SECTION I
NOTICE TO SERVICE PROVIDERS
The Town of Falmouth, Department of Public Works, will accept Bids for:
Old Burying Ground Gravestone Preservation, Phase 2A, 2026
Bids will be received in the Office of the Deputy Director, Falmouth Public Works, 416 Gifford Street,
Falmouth, MA 02540 on or before the following time and date: 2pm on Wednesday, June 24, 2026 at
which time and place the Bids will be opened and reviewed.
Request For Services Documents will be available after 8:00 A.M on Wednesday, June 10, 2026 and
may be examined and/or obtained at the office of the Deputy Director of the Department of Public
Works, 416 Gifford Street, Falmouth, MA 02540.
Service Providers may not withdraw their Bids for a period of 120 calendar days, after the actual date of
the opening of the Bids.
The successful Service Provider must furnish a 100 percent (100%) Performance Bond with a surety
company licensed to do business in the Commonwealth of Massachusetts.
Wage rates for this Project are subject to the minimum wage rates as per M.G.L. Chapter 149, Section
26 to 27D inclusive.
The request for services Bid and award of this Contract will be under the provisions of M.G.L. Chapter
30B.
This Services Proposal shall have a time period of one year.
The Town reserves the right to waive any informality in or reject any and all Bids, or to accept the Bid
deemed to be in the best interest of the Town of Falmouth.
Bids are welcome from minority and female businesses.

SECTION II
INFORMATION TO SERVICE PROVIDERS / GENERAL CONDITIONS
1. Attention of all Service Providers is directed to Massachusetts General Laws and to all other
applicable sections of the General Laws as most recently amended which govern the award of this
Contract.
2. The Service Provider shall submit his Bid upon forms furnished by the Department of Public
Works. The Service Provider shall specify the price in figures and in words, if space for words is
provided. All words and figures shall be typewritten or in ink. In case of discrepancy, the amount
shown in words will govern.
3. All Bids shall be signed correctly in ink by the individual or in case of a firm, partnership or
corporation, it shall be signed by a person having a legal authority from said firm, partnership or
corporation.
4. All Bids shall be submitted to the Office of the Parks Superintendent, Department of Public Works,
416 Gifford Street, Falmouth, Massachusetts 02540 on or before the date stated in the Notice to
Service Providers.
6. Bid forms shall be completely filled in. Bids which are incomplete, conditional, or obscure, or
which contain additions not called for will be rejected. Use the pages of this Document when
submitting Bids and submit Agreement Document intact. All Bids along with the qualifying
statements shall be considered firm prices for the period of the Bid as submitted by the Service
Provider. No award will be made to any Service Provider who cannot satisfy the Town of
Falmouth, Department of Public Works, that he has sufficient ability and experience in this class of
work and sufficient capital and plant to enable him to prosecute and complete the work successfully
within the time named. The Owner's decision or judgment on these matters will be final, conclusive
and binding.
7. The Town may make such investigations as it deems necessary to determine the ability of the
Service Provider to perform the work, and the Service Provider shall furnish to the Town all such
information and data for this purpose as the Town may request. The Town reserves the right to
reject any Bid if the evidence submitted by, or investigation of, such Service Provider fails to
satisfy the Town, that such Service Provider is properly qualified to carry out the obligations of the
Agreement and to complete the work contemplated therein within the time period set forth in the
Bid documents.
All applicable Federal, State and Local Laws, ordinance and rules, regulations (including but not
limited to any laws, ordinances or regulations relating to the Town of Falmouth, or the
Massachusetts Department of Environmental Protection) of any authorities shall be binding upon
the Service Provider throughout the pendency of this Contract. The Service Provider shall be
responsible for
8. Certificate of Insurance acceptable to the Town shall be filed with the Town prior to execution of
any contractual Agreement. These Certificates shall contain a provision that coverage afforded
under the policies will not be reduced or canceled unless at least fifteen (15) days prior written
notice has been given to the Town.
The Service Provider shall procure and maintain, at the Service Providers own expense, during the
Contract time, liability insurance as herein-after specified:
Service Provider’s General Public Liability and Property Damage Insurance including vehicle
coverage issued to the Service Provider and protecting the Service Provider from all claims for
personal injury, including death, and all claims for destruction of or damage to property arising out
of or in connection with any operations under this Agreement. Insurance shall be written with a
limit of liability of not less than $1,000,000 for all damages arising out of bodily injury including
death, at any time resulting there-from, sustained by any one person in any accident; and a limit of
liability of not less than $1,000,000 aggregate for any such damages sustained by two or more
persons in any one accident.
9. The Service Provider shall procure and maintain, at the Service Provider’s own expense, during the
duration of the Agreement, in accordance with the provisions of the Laws of the Commonwealth of
Massachusetts, G. L. Chapter 149, Section 34A, Workman's Compensation Insurance, including
occupational disease provisions, for all the Service Provider’s employees, and in case any work is
sublet, the Service Provider shall require such sub-service provider similarly to provide Workman's
Compensation Insurance, including occupational disease provision for all of the latter's employees
unless such employees are covered by the protection offered by the Service Provider. In case any
class of employees engaged in hazardous work under this Agreement is not protected under the
Workman's Compensation Law, the Service Provider shall provide and shall use each sub-service
provider to provide adequate and suitable insurance for the protection of its employee not otherwise
protected.
Signature of the Service Provider is required on the Written Bid Form regarding the Non-Collusive
resolution which states: "The Service Provider certifies under the provisions of Chapter 701 of the
Acts of 1983 and under the penalties of perjury, that this Bid is in all respects bonafide, fair and
made without collusion or fraud with any other person". As used in this Section, the word "person"
shall mean any natural person, joint venture, partnership, corporation or other business or legal
entity.
A Performance and Payment Bond in the amount of One Hundred (100%) percent of the annual
contract price will be required for the faithful performance of the Contract. The Service Provider
shall obtain and submit the bond within ten (10) days after notification of the Bid award. The
successful Service Providers Bid Bond shall not be released until such time the Performance and
Labor and Materials Bonds have been posted. Within seven (7) working days of receipt of
acceptable Payment Bond and Agreement signed by the party to whom the Agreement was
