INTENT TO SOLE SOURCE

The Erie VA Medical Center intends to make a sole source contract by the authority of FAR 6.302-1 (Only one responsible source and no other supplies or services will satisfy agency requirements) for the DeMayo Adapt2Fit Modular Knee Positioner with Innovative Medical Products, Inc. of 87 Spring Lane, PO Box 8028 Plainville, CT 06062. A determination that only one SDVOSB can meet the requirement is not required. However, in accordance with FAR 6.302(c)(2)(ii), contracts awarded using this authority shall be supported by a written justification and approval described in FAR 6.303 and FAR 6.304. In accordance with FAR 6.305(c), the brand name justification under FAR 6.302-1(c) shall be posted with the solicitation.

Simplified Acquisition Procedures will be used, and the resulting contract will be a firm-fixed price contract. The NAICS Code is 339113 and the Size Standard is 750 employees. This special notice serves as a notice of intent to award a sole source contract, is not a request for competitive proposals, and is not a solicitation or a request for offers. Any response to this notice must show clear and convincing evidence that a prospective offeror can fulfill the requirements of the solicitation and that competition would be advantageous to the Government. A determination by the Government not to compete this procurement is solely within the discretion of the Government. Interested parties should submit a capability statement to the Contract Specialist within 3 calendar days of the date of this notice.
