TERMS AND CONDITIONS OF GENERAL SALE
NOTE: The Government of Guam reserves the right to change these terms and condi(cid:415)ons of
the general sale. Bidders are cau(cid:415)oned to periodically review these terms and condi(cid:415)ons
for possible changes.
INSPECTION: Bidders are invited and urged to inspect the property to be sold prior to
submi(cid:427)ng Bids. Property will be available for inspec(cid:415)on at the place and (cid:415)me specified in
the Bid Invita(cid:415)on. The Government of Guam will not be obligated to furnish any labor of
such purpose. In no case will failure to inspect cons(cid:415)tute grounds for a claim of for the
withdrawal of a bid a(cid:332)er opening.
CONDITIONS OF PROPERTY: All property listed herein is offered for sale "As Is" and without
resource against the Government of Guam. The descrip(cid:415)on is based on the best available
informa(cid:415)on, but the Government makes no guarantee, warranty, expressed or implied, for
fitness for any use or purpose, and no claim will be considered for allowance or
adjustments, or for recessions of the sale based upon failure of the property to correspond
with the standard expected. This is not a sale by example.
CONSIDERATION OF BIDS: The Government of Guam reserves the right to reject any and all
bids, to waive any technical defects in bids, unless otherwise specified by the Government
or by the bidder to accept any one item or group of items in the bid, as may be in the best
interest of the Government. Unless otherwise specified, bids must be submi(cid:425)ed on any or
all items. The agent shall have the authority to reject or award the bid in whole or in part
for any one or more items if he determines it is in the public's interest. Bid nego(cid:415)a(cid:415)ons may
be considered.
BID GUARANTEE: The bidder agrees that (1) the bid will not be withdrawn within the
specified for acceptance a(cid:332)er the opening of bids, and will during that (cid:415)me remain firm and
irrevocable and that (2) the bidder will pay to the Government the purchase price of the
property in accordance with the bid, if accepted.
BILL OF SALE: The Government will issue a bill of sale for property sold to awarded bidders.
Bill of sale requiring a replacement or reissuance due to the original was lost or damaged, a
wri(cid:425)en request from the awarded bidder must be made within two years from when the
original bill of sale was first issued. The Government reserves the right to charge a fee of

$10.00 per reissued bill of sale. For property sold as "Junk" or "Salvage", a subsequent bill of
sale will not be issued regardless of repairs made.
PAYMENT: Payment for a full purchase price within five (5) working days a(cid:332)er receipt of
"No(cid:415)ce of Award" shall be made by postal money order, cashier's check or cer(cid:415)fied check
drawn from a local bank and made payable to the: Treasurer of Guam. Payment of cash in
the amount of $500.00 and below is acceptable. Payment in excess of $500.00 shall be
made by postal money order, cashier's check or cer(cid:415)fied check. Par(cid:415)al payments will not be
accepted. If the successful bidder fails to make full and final payment as herein provided,
the Government reserves the right upon wri(cid:425)en no(cid:415)ce to the successful bidder to sell or
otherwise dispose of any or all of such property in the Government's possession and to
charge the loss to the account of the defaul(cid:415)ng bidder. The original purchase will in no way
be released from full compliance with the terms and condi(cid:415)ons of the sale of the resale
property.
REMOVAL OF PROPERTY: The purchaser shall be en(cid:415)tled to obtain the property upon
ves(cid:415)ng of (cid:415)tle to the property to him, unless otherwise specified in the Invita(cid:415)on to Bid. A
current valid driver's license will be required to remove property from the sale premises.
Other acceptable form of photo iden(cid:415)fica(cid:415)ons include Federal, state or local government.
The Government will not accept expired iden(cid:415)fica(cid:415)ons. The purchaser shall assume all risk
in connec(cid:415)on with the performance of his contract and shall hold the Government harmless
for any injury to persons or damage to property arising from on or in connec(cid:415)on with his
performance under this contract. The purchaser shall remove the property at his own
expense and shall reimburse the Government for any damage to Government property
caused by the removal opera(cid:415)ons of the purchase. If the purchaser fails to remove the
property within ten (10) working days as specified, the government shall have the right to
charge the purchaser a penalty fee in addi(cid:415)on to daily storage fees if the property is stored,
or on the premises owned or controlled by the Government, including handling and moving
charges, shall be borne by the purchaser. A(cid:332)er all a(cid:425)empts have been made by the
Government to have the property removed by the successful bidder, the Government has
the right to sell, to the next highest bidder, or place item on the next sale, or dispose of the
item. Proceeds from the sale will be deposited to the General Fund and the defaul(cid:415)ng
successful bidder shall have no right to collect the amount from such sales proceeds. No
property shall be released to the successful bidder without the presence of General Services
Agency (GSA) staff or GSA's designated representa(cid:415)ve.
DEFAULT: All items awarded to the highest bidder must be paid in full and removed from the
sale property within the specified (cid:415)me period under the terms and condi(cid:415)ons for each sale.

Should the bidder fail to pick up or pay for the awarded bid items within the (cid:415)me specified
on the bid, the Government will issue a "No(cid:415)ce of Default" to the awarded bidder no(cid:415)fying
the awardee of five (5) calendar days to cure. A(cid:332)er the five (5) calendar days elapsed and
the awarded bidder does not cure, the Government will then assess penalty fees as
specified in the fee schedule below. The bidder then has five (5) calendar days to pay the
penalty fees. If the bidder does not se(cid:425)le his account within the five (5) calendar days
allowed, the bid items will be awarded to the next highest bidder, or placed on the next sale,
or may be further disposed. If the default is not cured within the (cid:415)me specified and the
bidder does not make any a(cid:425)empt to se(cid:425)le his account, the Government has the right to
prohibit the bidder from par(cid:415)cipa(cid:415)ng in future bids with the Government of Guam.

INTRUCTIONS TO BIDDERS: Bidders must be at least 18 years of age. No employee of the
owning or disposing agency shall be en(cid:415)tled to par(cid:415)cipate in the Bid Sale. In addi(cid:415)on, GSA
employees and their immediate family are also ineligible to par(cid:415)cipate in any inspec(cid:415)ons
and or as a bidder. Immediate family is defined as a spouse and their children. Envelope
containing bids must be sealed and marked in the upper le(cid:332) hand corner with the name and
address of the bidder, iden(cid:415)fica(cid:415)on of the invita(cid:415)on, and date and hour of opening.
