Roy City Corporation is requesting proposals from qualified individual(s) or firm(s) that are able and willing to purchase and develop certain property located in Roy City. The City is willing to sell real property with the agreement that said property will be developed with a housing development that maximizes the use of the property.
Proposers are responsible for securing any and all addenda issued.

REQUEST FOR PROPOSAL

Roy City Corporation Sale of Real Property

I.    INTRODUCTION

Roy City Corporation is requesting proposals from qualified individual(s) or firm(s) that can purchase and develop real property located at 4060 Sandridge Dr. Roy, UT 84067; 08-488-0005, ALL OF LOT 5, ROY STATION SUBDIVISION, ROY CITY, WEBER COUNTY, UTAH.
This RFP outlines the criteria for submission, the evaluation process, and the terms and process of the sale.
II.    BIDDER REQUIREMENTS

The individual, company, or firm that bids must be able to purchase and develop the property to maximize it use and begin construction within a reasonable amount of time after the purchase.

III.    RESPONSE TO REQUEST FOR PROPOSAL (SUBMITTAL)

The City will accept proposals from persons or entities that are capable of fulfilling the requirements as described in Section II. Applicants shall include qualifications for work set forth in this RFP for which it proposes to provide services.
A.    Each Proposal must include, as a minimum, the following information:
1.    Company Information: Name, address, email and telephone number of the person or company submitting the proposal.
a.    The name and contact information of the person designated as the firm’s representative.
b.    A description of the firm’s experience and capability of fulfilling this contract if awarded.
c.    Current business, contracting, or other applicable licenses.
d.    Proof of Insurance
2.    Purchase offer amount for the property.
3.    A detailed description of the proposed construction project to be built if awarded the contract.

a.    A detailed timeline of the construction project to include a start date and a completion date.
4.    A list of three recently completed projects.
IV.    EVALUATION OF PROPOSALS

Proposals will be evaluated in accordance with how the proposer will meet the requirements indicated in section II of this RFP and the customer service needs of the citizens of Roy as indicated in section III. Please submit all required documents, narrative and statements referenced in section III.
All proposals in response to this RFP will be evaluated in a manner consistent with the Roy City policies and procedures.

In the initial phase of the proposal evaluation process, the evaluation committee will review all proposals timely received.  Non-responsive proposals (those received after the deadline or not conforming to RFP requirements) will be eliminated. The remaining proposals will be evaluated in a cursory manner to eliminate from further consideration those proposals which in the judgment of the evaluation committee fail to offer sufficient and substantive provisions to warrant further consideration. Each proposer bears sole responsibility for the items included or not included in the response submitted by that proposer. The City reserves the right to disqualify any proposal that includes significant deviations or exceptions to the terms, conditions and/or specifications in this RFP.

At the conclusion of this initial evaluation phase, finalist proposals will be selected for detailed review and evaluation. The City may require an in-person presentation by a finalist proposer to supplement their written proposal.
V.    ADDITIONAL INFORMATION – GENERAL TERMS AND CONDITIONS

A.    The City reserves the right to request clarification of information submitted, and to request additional information from any proposer.
B.    Roy City will make every effort to ensure all offerors are treated fairly and equally throughout the entire advertisement, review and selection process. The procedures established herein are designed to give all parties reasonable access to the same basic information.
C.    Cost of Developing Proposals - All costs related to the preparation of proposals and any related activities are the sole responsibility of the offeror. Roy City assumes no liability for any costs incurred by offerors throughout the entire selection process.
D.    Proposal Ownership – Once submitted, all proposals, including attachments, supplementary materials, addenda, etc. become the property of Roy City and will not be returned to the offeror.
E.    Conflict of Interest – No member, officer, or employee of Roy City, during his or her tenure shall have any interest, direct or indirect, in this contract or the proceeds thereof, except as permitted by Roy City policy.
F.    Non-Collusion – The offeror guarantees the proposal is not a product of collusion with any other offeror and no effort has been made to fix the proposal price or any offeror or to fix any overhead, profit of cost estimate of any proposal price.
G.    Roy City reserves the right to reject any and all proposals, cancel all or part of this RFP, waive any minor irregularities and request additional information from respondents.  The City will not reimburse the respondents to this RFP for any expenses incurred in preparing the proposals, or for the attendance at any meetings related to the proposal process.  This RFP does not obligate the City to accept any proposal or contract for any services.  Furthermore, Roy City shall have the right to waive any informality or technicality in proposals received, when in the best interest of Roy City. Roy City reserves the right to segment or reduce the scope of services and enter into contracts with more than one vendor.
H.    Award of Contract - The selection of the company will be made by a selection committee comprised of city employees. Roy City reserves the right to negotiate and hold discussions with prospective service providers as necessary, however, Roy City may award this contract without discussion of proposals received from prospective service providers. The selected company shall enter into a written agreement with Roy City.
I.    Pursuant to the Utah Government Records Access and Management Act (GRAMA), records will be considered public after the contract is awarded. If an offeror wishes to protect any records, a request for business confidentiality may be submitted to the Roy City Recorders Office at the time of bid submission.
J.    An appraisal report done for Roy City Corporation done by Valbridge Property Advisors on July 8, 2024, included as Exhibit A.
VI.    UTAH STATE LAW GOVERNS THE FINAL SALE OF THE REAL PROPERTY
In accordance with Utah State Code Ann. § 10-8-2(4), the City will finalize the sale contract for the property in a public meeting after the award of the RFP.
VII.    GOVERNING INSTRUCTIONS

This Request for Proposal will constitute the governing document for submitting Proposals and will take precedent over any oral representations.

IX.    SUBMISSION OF PROPOSALS

Firms shall prepare one copy the required documentation in one sealed envelope and submit to the office of the City Manager, 5051 South 1900 West, Roy UT 84067. On the envelope, indicate your “Company’s Name” and the project name “Real Property Sale RFP”.
No facsimile or email transmittals will be accepted. All submittals must be delivered by mail or other delivery service or hand-carried to the City Administration Office at the same address.
It is the sole responsibility of those responding to this RFP to ensure that their submittal is made to the correct location and in compliance with the stated date and time. City offices are closed on holidays.
The City reserves the right to accept or reject any submittal as it best serves convenience and/or is found to be in the best interest of the City.

X.    RFP SCHEDULE – (Subject to Change)

October 3, 2024 – RFP is opened to the public; Document is published on the City’s website and other public notice locations by October 4.

RFP Review by Selection Committee; Interviews, Follow up, or Formal Presentations
Recommendation of Award & Approval by City Council

The City has made every effort to include enough information in this RFP for a proposer to prepare a responsive proposal.  Respondents are encouraged to submit the most comprehensive and competitive proposal possible. Submission of a proposal indicates acceptance by the Respondent of the conditions contained in the RFP.
