall be exclusive of any sales, excise or other taxes for delivery to a tax exempt
Municipality. Tax exempt certificate number 136007284 covers Public Works Department
purchases by the Town of Bedford.
The Town of Bedford reserves the right to purchase material from other vendors as awarded by the
State of New York Office of General Services, without notice to the vendor awarded the Town bid.
This contract is specifically for the pickup and / or delivery of Local Screenings fill to the Town of
Bedford's storage site at Crusher Road. Vendors (including both trucking firms and quarries)
providing these materials for use by the town are required to be able to provide at least 100 tons of
material per 8 hour work day (i.e. Monday-Friday 7am - 300 pm - excluding town observed
holidays) to the Crusher Road facility. Vendors are expected to begin delivery of these materials to
the Crusher Road facility within one working day of the order being placed. In the event that the
lowest bidder for above mentioned stone and gravel materials is unable deliver said materials (i.e.
delivery of at least 150 tons of material within 1 working day of receipt of the order to the Crusher
Road facilities), the next lowest bidder will be contacted to either supplement or entirely take on
the order at the per ton price that they (i.e. the higher price) quoted. If the second lowest bidder is
unable to provide these services, the third lowest bidder will be contacted, and so on. All material
delivered by the vendor shall be made up of "clean" stone and gravel and free of any contaminants
such as asphalt, concrete, brick, construction debris, metals, petroleum waste, etc.
All suppliers, submitting bids on items in non-conformance with the specifications or delivery time
as stated, must submit them on a separate sheet of paper clearly stating the variance between their
bid and the specifications. The bid will receive careful consideration if such deviations do not
depart from the intent of this specification and are to the best interests of the Town of Bedford.
Additional information on any of the items as given in the detailed specifications may be secured
from the office of the Commissioner of Public Works or designee.
Each bid must be signed by a person authorized to do so and each bid must include a certificate of
non-collusion and waiver of immunity agreement, as required by law.
Bidders are not to separate the notice and specifications from the proposal form, but must return
the same complete.
Separate bids will be awarded for each item as listed in the proposal.
The Commissioner of Public Works or designee reserves the right to reject any or all bids, to
accept any bid or waive any informality in the proposal as deemed advisable in the best interest of
the Town of Bedford.
Unless otherwise permitted by the Commissioner of Public Works, vendors awarded this contract
are required to deliver Local Screenings fill to Town of Bedford DPW Facilities within 2 working
days of an order being placed. The Commissioner of Public Works for the Town of Bedford

reserves the right to obtain materials on the open market in the event that the lowest bidder is
unable or unwilling to deliver these materials (or delivers materials of an unsatisfactory quality) to
Bedford's Public Works Facilities within 2 working days specified above.
If deemed necessary, vendors awarded the contract for the delivery of Local Screenings will be
expected to provide the Commissioner of Public Works of up to four (4) references of the names,
addresses, and phone numbers of suppliers and quarries they have work with in the past. Failure to
produce the abovementioned references can result in the rejection of their bid.
General Municipal Law (GML) 103 (16) Purchasing through Piggyback -Per General Municipal Law
(GML) 103 (16), this bid will be made available to other municipalities seeking the same product and
services upon consent of the contractor. If Contractor consents, Contractor to honor pricing listed
above to any municipality or government agency allowed by law to piggyback. Participating agencies
may enter into a contract with the successful vendor for the purchase of the service and commodities
described herein based on the terms, conditions, and prices offered by the successful contractor. Minor
changes in terms and conditions may be negotiated by participating agencies. Any liability created by
Piggyback Purchasing using this agreement shall be the sole responsibility of the district or agency
placing the order.

NON-COLLUSIVE BIDDING CERTIFICATION
Made pursuant to Section 103-d of the General Municipal Law of the State of New York
as amended by the Laws of 1966.
(a) By submission of this bid, each Bidder and each person signing on behalf of any Bidder
certifies, and in the case of a joint bid, each party thereto certifies as to its own
organization, under penalty of perjury, that to the best of his knowledge and belief:
(1) The prices in this bid have been arrived at independently without collusion,
consultation, communication, or agreement, for the purpose of restricting competition, as to any
matter relating to such prices with any other Bidder or with any competitor;
(2) Unless otherwise required by law, the prices which have been quoted in this bid have
not been knowingly disclosed by the Bidder and will not knowingly be disclosed by the Bidder
prior to the opening, directly or indirectly, to any other Bidder or to any competitor; and
(3) No attempt has been made or will be made by the Bidder to induce any other person,
partnership or corporation to submit or not to submit a bid for the purpose of restricting
competition.
(b) A bid shall not be considered for award nor shall any award be made where (a) (1) (2) and (3),
above, have not been complied with; provided, however, that if in any case the Bidder cannot
make the foregoing certification, the Bidder shall so state and shall furnish with the bid a
signed statement which sets forth in detail the reasons therefore. Where (a) (1) (2) and (3),
above, have not been complied with, the bid shall not be considered for award nor shall any
award be made unless the head of the purchasing unit of the political subdivision, public
department, agency or official thereof to which the bid is made, or his designee, determines that
such disclosure was not made for the purpose of restricting competition.
