The following notice serves as a synopsis prepared in accordance with DFARS PGI 206.302-1, and FAR 5.2 as supplemented with additional information included in this notice.
This synopsis is NOT a request for competitive proposals. All responsible sources may submit a capability statement, which will be considered by the Government. A determination by the Government not to compete this proposed contract action based on responses to this notice is solely within the discretion of the Government.
The Naval Undersea Warfare Center, Division Newport (NUWCDIVNPT) intends to modify Firm Fixed Price (FFP) Purchase Order (PO) N6660424P0073 to include 6 additional Trips to CLIN 0003 ‘EA Engineering Services Support – Travel; and 2000 additional Labor hours to CLIN 0004 ‘EA Engineering Services Support – Labor’. The awardee of this contract is Nightwing Intelligence Solutions, Inc (cage 3XYV3).
Prior to the award of N6660424P0073, A combined synopsis and solicitation notice (N6660424Q0073) was published publicly on the Government-wide Point of Entry (GPE), SAM.gov on 25 April 2024. The notice stated the intention of NUWCDIVNPT to award a contract on a sole source basis to Nightwing (Previously RCSI, Inc). No additional sources came forward during the solicitation period.
Nightwing is the only practicable source of supply for these services. The objective of this contract is to modify an existing weapons subsystem. Nightwing retains the data rights to developed software utilized within this weapons subsystem. The effort of the Engineering services under this contract is to tailor the existing software solution. As such, the alternative to procuring these additional services from Nightwing, would be to develop a new software at the expected duplicative cost of $2,000,000.00 and 3 year impact to required schedule.
The proposed contract action is for commercial services for which the Government intends to negotiate with only one source in accordance with 10 U.S.C. 3204(a)(l) and 41 U.S.C. 1901, as implemented in Federal Acquisition Regulation (FAR) 13.501(a)(1)(ii).
The anticipated award date of this requirement is expected to be on or about 21 January 2024.
