The Town of Agawam, Chief Procurement Officer in consultation with the Engineering Department hereby invites sealed bids from qualified experience sources in accordance with Chapter 30, Section 39M, inclusive as amended, for furnishing materials and services as needed for the preservation of roads, driveways and parking lots owned by the Town of Agawam as detailed within the following contract documents. In general, this bid includes materials and services associated with the supply, performance and installation of Random Crack Sealing – PCRM Asphalt with Reinforcing Fibers, Hot Applied Mastic Crack Seal, Polymer Modified Rejuvenating Fog Seal, and Spray Applied Penetrating Asphalt Rejuvenator. MassDOT prequalification of contractors with the class of work as, CRACK SEALING for the project with an estimated value of $476,700 will be required. Valuation for purposes of MassDOT Prequalification is based on first year times two (2) to arrive at an estimated total value of all bid items. The estimated value provided in this Invitation to Bid is for one year. Vendors are expected to be able to provide their services over two (2) years at two (2) times the initial estimated value.
The contract will be awarded to the prequalified, responsible and responsive bidder who offers the lowest price. The low price for Items 1-4 (Random Crack Sealing – PCRM Asphalt with Reinforcing Fibers, Hot Applied Mastic Crack Seal, Polymer Modified Rejuvenating Fog Seal, and Spray Applied Penetrating Asphalt Rejuvenator) will be determined by the lowest total price for Items 1-4 inclusive.
The term of this contract shall extend from day of contract execution through November 30, 2026. Awarding Authority reserves the right to extend the contract for one (1) additional 12 month option. The Town of Agawam reserves the right: (1) to award bids received on the basis of individual items, or groups of items, or on the entire list of items (2) to reject any or all bids, or any part thereof; (3) to waive any informality in the bids; and (4) to accept the bid that is in the best interest of the Town.
Attention is called to the minimum wage rates to be paid on the work as determined by the Commissioner of Labor and Industries under the provisions of General Laws, Chapter 149, Sections 26 to 27G, inclusive.
Each bidder must submit with the bid a bid deposit equal to five percent (5%) of the amount of the bid. The bid deposit may be in the form of a certified check, bank/treasurer’s or cashier’s check, or bid bond from a licensed surety company (G.L. c.30, section 39M; c.189, section 44B). The successful bidder will be required to furnish a Labor and Materials Payment Bond in the amount of 50% of the contract total.
