Description

The United States Patent and Trademark Office (USPTO), Office of Policy and International



Affairs (OPIA) has a requirement to contract with Clarivate Analytics (US) LLC for a subscription to their Crossbow Intellectual Property (IP) - Darts-IP platform which is an intellectual property case law platform specifically tailored to IP professionals to research case law, track ongoing litigation, and provide aggregate statistical data covering united states, China, and Europe.



Darts-IP is the only database that contains civil, administrative and criminal IP cases with statistical tools to generate outputs (especially graphical outputs). Dart-IP, the search can be performed in English or Chinese and the legal summaries are available in English or Chinese. The decision itself is in Chinese (electronic version of the decision) and a corresponding machine translation of the decision is also available.



The USPTO requires commercial databases to develop empirical data and analysis and expand knowledge for the purpose of understanding the international IP landscape through empirical research and fact-finding. The type of reporting required is unique to the USPTO. The database allows a user-friendly interface to access queries specifically tailored to IP professionals to research case law, track ongoing litigation, and provide aggregate statistical data covering U.S., China and Europe.



For this procurement, the USPTO is exempt from the Competition in Contracting Act (CICA) as the subject requirement is being procured using the Alternative Competition Method in accordance with the Patent and Trademark Office Acquisition Guidelines (PTAG) and the Patent and Trademark Office Efficiency Act 35 U.S.C. 2(b)(4)(A). We have identified Clarivate Analytics (US) LLC as the only company capable of providing the required level of service and expertise necessary to meet all technical requirements for the support of OPIA.



To make this sole source determination and in accordance with PTAG 6.1.1, the USPTO conducted market research which included an extensive review of SAM.gov, GSA Advantage, as well as targeted web-searches, and historical knowledge of previous awards.



As a result, the UPSTO intends to negotiate and award a firm-fixed price Purchase Order to Clarivate Analytics (US) LLC. The anticipated award date is December 9, 2024.



This requirement utilizes NAICS Code 519290 - Web Search Portals and All Other Information Services and has a period of performance that includes a one-year base period with four option years from date of award.

The USPTO intends the subject requirement to be procured using the Alternative Competition Method in accordance with the Patent and Trademark Office Acquisition Guidelines (PTAG) and the Patent and Trademark Office Efficiency Act 35 U.S.C. 2(b)(4)(A). The subsequent solicitation will not be posted on SAM.gov and instead sent directly to the vendor listed above.
