REQUEST FOR PROPOSALS
FOR CONSTRUCTION MANAGER-AT-RISK SERVICES
CITY OF JACKSONVILLE, TEXAS
Pursuant to the provisions of Texas Government Code Chapter 2269, Subchapter F, it is the intention
of the City of Jacksonville (the “City”) to select, via the one-step Request for Proposal process, a
Construction Manager-at-Risk (a “Construction Manager”) for the construction of the project
described herein (“Project”). Persons or entities submitting proposals are referred to herein as
“Offeror(s).”
Proposals are to include the information requested in Section II of this Request for Proposals (the
“Request”) in the sequence and format prescribed. In addition to and separate from the requested
information, Offerors submitting proposals may provide supplementary materials further describing
their capabilities and experience. Four (4) copies of the proposals are required.

Any proposal received after such time will not be considered and will be returned unopened.

Following the deadline for receipt, the City's staff will receive, publicly open, and read aloud the
names of the Offerors and all fees and prices stated in the proposals. Within forty-five (45) days
following the date of the opening, the City will evaluate and rank each proposal submitted in relation
to the selection criteria set forth herein. The City may also request additional information from
Offerors at any time prior to final ranking of Offerors. The City may select all, some or none of the
Offerors for interviews. The interview, if any, will not be scored separately from the proposal, but
may result in an adjustment in score. A recommendation will be made to the City Council as to the
ranking of the proposals.

Following the City’s ranking of the Offerors based on the published selection criteria, the City will
attempt to negotiate an agreement with the Offeror that offers the best value to the City. If the City
is unable to negotiate an agreement with the selected Offeror, the City shall, formally and in writing,
end negotiations with that Offeror and begin the negotiation process with the next ranked Offeror
in the order of selection ranking until a contract is reached or negotiations with all ranked Offerors
end.
Pursuant to Texas Government Code Section 2269.254, the City will rank the proposals based on
the following criteria and relative weights:

30% Offeror’s experience and past performance on similar projects
15% Quality of the Offeror’s work and services
15% Qualifications of Offeror’s proposed personnel
5% Offeror’s financial strength
5% Offeror’s safety record
15% Offeror’s proximity to the worksite
All responses in the Offerors’ proposals may be used to rank Offerors based on the criteria. The City
reserves the right to verify the accuracy and completeness of all responses by utilizing any
information available to the City without regard to whether such information appears in your
proposal.
By submitting a proposal, each Offeror agrees to waive any claim it has or may have against the
City, the Architect/Engineer, and their respective trustees, agents and employees, and any reference
sources, arising out of or in connection with the administration, evaluation, or recommendation of
any proposal; waiver of any requirements under the Request for Proposals; acceptance or rejection
of any proposal; and award of a contract.
The City shall have no contractual obligation to any Offeror, nor will any Offeror have any property
interest or other right in the contract or Work being proposed unless and until a contract is
unconditionally executed and delivered by all parties, and all conditions to be fulfilled by the Offeror
have been so fulfilled by the Offeror.
I. SCOPE OF WORK, FORM OF CONTRACT
A. Scope of Work:
1. Project: The proposed Project consists of the repair and modification of the HVAC
systems, roof and building envelope, and related elements in the Public Safety Complex.
2. Scope of Services: The selected Offeror shall serve as a Construction Manager-at-Risk for
the Project, providing (1) Preconstruction Services, and provided that the parties agree on a
Guaranteed Maximum Price, (2) construction services for the construction of the Project.

Such services are generally outlined below.
i. Preconstruction Services: Construction Manager shall provide preconstruction services
for the Project as specified in the Contract Documents and as otherwise agreed by the
parties. Such preconstruction services may include, but shall not be limited to, the
following:
a. Cost estimating services;
b. Constructability analysis;
c. Scheduling and planning services;
d. Value engineering;
e. Preparation of preliminary bid packages for subcontractors and suppliers;
f. Identification of long-lead procurement items; and
g. Preparation of a GMP proposal.
ii. Construction Services: Construction Manager shall provide services and Work during
the construction phase of the Project as specified in the Contract Documents, if the
parties execute a Guaranteed Maximum Price amendment, which may include but shall
not be limited to the following:
a. Performance of the Work specified in the Contract Documents;
b. Procurement of materials and equipment;
c. Bidding, award, and management of subcontracts and supplier agreements, in
compliance with City’s requirements;
d. Quality control measures;
e. Coordination with the City’s Architect/Engineer as necessary for the performance
of the Work;
f. Management of site operations and safety programs; and
g. Coordination with authorities having jurisdiction as necessary for the performance
of the Work.
B. Timing/Anticipated Schedule:
At this time, the City is estimating the Project should be substantially complete within 9-12 months
of execution of the Agreement, as defined below.
C. Budget:
The final budget for this Project is still being determined; however, Offerors should provide
estimated General Conditions Costs and a proposed Fee based upon an estimated budget of Two
Million Dollars ($2,000,000) for the construction of the Project.
D. Form of Contract:
The contract between the City and the Construction Manager shall be the “Standard Form of
Agreement Between Owner and Construction Manager as Contractor Where the Basis of Payment
is the Cost of the Work Plus a Fee with a Guaranteed Maximum Price,” AIA Document A133-2019,

as modified by the City for this Project (“Agreement”). A copy of the Agreement, as modified, is
attached as Exhibit “A.” The General Conditions shall be the General Conditions of the Contract
for Construction, AIA Document A201-2017, as modified by the City for this project (“General
Conditions”), attached as Exhibit “B.” The GMP Amendment form, AIA Document A133 – 2019
Exhibit A, “Guaranteed Maximum Price Amendment” (“GMP Amendment Form”) is attached as
Exhibit “A-1.” The insurance requirements with which Construction Manager must comply
(“Insurance Requirements”) are attached as Exhibit “A-2.”
By executing and submitting a response to this Request, Offeror represents that it has reviewed the
terms and conditions of the Agreement, General Conditions, GMP Amendment Form, and Insurance
Requirements, and will execute these documents in substantially similar form, subject to final
approval by the City Council. Offeror must state any requested modifications to these Contract
Documents as part of its response to this Request. If no requests are made, Offeror will be
expected to execute the contract without modification.
The Prevailing Wage Schedule adopted by the City Council is attached as Exhibit “C.”
Offerors must complete and submit the Conflict of Interest Questionnaire (Exhibit “D”) and Non-
Collusion Affidavit (Exhibit “E”) with its response to this Request.
E.
The Offerors, or any agent or representative of Offerors, shall not undertake any activities
or actions to promote or advertise their qualifications or Proposal to any member of the City Council,
the City’s Administration or their respective staff persons, except as specifically requested in writing
by the City, at any time between the date of publication of the Request and the date of award of an
Agreement by the City Council. This restriction extends to “thank you” letters, phone calls, emails
and any contact that results in the direct or indirect discussion of the Request and/or proposals
submitted by Offerors.
F.
Other Conditions and Terms:
1. Liquidated damages, if any, shall be as set forth in the Contract Documents.
2. Selected Offeror shall be required to provide performance and payment bonds in accordance
with the terms of the Contract Documents and Texas law, including Section 2269.258 of the
Texas Government Code.
3. The City will not be responsible for the costs incurred by any Offeror or other party relating
to the preparation or submittal of a proposal.
4. Respondents are advised that the Texas Prevailing Wage Law will be administered in
accordance with the procedures set forth in the Contract Documents and as required by
Chapter 2258 of the Texas Government Code. Applicable rates and prevailing wage
requirements are shown in Exhibit “C.”
