Publish date: April 17, 2026
SECTION 1 – GENERAL INFORMATION
1.1 Purpose
In accordance with the Comprehensive Environmental Response, Compensation, and Liability Act
(CERCLA) § 104(k) and 40 CFR § 312.10, the City of Missoula, Montana, (City) is seeking
Statements of Qualifications (SOQ) from firms to coordinate, direct, and oversee environmental
assessment and cleanup activities at any given brownfield site over the course of three (3) years
from 2026 to 2029.
1.2 General Submission Information
The Brownfields Program is accepting SOQs from firms wishing to be added to the list of
prequalified firms to perform specific projects involving several types of environmental services.
The SOQ should address the firm’s capabilities for performing all aspects of services that they are
requesting consideration for prequalification. Specific project selections will be based on the list
of prequalified firms determined by City program staff based on the information included in the
submitted SOQ. The City reserves the right to award projects to prequalified firms at its discretion,
either directly or through a project specific proposal based system. Additionally, the City may, in
its sole discretion, conduct additional procurement outside this RFQ for activities which would
benefit the program from additional expertise or qualifications.
1.3 Questions
Questions will be accepted until 11:59 p.m. (local time) on Wednesday, May 13, 2026. Questions
regarding this RFQ should be submitted to:
Tyler Walls, Brownfields Program Specialist
Phone: 406-552-6108 | Email: wallst@ci.missoula.mt.us

The City shall not be responsible for SOQ preparation costs, nor costs including attorney fees
associated with any (administrative, judicial or otherwise) challenge to the determination of

claims to such costs and fees.
1.5 Reasonable Accommodations
The City attempts to provide reasonable accommodations for any known disability that may
interfere with a person from participating in any service, program, or activity of the agency.
Alternative accessible formats of this document will be provided upon request. For further

SECTION 2 – GENERAL CONDITIONS
2.1 Quality Assurance
Any environmental sampling required will follow guidelines, regulations, and requirements of
both the U.S. Environmental Protection Agency (EPA) and Montana Department of
Environmental Quality (DEQ). All data will be generated in accordance with the quality
requirements described in the City’s Programmatic Quality Assurance Project Plan (QAPP) (June
2024 – January 2026 Annual Review) or its successor, as appropriate. Sampling activities must be
adequate to determine the presence or absence, magnitude, extent, and cleanup options for
contaminants that may pose a threat to human health and the environment, as well as
redevelopment and future land use. Prior to any sampling event, a site-specific Sampling and
Analysis Plan (SAP) will be developed and approved by EPA and DEQ, as necessary. SAPs will
identify the data collection activities and associated quality assurance and quality control measures
for the sampling event. The City’s QAPP is available electronically upon request.
2.2 Federal Requirements
Because this work is federally funded it entails federal cross-cutting requirements. The three most
impactful federal requirements are highlighted below.
DBE Procurement
In accordance with EPA’s Program for utilization of Disadvantaged Business Enterprises
(DBEs), the selected firms must ensure and document that six affirmative steps are
followed in extending any subcontracting opportunities to qualified DBE firms (see 40
CFR § 35.6580(a)). This applies to subcontractors who may be listed as members of the
project team as described in Section 3.6.
Davis-Bacon Act
In general, contracts and subcontracts for construction related activities must be procured
in accordance with Davis-Bacon (DB) requirements; awarded at or above DB prevailing
wage requirements; and must document and retain documentation of compliance with DB,
e.g., periodic interviews and weekly collection of certified payrolls. Construction related
activities associated with cleanup activities are subject to DB prevailing wage
requirements. For example, excavation of contaminated soil would be classified as Heavy

Construction; and asbestos abatement within structures would be classified as Building
Construction. The selected firms will assist the City to comply with DB requirements for
its own staff (if relevant) and cleanup contractors who must follow the prevailing wage
determination for the locality of Missoula, Montana.
National Historic Preservation Act
Prior to conducting or engaging in any on-site activity with the potential to impact historic
properties (such as invasive sampling or cleanup), the City shall consult with EPA
regarding potential applicability of the National Historic Preservation Act (NHPA) (16
USC § 470) and, if applicable, shall assist EPA in complying with any requirements of
NHPA and implementing regulations. The selected firms will assist the City to comply
with NHPA Section 106 requirements, as necessary.
2.3 Health and Safety Requirements
The selected firms must have advanced health and safety training as specified in Occupational
Safety and Health Administration (OSHA), 29 CFR 1910.120, including 40-Hour Hazardous
Waste Operations and Emergency Response (HAZWOPER) and 8-Hour Refresher Courses.
Selected firms must ensure that all individuals working at the site have appropriate health and
safety training. The selected firms may be asked to review and prepare site-specific Health &
Safety Plans prior to any on-site work performed by any contractor or subcontractor.
2.4 Equal Employment Opportunity
Pursuant to Section 49-2-303 and 49-3-207, of the Montana Code Annotated, no part of these
services shall be performed in a manner which discriminates against any person on the basis of
race, color, religion, creed, political ideas, sex, age, marital status, physical or mental disabilities,
or national origin by the persons performing the contract. Any hiring by the selected firm shall be
on the basis of merit and qualifications directly related to the requirements of the particular position
being filled.
