TERMS AND CONDITIONS OF GENERAL SALE

NOTE: The Government of Guam reserves the right to change these terms and condi ons of

the general sale. Bidders are cau oned to periodically review these terms and condi ons

for possible changes.

INSPECTION: Bidders are invited and urged to inspect the property to be sold prior to

submi ng Bids. Property will be available for inspec on at the place and me speciﬁed in

the Bid Invita on. The Government of Guam will not be obligated to furnish any labor of

such purpose. In no case will failure to inspect cons tute grounds for a claim of for the

withdrawal of a bid a er opening.

CONDITIONS OF PROPERTY: All property listed herein is oﬀered for sale “As Is” and without

resource against the Government of Guam. The descrip on is based on the best available

informa on, but the Government makes no guarantee, warranty, expressed or implied, for

ﬁtness for any use or purpose, and no claim will be considered for allowance or

adjustments, or for recessions of the sale based upon failure of the property to correspond

with the standard expected. This is not a sale by example.

CONSIDERATION OF BIDS: The Government of Guam reserves the right to reject any and all

bids, to waive any technical defects in bids, unless otherwise speciﬁed by the Government

or by the bidder to accept any one item or group of items in the bid, as may be in the best

interest of the Government. Unless otherwise speciﬁed, bids must be submi ed on any or

all items. The agent shall have the authority to reject or award the bid in whole or in part

for any one or more items if he determines it is in the public’s interest. Bid nego a ons may

be considered.

BID GUARANTEE: The bidder agrees that (1) the bid will not be withdrawn within the

speciﬁed for acceptance a er the opening of bids, and will during that me remain ﬁrm and

irrevocable and that (2) the bidder will pay to the Government the purchase price of the

property in accordance with the bid, if accepted.

BILL OF SALE: The Government will issue a bill of sale for property sold to awarded bidders.

Bill of sale requiring a replacement or reissuance due to the original was lost or damaged, a

wri en request from the awarded bidder must be made within two years from when the

original bill of sale was ﬁrst issued. The Government reserves the right to charge a fee of
