SEWER CHEMICALS INVITATION TO BID
The Town of Spencer, Board of Sewer Commissioners, hereinafter called TOWN, invites sealed bids
from qualified vendors, hereinafter called BIDDER, on forms included with bid specifications, for the
purchase and delivery of bulk Liquid Aluminum Sulfate, bulk Soda Ash, Liquid Polymer (shipped in 55-
gallon drums) and bulk Liquid Sodium Hydroxide. Bid prices will be valid from July 1, 2026 through
June 30, 2027.
Bid specifications and a sample contract will be available on May 21, 2026, on the Town of Spencer
Website spencerma.gov (Click on Bids & RFPs). Obtaining the bid documents online is strongly
encouraged. All bids must conform to the specifications of the TOWN and be submitted on the proper
forms to be considered a valid bid. Seal Bids will be accepted at the Spencer Sewer Department, 3
Old Meadow Road, Spencer, MA 01562, until Thursday, June 11, 2026 at 1:00 PM, at which time
they will be opened and read aloud.
All bids shall be in accordance with M.G.L. including but not limited to: Ch. 30, Section 39M (Bid
Bond), Ch. 149, Sec. 27 (Prevailing Wage Rates), and Ch. 149, Sec. 29 (Labor and Material Bonds as
applicable). A bid deposit in the amount of 5% of the bid shall accompany every bid. The bid deposit
shall be in the form of a bid bond, certified treasurer’s check, or cashiers check made payable to the
Town of Spencer. Upon award and signing of the contract, the bid deposit will be returned to the
bidders. The Town of Spencer is exempt from sales and federal excise tax to the extent permitted under
law; BIDDERS should not include such taxes in figuring or in references to any bid.
Bids offering escalation clauses will be rejected. The Town of Spencer reserves the right to reject any
and all bids, wholly or in part, or to accept any bid even if the bid is not the lowest cost, if it is deemed
to be in the best interest of the municipality, to waive informalities deemed inconsequential and to make
awards in a manner deemed to be in the town's best interest. Minority and woman-owned businesses are
encouraged to bid.

The Town of Spencer, Board of Sewer Commissioners, hereinafter called TOWN, establishes the
following specifications for contractors submitting sealed bids, hereinafter called BIDDER.
1. Each bid must be submitted in a sealed envelope bearing the name and address of the BIDDER on
the outside and plainly marked "Spencer Sewer Chemicals Bid". If submitted by mail, the sealed
envelope(s) containing the bid(s) must be enclosed in a separate sealed envelope addressed to the
Spencer Sewer Department, 3 Old Meadow Road, Spencer, MA 01562. Undelivered or lost mailed
bids will be qualified as no bid.
2. All bids must be submitted on the bid proposal form attached. All blank spaces for bid prices must
be filled in, in ink or typewritten, in both figures and words as applicable, and the bid proposal form
must be fully completed and executed when submitted. In cases of price discrepancy, the amount in
words will govern.
3. Bidder shall provide properly licensed equipment and qualified personnel to deliver chemicals
uncontaminated, in a safe and efficient manner.
4. The TOWN may make such investigation as deemed necessary to determine the ability of the
BIDDER to supply said chemical and the BIDDER shall furnish to the TOWN all such information
for this purpose as the TOWN may request. No award will be made to any BIDDER who cannot
meet all of the following requirements:
He shall not have defaulted on any contract during the previous five years.
He shall maintain a permanent place of business. (where if applicable)
He shall have adequate personnel and equipment to perform the work expeditiously.
He shall have suitable financial status to meet obligations incident to the work.
He shall have appropriate technical experience satisfactory to the TOWN in the class of chemical
involved.
He shall be registered with the Secretary of State of the Commonwealth of Massachusetts to do
business in Massachusetts.
He shall not have failed to perform satisfactorily on contracts of a similar nature.
He shall be within a distance (50-100 mile radius) of the Facility that the Town finds suitable for
emergency delivery, or able to deliver in a timely fashion daily process chemicals (Hydrated
Lime, Aluminum Sulfate) during natural disaster, inclement conditions, etc.
5. The TOWN reserves the right to reject any bid if the foregoing requirements are not satisfied or if
any other evidence fails to satisfy the TOWN that such BIDDER is properly qualified to carry out
the obligations of the contract and to complete the work contemplated therein. Conditional or
qualified bids will not be accepted.
6. Estimated quantities for unit price items are approximate, only being given, as a basis for the
uniform comparison of bids, and the TOWN does not expressly, nor by implication, agrees that the
actual amount of chemical will correspond therewith.
7. At the time of opening of bids, each BIDDER will be presumed to have read and to be thoroughly
familiar with the technical specifications (including all addenda). The failure or omission of any
BIDDER to examine any form, instrument or document shall, in no way, relieve any BIDDER from
any obligation in respect to his bid.

8. During the bidding period, access to the delivery site is available by permission of the Town of
Spencer Sewer Department by calling 508-885-7542.
9. Unit prices shall include the entire cost of labor, fuel, materials, overhead, profit, bonds, insurance
and all other items incidental to fulfilling purchase and delivery requirements.
10. No amount shall be added for state sales tax. The successful BIDDER will be supplied with the
Town of Spencer's tax-exempt number after the bid award.
11. The BIDDER shall include with the Bid Proposal Certificates of Insurance in the sum of five
hundred thousand/one million/five hundred thousand dollars
($500,000.00/$1,000,000.00/$500,000.00) to cover public liability and a certificate of insurance
covering workers' compensation, all of which shall remain in full force and effect during the contract
period. Said insurance shall indemnify the Town of Spencer and the Spencer Sewer Department
against all claims, liability or action for damages incurred in any way connected with the
performance of the work of the licensee and for or by any acts or omissions of said licensee in the
performance of work.
12. The bid will be valid for one year from the period beginning July 1, 2026 through June 30, 2027.
13. The contract will be awarded to the responsible BIDDER submitting the lowest bid, complying with
the conditions stipulated in these Bid Specifications. Contracts may be awarded to the responsive
and responsible BIDDER(s) offering the lowest price for each individual item. The TOWN reserves
the right to reject any or all bids, wholly or in part, and to make awards in a manner deemed in the
best interest of the TOWN. In the event of an equal bid the TOWN reserves the right to divide the
award among two or more in the best interest of the TOWN. In the event that the lowest responsible
and responsive BIDDER is unable to perform, the second lowest responsive and responsible
BIDDER would be called upon to continue contract. Bid prices are expected to be held or BIDDER
would hold price.
14. The BIDDER shall keep the materials under his personal control and shall not assign by power of
attorney or otherwise or sublet the work or any part thereof without approval of the TOWN.

Commercial Grade Liquid Aluminum Sulfate Product Specifications
PRODUCT:
48.5% Liquid Aluminum Sulfate (Al2(S)4)3 x H2O)
COMPLIANCE:
Product must meet or exceed the current American Water Works standard B403 for aluminum sulfate.
Product must also be certified under ANSI/NSF Standard 60 - Drinking Water Treatment Chemicals.
The manufacturer and all intermediate vendors, if any, taking custody of the product must have
ANSI/NSF Standard 60 certification for the product from either Underwriters Laboratory (UL) or the
National Sanitation Foundation (NSF).
MANUFACTURE & PHYSICAL PROPERTIES:
The product shall be manufactured with bauxite ore and sulfuric acid and contain a minimum 8.3%
alumina. The pH of the liquid product shall be greater than 2.0 su.
ESTIMATED PURCHASE QUANTITY:
It is estimated that the quantity of the product required for the 12-month period contract period will be
30,000 gallons. Typical order and delivery quantities shall be one 5,000 gallon load each delivery.
BIDDING FORMAT:
The vendor shall bid the product in price per gallon in liquid form. Bid price must be made on the
included bid form.
DELIVERY REQUIREMENTS & LOCATION:
All orders for the product from the town will be phoned into the vendor accompanied by a purchase
order number. The vendor shall be required to be able to deliver the product within 72 hours of receipt
of the order.
The vendor is responsible for any product spill that occurs during loading, transportation and unloading
operations.
Delivery fill pipe is 2-inch ID with a 21/2-inch OD quick connect female end. The vendor is responsible
for all fittings and hoses to connect the delivery fill pipe.
