1. Project Overview
Pike County Schools is requesting proposals from qualified paving contractors for a campus-
wide paving and roadway improvement project located at Pike County Schools main campus.
The project consists of multiple roadways, parking, and traffic improvement areas identified
by color coding on the project map. Each area represents a specific scope of work and must be
priced separately as part of the proposal.
Work includes but is not limited to:
* Asphalt milling and resurfacing
* Pavement repair and undercutting
* New asphalt paving
* Roadway widening
* Parking lot expansion
* Grading and base installation
* Curb and gutter installation
* Concrete sidewalks and ADA ramps
* Traffic control
* Pavement striping and signage
* Erosion control and site restoration
* Payment and Performance Bond
* All work to be completed per GDOT specifications.
Contractors must submit a cost analysis for each color-coded project area as outlined in this
RFP.
2. Contractor Qualifications and
Requirements
Contractors submitting proposals must:
* Be properly licensed to perform paving work in the State of Georgia
* Have experience with municipal or institutional paving projects
* Demonstrate familiarity with standards established by the Georgia Department of
Transportation (GDOT)
* Provide proof of insurance and bonding capacity
* Provide at least three references for similar projects completed within the past five years
* Include a copy of your company's current W-9 Tax Form
* Include a copy of your company's current E-Verify Form

Subcontractor Affidavit under O.C.G.A. 13-10-91(b)(3)
By executing this affidavit, the undersigned subcontractor verifies its compliance with O.C.G.A.
13-10-91, stating affirmatively that the individual, firm or corporation which is engaged in the
physical performance of services under a contract with (name of contractor) on behalf of (name
of public employer) has registered with, is authorized to use and uses the federal work
authorization program commonly known as E-Verify, or any subsequent replacement program, in
accordance with the applicable provisions and deadlines established in O.C.G.A. 13-10-91.
Furthermore, the undersigned subcontractor will continue to use the federal work authorization
program throughout the contract period, and the undersigned subcontractor will contract for the
physical performance of services in satisfaction of such contract only with sub-subcontractors
who present an affidavit to the subcontractor with the information required by O.C.G.A. 13-10-
91(b). Additionally, the undersigned subcontractor will forward notice of the receipt of an
affidavit from a sub-subcontractor to the contractor within five business days of receipt. If the

The contractor has the right to cancel this contract with a (30) thirty-day written notice of
contract cancellation being sent to PCS.
Termination for Convenience: PCS reserves the right to terminate the Contract, in whole or
in part at any time, with thirty (30) days' notice, when in the best interests of PCS without
penalty or recourse. Upon receipt of the written notice, the Contractor shall immediately stop
all work, as directed in the notice, notify all subcontractors of the effective date of the
termination and minimize all further costs to PCS. The Contractor shall be entitled to receive
just and equitable compensation for work in progress, work completed, and materials
accepted before the effective date of the termination.
Termination for default In addition to the rights reserved in the contract, PCS may
terminate the contract in whole or in part due to the failure of the Contractor to comply with
any material term or condition of the contract, to acquire and maintain all required insurance
policies, bonds, licenses and permits, or to make satisfactory progress in performing the
contract. PCS shall provide thirty (30) days' written notice to Contractor, identifying the
deficiencies in Contractor's performance or other material provision, allowing Contractor,
within those thirty (30) days, to cure deficient performance. If Contractor fails to cure the
deficient performance within the thirty (30) day cure period, the contract shall be terminated.
Upon termination under this paragraph, all goods, materials, documents, data and reports
prepared by the Contractor under the Contract shall become the property of and be delivered
to PCS on demand.
Additions/Deletions of Service PCS reserves the right to add and/or delete products and/or
services provided under this Contract. If a requirement is deleted, payment to the Contractor
will be reduced proportionately to the amount of service reduced in accordance with the
proposal price. If additional services and/or products are required from this Contract, prices
for such additions will be negotiated between the Contractor and PCS.
Changes and Change Orders PCS, within the general scope of the Agreement, may, by
written notice to Contractor, issue additional instructions, require additional services or direct
the omission of services covered by this Agreement. In such event, there will be made an
equitable adjustment in price, but any claim for such an adjustment must be made within
thirty (30) days of the receipt of said written notice. Change order shall mean a written order
to the Contractor executed by PCS issued after the execution of this Agreement, authorizing
and directing a change in services.

Payment Terms Contractor will provide monthly invoice statements consistent with the
amounts listed on the Bid Pricing Schedules. Payment is due "net 30" from date of invoice
receipt by PCS.
Personnel Contractor shall provide adequate personnel, trained in proper procedures and
techniques. The Contractor must demonstrate the ability to provide trustworthy, reliable workers.
Contractor shall employ a competent supervisor who will have full authorization to act on
Contractor's behalf and who will ensure that the Contractor's employees are fulfilling all terms of
this contract. All communications given to this supervisor shall be as binding as if given to the
Contractor. Contractor's supervisor shall establish a mutually agreeable regular line of
communication with PCS's contact person. No subcontracting of this contract will be allowed
without the express written consent of PCS.
a. The selected vendor(s) agrees that, at all times, their employees furnishing or performing
any of the services specified under this agreement shall do so in an identifiable uniform
and in a professional and dignified manner.
b. Prior to working on PCS premises, the vendor(s) shall subject all its employees to a
Criminal Records Check. Vendor will not permit any of its employees with a Criminal
Record to enter PCS premises. In addition, PCS reserves the right to carry out its own
Criminal Record Check for the selected vendor and any of the vendor's employees as is
deemed necessary.
c. Selected vendor(s) employees must be 17 years of age or older.
d. Selected vendor must be enrolled in and use E-Verify. Contractor affidavit must be
included in bid submission.
The Pike County School System requires all individuals working within a school building, or on
a school site, to submit to a background check pertaining to felony convictions and sex offender
convictions. Violent felons and sex offenders shall not be allowed within a school building or on
a school site. Convicted predatory sex offenders shall not be allowed on Pike County School
System property at any time. All decisions made in this effort to promote a safe school
environment shall be assessed at the sole discretion of the Pike County Board of Education.

Safety Precautions The Contractor shall adhere to and enforce all applicable local, state, federal, and
OSHA safety rules and regulations. All personnel will wear Personal Protective Equipment as required.
Liability Contractor shall be responsible for any such loss or damage to property including money,
securities, merchandise, fixtures, and equipment belonging to the PCS or PCS employees or to any other
person or organization to such extent as the PCS is legally liable for such loss or damage, if any such loss or
damage was caused by an employee of Contractor.
Insurance Requirements Prior to execution of the contract, and at all times that this Contract is in force,
the Contractor shall obtain, maintain and furnish the PCS Certificates of Insurance from licensed companies
doing business in the State of Georgia and acceptable to the PCS covering: 1.11.1
Statutory Workers' Compensation Insurance Employers Liability: 1.11.1.1
Bodily Injury by Accident - $100,000 each accident 1.11.1.2
Bodily Injury by Disease - $500,000 policy limit 1.11.1.3
Bodily Injury by Disease - $500,000 each employee Note: Under this contract, Contractor is required to
maintain workers' compensation coverage even if not required by law. 1.11.2

The PCS shall be shown as additional insured on General Liability, Auto Liability and Umbrella Liability
policies. 1.11.6
There shall be a (30) thirty-day notification to PCS in the event of a cancellation or modification of any
stipulated insurance coverage. 1.11.7

Insurance Company must have an A.M. Best Rating of A-6 or higher. 1.11.9

Company must be authorized to do business in Georgia by the Georgia Insurance Department.
Below is listed the insurance coverage which must be procured by the vendor at his own expense. The
Contract Services agrees to follow instructions indicated in each case:
(1) Comprehensive General Liability Insurance - Personal injury, including death, with limits of
$1,000,000 for each person and $2,000,000 for each occurrence.
(2) Property Damage - limits of $100,000 for each accident and $300,000 for the aggregate.
(3) Auto Liability - including Owner, hired, and non-owned vehicles with limits of Bodily injury,
including death limits of $1,000,000 for each person and $1,000,000 for each occurrence, and
Property damage limits of $1,000,000 for each occurrence.

(4) Umbrella Excess Liability Insurance: Vendor shall carry umbrella excess liability including Auto,
General Liability and Professional Liability in the amount of $1,000,000 over existing primary
insurance and over self-insured hazards.
(5) Environment Impairment Liability and/or Pollution Liability - $1,000,000 per occurrence.
(6) Worker's Compensation: As required by law.
All the above policies must be occurrence based. The Pike County School System shall be named as an
additional insured on all policies. The policies shall contain provision that the coverage provided by said
policies shall be primary to any insurance maintained by the School System. Said insurance shall in fact be
primary to any insurance maintained by the School System.
Equipment and Supplies
The Contractor must furnish all necessary equipment, tools, supplies, transportation, and all effort necessary
to perform the required services at the designated locations.
Silence of Specifications
The apparent silence of this specification and any supplemental specifications as to any details or the
omission of a detailed description concerning any point shall be regarded as meaning that only the best
commercial practices are to prevail and that only materials of first quality and correct type, size and design
are to be used. All workmanship is to be first quality. All interpretations of these specifications shall be
made upon the basis of this statement, with PCS interpretation to prevail.
Independent Contractor
1.14.1 The Contractor represents to PCS that he is fully experienced and properly qualified to perform the
functions provided for in the Scope of Work and that he is properly equipped, organized and financed to
perform such functions. The Contractor shall finance his own operations hereunder, shall operate as an
independent contractor and not as the agent of PCS and nothing contained in this Invitation to Bid or
contract resulting from same shall be construed to constitute the bidder or any of his employees, servants, or
agent, or subcontractors as a partner, employee, servant or agent of PCS nor shall either party have any
authority to bind the other in any respect, it being intended that each shall remain an independent contractor.
1.14.2 However, because the Contractor's work may be associated in the minds of the public with the PCS,
the Contractor shall ensure that its employees, subcontractors and agents perform in an orderly, responsible
and courteous manner.
1.14.3 The Contractor is solely responsible for complying with employment related laws, including ensuring
that its employees and those of its subcontractors are provided with workers' compensation insurance and
are legally eligible to work in the United States.

1.14.3.1 In accordance with Title VI of the Civil Rights Act, as amended, 42 U.S.C. 2000d, section 303 of
the Age Discrimination Act of 1975, as amended, 42 U.S.C. 6102, section 202 of the Americans with
Disabilities Act of 1990, 42 U.S.C. 12132, and all other provisions of Federal law, the Firms doing
business with PCS agree that, the Firm, for themselves, their assignees and successors in interest, will not
discriminate against any employee or applicant for employment, any subcontractor, or any supplier because
of race, color, creed, religion, national origin, gender, age or disability.
1.14.3.2 PCS does not allow the employment of unauthorized aliens to perform work on PCS
contracts. Each contractor must provide evidence on PCS-provided forms that it and its
subcontractors and sub-subcontractors have registered for and are participating in the federal work
authorization program as defined by O.C.G.A. 13-10-90(2) to verify information of all new
employees. Contractors and subcontractors must keep all documents and records of its compliance
for a period of three (3) years following contract completion. PCS is authorized to conduct random
audits of contractor, subcontractor or sub-subcontractor compliance. 1.14.4 It is agreed that the
Contractor will not assign, transfer, convey or otherwise dispose of a contract that results from this
invitation or his right, title, or interest in or to the same, or any part thereof, without written consent
of PCS.
Indemnification
1.15.1 To the fullest extent permitted by law, Contractor shall defend, indemnify, and hold harmless PCS, its
agents, representatives, officers, directors, officials, and employees from and against all claims, damages,
losses and expenses, including, but not limited to, attorney fees, court costs, expert witness fees, and the cost
of appellate proceedings, relating to, arising out of, or alleged to have resulted from the negligent acts,
errors, omissions or mistakes relating to the performance of this Contract. Contractor's duty to defend,
indemnify and hold harmless PCS, its agents, representatives, officers, directors, officials, and employees
shall arise in connection with any claim, damage, loss or expense that is attributable to bodily injury,
sickness, disease, death, or injury to, impairment, or destruction of property, including loss of use resulting
there from, caused by any negligent acts, errors, omissions or mistakes in the performance of this Contract
including any person for whose acts, errors, omissions or mistakes Contractor may be legally liable.
1.15.2 The amount and type of insurance coverage requirements set forth herein will in no way be construed
as limiting the scope of the indemnity in this paragraph.
1.15.3 The scope of this indemnification does not extend to the sole negligence of PCS.
