Surveyor’s Office at 200 E. Berry Street, Suite #350, Fort Wayne, Indiana, 46802.
The following must appear on the outside of the envelope containing the bids. Emailing spray
bids is not allowed.

DITCH SPRAY SPECIFICATIONS
1. The Contractor hereby covenants and agrees to perform all of the labor and to provide all of the
necessary equipment, material and supplies for the ditch bank spraying of the open channel of the
following ditch(es):

To legally recognize the Allen County Regulated Drains that have been selected by the
Contractor, the space given beside the drain names must be initialed by the Contractor. If the
Contractor’s initials are absent beside the drains, this contract may be considered null and void.
2. Contractor shall be responsible for the handling, mixing and application of all materials as
required herein. The Contractor shall obtain the required permits for applying herbicides, shall
have adequate liability and insurance and shall agree to indemnify and hold the County harmless
against any and all claims that may arise as a result of the Contractor’s operations. The Contractor
shall conduct his work as to avoid any damage outside the ditch right-of-way. Any damage
outside the ditch right-of-way resulting from the Contractor’s operations shall be the sole
responsibility of the Contractor. Proof of proper licensure, permit, and insurance shall be
provided with all signed contracts.
3. Contractor shall spray both sides of ditch from top of bank to top of bank plus 40’ from top of
bank on the working side of the ditch.
4. The treatment shall be a mixture authorized and permitted for use on ditch banks for the purpose
of control of weeds and brush. Under no circumstances shall any chemical not approved by the
Indiana State Chemist be used in this County!
5. The Contractor shall be required to carry liability and property damage insurance, including but
not limited to crop damage. Contractor shall carry at Contractor’s expense, personal liability
insurance and property damage insurance in the minimum amount required by the Allen County
Board of Commissioners. Said insurance shall insure the Contractor, Allen County Surveyor, and
Allen County Drainage Board. The Contractor shall provide the Surveyor with copies of said
insurance policies or a certificate of insurance indicating the amount and type of insurance in
force, the name of the insurance company and effective dates of the insurance.
6. The Contractor will be held responsible for all damage occurring during the performance of, and
for up to one year from date of start of work, said responsibility will continue even through partial
payments may have been made under the contract. The Contractor will be held liable for all
damages that may occur to persons, property, animals or vehicles arising from defective apparatus
or any negligence on the part of himself or his employees. The Contractor is hereby expressly
bound to indemnify and save harmless the County, the Surveyor, the Drainage Board and their
agents and employees, from all damages, costs, judgements, loss and from all suits or actions, or
the defense thereof including attorney fees, of any nature and description arising out of any claim
or suit brought against the said Surveyor or Drainage Board for, or on account of, any injuries or
damages received or sustained, or alleged to have been received or sustained by any party by or

from any act or omission of the said Contractor or his servant or agents occurring in the
performance of said work or by or on account of any act or omission of said Contractor or his
agent. The Contractor is hereby expressly bound to appear and defend all such suits or actions
and account of such suits or actions.
7. The Contractor shall guarantee a “Percentage of Kill” of not less than 85% of affected foliage.
The Surveyor and/or the Drainage Board and the Contractor will inspect these sites and determine
the percentage of kill. If, in the opinion of the Surveyor and/or the Drainage Board, the percentage
of kill is below the 85%, the Contractor shall, at his own expense, re-spray all weeds and brush
along the length of the drain. Re-sprout on stumps is to be eliminated when you spray. Dormant
spray can be used if there is no interference with landowners and a guarantee of 85% kill.
8. Dormant spray mix and methods is required when spraying from 04/05/25 to 05/15/25 (full leaf
out). Full leaf out conditions will require normal foliar spray mix and application.
9. All work within this contract shall be completed by date on contract. The project includes
furnishing all labor, equipment and materials to complete the weed and brush spraying project.
10. The Contractor shall keep a log of spraying containing the following information:

C. Wind
G. Material
D. Temperature
H. Ratio
Said log shall be surrendered to the Surveyor’s Office when spraying is completed.
11. The Contractor shall comply with all State of Indiana laws pertaining to applicators and licensure.
The Contractor shall provide the Allen County Surveyor’s Office with a photocopy of his license
upon submittal of his signed contracts.
10. The Contractor shall provide all necessary safeguards, safety devices, and protective equipment.
The Contractor shall take all other actions necessary or advisable to protect the lives of
employees on the job, and to ensure the safety of the public and property.
11. All work shall be subject to the approval of the Surveyor.
12. Contractor may file claim for 80% payment after completion of all work and the remaining 20%
after 60 days. Required log must be on file before any claim for payment will be allowed.
