Intent
The purpose of this invitation to bid is to establish a term contract for the rental of Construction and
Highway Maintenance Equipment to be used by the Department and its 12 Districts.
Multiple Award
ODOT will accept all responsive bids submitted on or before the specified bid opening date and make an
award to all responsive bidders pursuant to O.R.C. 5513.02.
A District has the option of not using this contract if there is not an awarded vendor within a reasonable
distance for the commodity being requested and/or the equipment needed is not able to be provided at the
specified time of need by an awarded vendor within the County/District.
Contract Duration
The effective duration of this contract shall be for twelve (12) months from the Date of Award. All pricing
submitted for both equipment and accessories shall remain valid for the duration of the agreement (unless
equipment is no longer available).
ODOT reserves the right to unilaterally extend this Contract up to one (1) calendar month beyond the
original contract expiration date at the original unit bid prices awarded.
Pricing
4a. Pick-Up and Delivery Charges
ODOT reserves the right to either pick up and return the rental equipment with ODOT equipment
and manpower or to have the rental equipment delivered and picked up by the vendor.
The vendors will supply a flat per mile charge for the purpose of calculating and evaluating the total
rental cost. The distance for the pick-up and delivery charge will be verified by ODOT using Google
Maps.
The exact delivery location and method of delivery or pickup will be listed on the purchase order or
explained at the time of the order.

Vendor must specify whether a vendor-supplied operator is a mandatory requirement with each
item that is bid. This will be documented in the last two columns. If a vendor-supplied operator is
mandatory, the operator’s hourly rate must be included in these columns. If the vendor-supplied
operator is optional, the operator’s hourly rate should be listed in the last column. If no operator is
available and is not required, please leave the last column blank.
4c. Fuel and Maintenance
All equipment picked up by ODOT or delivered by the vendor to an ODOT facility shall have a full
tank of fuel and all manufacturers required maintenance shall be up to date.
Delivery Time
Delivery shall be made within two (2) business days after written or verbal notification of a valid State of
Ohio purchase order or State paycard. For Department pickup, the equipment being requested must be
available for pickup within two (2) business days after written or verbal notification of a valid State of Ohio
purchase order or State paycard.
Delivery Hours
All deliveries shall be made between the hours of 8:00 a.m. and 3:30 p.m., Monday through Friday,
excluding State holidays, unless special permission is granted by the Department to temporarily waive or
adjust this requirement.
Insurance
The rental price(s) submitted by the vendor must include the price of insurance to cover fire, theft,
vandalism and accidents/damage for each piece of equipment during the contract rental period.
The Comprehensive Insurance coverage will pay for direct and accidental loss to the Department vehicle
(owned or not) caused by collision, glass breakage for any reason, missiles, falling objects, fire, theft or
larceny, explosion, earthquake, windstorm, hail, water, flood, malicious mischief or vandalism, and riot or
civil commotion.
ODOT is covered by a tort liability self-insurance program managed through the Department of
Administrative Services (DAS). The vendor must work with DAS to recover damages that would be
deemed operator liability.
The vendor is not to offer ODOT any supplemental insurance. Failure of ODOT to decline any
supplemental insurance shall not be an agreement by ODOT for such coverage. ODOT will not be held
responsible for any charges for supplemental insurance.
Damage resulting from ODOT Neglect
If, in the opinion of the vendor, damage was done to a piece of equipment that was rented to ODOT, that
vendor may submit a claim request to the Administrator of the Office of Equipment Management. In this
claim, the vendor must submit the following: 1. Proof that the equipment or item was in working order prior
to rental, 2. Proof of damage after the rental and 3. Quoted cost for repair. The Office of Equipment
Management will make the final determination within (thirty) 30 days, after receiving the claim, whether
the claim is justifiable and thus payable by the district. Normal repairs as described in section 8 or wear
items, such as, but not limited to, lights, brooms, tires, wires, batteries, etc. will not be considered in this
section. Upon request, for all units being bid the vendor must supply a list containing what the vendor
considers a wearable item.
If in ODOT’s opinion, the quoted cost of repair is excessive, ODOT reserves the right to have the piece of
equipment repaired at an ODOT location with ODOT staff or a service center of ODOT’s choice at ODOT’s
expense.

Repair Parts and Wear Items
The rental price paid is the only charge the Department will pay. It will be the vendor’s responsibility to
make necessary repairs and provide new parts in the event the equipment would break down while in use
by the Department. The only exception will be payment resulting from an approved claim as described in
Section 7.
The vendor is responsible for replacement of wear items such as, but not limited to, lights, brooms, tires,
wires, batteries, cutting teeth, etc…, as part of the rental price.
Required Signatures upon Pick-up or Delivery of Equipment
ODOT understands that a signature is needed to confirm both receipt and delivery of rental equipment.
Upon delivery or pick-up of any equipment included in this agreement, an awarded Vendor hereby agrees
that any signatures/initials provided by ODOT personnel on any Vendor-specific forms or agreements
shall not conflict with nor supersede the terms established in this agreement. If signature or initials are
required by ODOT personnel to confirm receipt of delivery or pickup of a piece of equipment the signature
shall be used by the Vendor solely for the purposes of acknowledging receipt or delivery. The Department
(and its agents) shall not be held responsible or liable for terms contained on any Vendor’s forms,
agreements, etc. that conflict with or add to the terms established through this agreement.
Addition of Newly Acquired Equipment
The Department understands that throughout the duration of this contract vendor’s equipment lists may
change. Therefore, ODOT shall consider requests from awarded vendors allowing them to add newly
acquired equipment to this agreement. The Department shall reserve the right to accept or reject, in
whole or part, a request made by an awarded vendor to add additional equipment to this agreement. The
vendor agrees that any additional equipment accepted by the Department would be therefore added to
this agreement and shall be subject to the terms and conditions of this agreement.
Vendor requests to add newly acquired equipment shall be made on a no more than quarterly basis from
the contract effective date.

Within a reasonable period of time, the Department shall respond in writing to the vendor notifying them
of acceptance or rejection.
Rejection and/or Removal of Equipment due to Poor Working Condition
If, in the opinion of the Department, a piece of equipment included in this agreement is found to be in
poor working condition the Department shall reserve the right to reject the equipment at the point of
delivery or at pick-up. The Department shall further reserve the right to remove any piece of equipment
that is deemed to be in poor working condition (i.e. Implied Warranty of Merchantability) from this
agreement. The Department will not be charged any cost for equipment rejected or removed due to poor
working condition.
