Description

SINGLE SOURCE SPECIAL NOTICE



This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 - Synopses of Proposed Contract Actions U.S. Army Corps of Engineers - Omaha District, intends to issue a Firm-Fixed Price contract to KEM Electric Cooperative Inc, 107 S Broadway, Linton, North Dakota. The purpose of this acquisition is for a utilities contract to provide 3 phase power upgrades to Oahe Project North Dakota Beaver Creek Recreation Areas. The contractor shall provide electric service upgrade to the Government facilities at Beaver Creek Recreation Areas in a manner and form consistent with (1) all applicable laws, regulations, permits, and electric code, and (2) the facilities’ service requirements. The statutory authority for this non-competitive acquisition is 10 U.S.C 2304(c)(1) as implemented by FAR 13.106-1(b) Soliciting from a single source (1) for purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available.



A SOLICITATION WILL NOT BE POSTED. The Government intends to proceed with this sole source action. The NAICS code is 237130 - Power and Communication Line and Related Structures Construction. The Small Business Size Standard is $45,000,000.00. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS.



Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. If no affirmative written responses are received by 2pm CDT on 06 August 2025, an award will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the government not to compete this proposed requirement is solely within the discretion of the government. The U.S. Army Corps of Engineers is not responsible for any costs incurred by responding to this notice.
