The NESHOBA COUNTY BOARD OF SUPERVISORS will receive sealed bids until
Tuesday, September 8, 2026 at 10:00 AM from qualified vendors in response to this
solicitation for acquiring the following equipment and services:
One (1) or more, used, 2021 model year or newer, motor grader.
Detailed specifications for the above-described equipment and bid forms may be
obtained from the Neshoba County Board of Supervisors office at the Neshoba County
Courthouse, 401 Beacon Street, Suite 201, Philadelphia, Mississippi 39350, by calling 601-
656-6281 or on Neshoba County’s website at www.neshobacounty.net. Neshoba County,
Mississippi will determine if compliance with the specifications exist before accepting any
bid.
INSTRUCTIONS TO BIDDERS:
The detailed proposal, with the official bid form, in response to this solicitation shall
be submitted via single file PDF under the correct bid solicitation at
www.neshobacounty.net/bids or be placed in a sealed envelope marked “2026 Used
Motor Grader Bid” and filed with the Neshoba County Board of Supervisors C/O Chancery
Clerk Gidget Stovall Tate, 401 Beacon Street, Suite 107, Philadelphia, Mississippi 39350 by
10:00 AM on Tuesday, September 8, 2026. Neshoba County will not be responsible for
opening of bids not properly marked or received after the proposal response date and
time.
It shall be incumbent upon each bidder to understand the specifications as listed
herein and to obtain clarification when necessary. It is not the intent of these
specifications to limit the bidding to any particular make or manufacturer of equipment or
provider of services, but rather to select such equipment or services to provide for specific
needs and specific tasks. Any reference to name-brand materials or equipment is
intended to establish the minimum necessary standards only and bids submitted on
materials and equipment thereto, at the sole discretion of Neshoba County, shall be
considered.

INVITATION TO SUBMIT COMPETITIVE BIDS
The Neshoba County Board of Supervisors is soliciting competitive, sealed bids from
qualified vendors for the purchase of one (1), used, 2021 model year or newer, motor grader
for the use and benefit of Neshoba County and the Neshoba County Road Department.
Neshoba County reserves the right to reject any and/or all bids. Neshoba County also
reserves the right to accept the bid most advantageous to Neshoba County, Mississippi with
price, condition, delivery time and other factors considered.
The attached specification defines the MINIMUM specifications for a used, 2021 model year
or newer, heavy-duty, intensive use motor grader. All bids must exceed or be equal in
performance and quality to the following specifications, which are the minimum
specifications for this equipment. Any reference to manufacturer makes or series of
equipment stated are intended only to establish an acceptable standard and are not
intended to limit the bidding. It shall be incumbent upon each bidder to understand the
specifications as listed herein and to obtain clarification when necessary. It is not the intent
of the specifications to limit the bidding process to any particular make or manufacturer,
but to set a minimum standard, fill a specific need and to perform a specific task. Any
questions or clarifications in regard to this solicitation must be sent to Neshoba County
Road Manager Eddie Posey in writing via email, up to 48 hours (two business days) of the
Proposal Response Time and Date, by e-mail to eposey@neshobacounty.net.
This invitation is extended to all qualified vendors/manufacturers that are specifically in the
business of supplying heavy equipment for demanding use in road and bridge construction
and road and bridge maintenance activities.
INSTRUCTIONS TO BIDDERS:
The bid format shall include a complete and detailed proposal from the vendor along with
answering the following specifications questionnaire with a positive (YES) or negative (NO)
answer which will be included with all bids submitted. If the vendor answers negative or
NO to the specification provided, the vendor shall explain in detail why the specification is
not met by their proposed equipment and provide an explanation as to why they are
proposing an exception to such specification (if any). Vendors who propose a bid taking
total or general exceptions will be considered non-responsive and the bid will be rejected
at the sole discretion of Neshoba County, Mississippi.

SPECIFICATIONS FOR SOLICITATION
NOTICE TO BIDDERS: Bidders shall thoroughly examine any and all specifications,
schedule, instructions and any other documents supplied as part of this invitation to bid.
Bidders shall make all investigations necessary to thoroughly inform themselves regarding
the content of the written specifications and instructions supplied herein. No pleas of
ignorance by the bidder pertaining to the content of the specifications, schedule or
instructions will be considered by the agency once the deadline for proposal submission
has occurred. Failure or omission on the part of the bidder to make the necessary
examinations and investigations into the content of the specifications AND make all
clarifications or explanations of exceptions and conditions that exist or that may exist
hereafter shall NOT be accepted as a basis for making variations to the requirements of the
agency or compensation to the bidder.

CLARIFICATIONS: Clarifications shall be written correspondence between the bidder, the
agency and all other qualified bidders. A Clarification shall include the paragraph number,
page number, the text with unclear content (as written in the specification) and the definition
of the clarification requested. Verbal clarifications shall be documented in writing and
distributed to all other qualified bidders at least two business days prior to the deadline for
bid submission by amendment or update to specifications on the Neshoba County website.

EXPLANATION OF EXCEPTIONS: Bidders may take exceptions to any part of the bid
contained herein with a written itemized schedule. The schedule shall include the paragraph
number(s), the text that the bidder feels he can not comply with and an explanation why the
bidder feels that the requirement is not in the best interest of the county and/or an alternate
bidder solution. Alternate bidder solutions may be considered by the county, if the bidder
can show the agency that the alternate solution is, in quality, quantity, performance, etc.,
equal to OR better than the specified item. This agency will share the exception/alternate
solution with all other Qualified Bidders. Explanation of exceptions shall be documented in
writing at least two business days prior to the deadline for bid submission.

invitation to give, for the consideration of the county, a proposal that will comply with the

A bidder who submits a bid that takes "Total Exception" and makes an offering of some
"Standard" or "Stock" unit will be viewed by the agency as a bidder who did not make, and is
not prepared to make, a valid bid, and is not qualified to supply the heavy equipment as
specified herein. Alternate bids will NOT be considered. Any bidder desiring to provide a
response to this solicitation shall only submit one bid for their best product meeting the
specifications herein.

DEBARMENT STATUS:
By submission of this bid response, the Bidder and/or its authorized representatives, certify
under penalty of perjury, that to the best of their knowledge and belief they are not currently
debarred from submitting bids or bid on contracts by any agency within the State of
Mississippi, nor are they an agent of any person or entity that is currently debarred from
submitting bids on contracts by any agency within the State of Mississippi.
WARNING:
This agency will not tolerate Vendors who state compliance to specifications but deliver an
incomplete product and/or sub-standard materials and workmanship. Vendors who have
made delivery of such equipment without making every reasonable effort to remedy the
defects found at the time of delivery or within the warranty period will be notified that they
are DEBARRED from submitting bids to this agency in the future. This agency will not waste
valuable time (more than once) trying to recover legal costs and deal with lost in-service time
of new equipment, working with vendors who are unresponsive to the needs of this agency.

EQUIPMENT TYPE: The Neshoba County Road Department is seeking one (1) used motor
grader that delivers maximum power, performance and versatility to perform in a wide
range of applications under demanding road construction and maintenance use
