Clear Creek County and its four municipalities, Idaho Springs, Georgetown, Empire and Silver Plume, together have recently formed a multi-jurisdictional housing authority, the Clear Creek Regional Housing Authority (CCRHA). Clear Creek County, acting as Fiscal agent, and the four municipalities as co-applicants, have been awarded a Colorado Department of Local Affairs (DOLA) Local Planning Capacity (LPC) grant. The Grant will fund two projects. One, that is a sister project to this RFP, is a general project to launch the project.
The second, and subject of this RFP is a to seek legal services to advise and oversee the process described above.
The County, in its capacity as Fiscal Agent, is seeking a qualified attorney or firm as legal consultant to perform the following tasks for the Legal Consulting for Clear Creek Regional Housing Authority Launch Project:

Provide legal advice in the formation of a new government entity; the CCRHA

Observe the steps and work product of the CCRHA launch to ensure legal compliance

Assist with the identification of and or drafting of needed policy and procedure documents
This project is to provide legal advice on the launch of the Clear Creek Regional Housing Authority (CCRHA) including the development of identified policy and procedure documents. The project is funded by a DOLA Local Planning Capacity grant and has a budget of $60,000.

D. Responsiveness
This RFP provides prospective contractors with sufficient information to prepare and submit proposals for consideration by the County. To be considered responsive, each proposal must provide for completion of the tasks and Proposer information outlined in the RFP.

Standard Terms and Conditions of Request for Proposal
1. Clear Creek County reserves the right to reject any and all proposals, to consider alternatives, to wave irregularities and to re-solicit proposals.
2. Clear Creek County reserves the right to conduct such investigations of, and discussions with, those who have submitted proposals (“Proposers”) or other entities as it deems necessary to assist in the evaluation of any proposal or to secure maximum clarification and completeness of any proposal.
3. All proposals submitted must be valid for a minimum period of ninety (90) days after the date of the proposal opening.
4. Clear Creek County reserves the right to select the most responsible and responsive proposal which it finds to be in the best interests of Clear Creek County.
5. The County intends to engage the most qualified applicant available for this assignment. Responses to the RFP will be a principal basis for evaluation. The following criteria shall be considered in evaluating the proposals:
a. The reputation, experience and efficiency of the Proposer;
b. The ability of the Proposer to perform the contract or provide the goods and services within the time specified;
c. The comparative quality of the goods and services;
d. The Proposer’s performance under previous contracts with Clear Creek County, if applicable;
e. The Proposer’s performance under previous contracts of a similar nature with others, if applicable;
f. The ability of the Proposer to provide future oversight and services;
g. The number and scope of conditions attached to the proposal;
h. The Proposer’s interest in the project, as well as their understanding of the project scope and the specific requirements of Clear Creek County Open Space.
i. General qualifications of the firm and the qualifications of the assigned staff.
j. The Proposer’s price for services.
6. Clear Creek County makes no promise to any Proposer until such time as Clear Creek County executes the negotiated contract.
7. Any restrictions on the use of data contained within a proposal must be clearly stated in the proposal itself.
8. This RFP contains the instructions governing the proposals to be submitted and the materials to be included therein. These are mandatory requirements that must be met to be eligible for consideration.

Qualifications:

The Scope of Services desired includes but is not limited to the following:
1. Provide legal advice in the formation of a new government entity
a. Assist and advise as the CCRHA develops protocols, publishes notification standards, its website, adopts bylaws and other core tools
2. Observe the steps and work product of the launch to ensure legal compliance
a. Observe and participate as budget allows in the planning process to ensure legal compliance
b. Assist and advise with the creation of best practices in the development of day-to-day operations
3. Assist with the identification of and or drafting of needed policy and procedure documents
a. Proved knowledge and experience in the drafting and development of needed policies. practices and procedures, i.e. procurement polices, hiring policies, etc. that a new housing authority will need to function legally and effectively.
Schedule
Clear Creek County and the CCRHA anticipate that this project should take 8-12 months.
PROPOSER INFORMATION
Personnel
Furnish a list showing the key personnel and, if multiple, their primary assignments on this project. Please provide resumes. Ideally there will be one key staff member dedicated to this project who will be supported by the firm’s other staff experts. Clear Creek County is looking for staff who have relevant legal experience in housing, housing authorities, small or rural communities facing changing economies or transitions.
Qualifications
Furnish a summary of your experience on similar projects and provide a brief summary of three examples. Please provide at least one example of a project in which your efforts help a community achieve their housing goals. For each project provide the name, address and phone number of a contact person involved in the project. The statement of qualification shall be brief but shall include at a minimum the following:
1. Description of similar projects
2. Capabilities and staff
3. Based on the Scope of Work, present a general project plan, budget allocation and timeline.
Conflicts
The proposing firm shall include as part of the proposal, a disclosure of any specific interest or affiliation with or in any land within Clear Creek County, which could be directly benefited or could be served or prejudiced by Clear Creek County Government pursuing this project. If there is nothing to disclose, the proposal shall so state.

Special Requirements:
|
All materials submitted regarding this RFP become the property of the County and will only be returned at the County’s option. Responses may be viewed by any person at the proposal opening time and after final selection has been made. The County has the right to use any or all of the material outlined in the Proprietary Information above. Disqualification of a Proposer does not eliminate this right.
Incurring Costs
The County is not liable for any costs incurred by those who have submitted proposals (Proposers) prior to issuance of a signed contract.

In 2021, Clear Creek County started a process to better utilize and respond to the 2018 Housing Needs Assessment. This year-long community informed process resulted in the Clear Creek Housing Strategy, a report that was adopted in 2022. A key recommendation in that Strategy was, to better utilize the limited staff resources, spread across the county, Clear Creek County should pursue the formation of a Multi-jurisdictional Housing Authority (MJHA).
Clear Creek County, Idaho Springs, Georgetown, Empire and Silver Plume have come together to form the Clear Creek Regional Housing Authority (CCRHA). CCRHA is a collaborative effort supported by an Intergovernmental Agreement (IGA) executed in November of 2024. It is a multi-jurisdictional housing authority that was formed as a recommendation of the 2022 Clear Creek Housing Strategy by the Clear Path Home Project. The Clear Path Home project identified three main goals for the Housing Authority:
1. Advance Affordable Housing
2. Provide Resident Services
3. Identify a Revenue Stream
This project seeks to build on the three goals identified in the Clear Path Home project and enable the CCRHA Board and Executive Director to lead and drive selected housing advancement tactics strategies, sustainably and in a community informed way.
