ADVERTISEMENT FOR BIDS
DEMOREST CITY HALL PARKING LOT - FOR THE CITY OF DEMOREST,
GEORGIA
Sealed bids will be received by the City of Demorest Downtown Development Authority
(OWNER) for furnishing all materials, labor, tools, equipment, and any other
miscellaneous items necessary for the construction of the Demorest City Hall Parking Lot
in Demorest, Georgia.
Bids will be received at Demorest City Hall, 250 Alabama Street, Demorest, Georgia 30535,
until 11 a.m. on August 23rd. Any bid received after said time and date of bid opening will
not be considered by OWNER. Bids will be publicly opened and read aloud at this time and
location.
All bids will be evaluated by OWNER and the project will be awarded, if awarded, within
sixty (60) days of the bid opening.
The award of this bid proposal, if awarded, shall be based on several criteria including
prices bid, contractor qualifications, references, and experience in similar work.
The Project generally consists of, but is not limited to:
* Site demolition
* Earthwork and grading
* Storm drainage improvements
* Underground detention system
* Concrete curb and gutter
* Concrete sidewalks and ADA ramps
* Asphalt paving
* Pavement striping
* Erosion and sedimentation control
* Modular retaining wall improvements
* Related appurtenances
Alternate Bid Items include:
* Alternate No. 1 - Gymnasium Demolition
* Alternate No. 2 - Gymnasium Disassembly and Delivery to 251 Habersham Mills
Road, Demorest, Georgia

Time of completion for all work associated with this project shall be one hundred twenty
(120) consecutive calendar days from the date of a written Notice to Proceed from
OWNER.
Liquidated Damages: In the event the Contractor fails to achieve Substantial Completion
within the Contract Time, the Contractor shall pay the OWNER liquidated damages in the
amount of Five Hundred Dollars ($500.00) per consecutive calendar day until Substantial
Completion is achieved. No early-completion incentive is offered.
Local Preference: In accordance with applicable Georgia law and City policy, the City of
Demorest will apply a preference for local bidders. For purposes of this solicitation, a
"local bidder" is a bidder whose office is located in Habersham County, Georgia. Where a
bid from a local bidder is within five percent (5%) of the lowest responsive and responsible
bid from a bidder that is not local, the local bidder may be given the opportunity to match
the low bid and be awarded the Contract.

Questions regarding this solicitation shall be directed in writing to James Irvin, P.E., at
jirvin@foothillsld.com, and must be received no later than seven (7) calendar days prior to
the bid opening. Responses will be issued by written Addendum to all known plan holders.
A site visit prior to bidding is recommended and may be coordinated through Mark
Musselwhite at (762) 228-1469. A formal pre-bid conference will not be held.
OWNER requires a bid bond or certified cashier's check in the amount of five percent (5%)
of the total bid to be enclosed with the bid.
The successful bidder will be required to furnish Insurance, Workman's Compensation
Insurance, and Performance and Payment Bonds in the amount of one hundred percent
(100%) of the contract amount.
Each bid must be submitted in a sealed envelope addressed to OWNER and plainly
marked:
"Demorest City Hall Parking Lot - City of Demorest, Georgia"
OWNER reserves the right to waive informalities and to reject any or all bids.

SECTION 00100
INSTRUCTIONS TO BIDDERS
1. RECEIPT AND OPENING OF BIDS
Bids will be received by the City of Demorest, Georgia at the location and time indicated in
the Advertisement for Bids.
Any bid received after the stated time shall not be considered.
OWNER reserves the right to reject any and all bids and waive informalities.
No bidder may withdraw a bid within sixty (60) days after opening.
2. PREPARATION OF BID
Each Bid shall be submitted on the prescribed Bid Forms and accompanied by:

* Bidder Experience Statement
* Subcontractor List
* Non-Collusion Affidavit
* Compliance Statement
* Contractor's Certificate
* E-Verify Affidavit
3. EXAMINATION OF CONTRACT DOCUMENTS
Bidders shall carefully examine all plans, specifications, contract documents, and site
conditions prior to submitting a bid.
Submission of a bid constitutes acknowledgment that bidder has reviewed and
understands the project requirements.
Contractor shall verify all quantities, dimensions, material requirements, and site
conditions necessary to complete the work shown on the plans and specifications prior to
submitting a bid.
4. QUESTIONS AND INTERPRETATIONS
All questions concerning the meaning or intent of the Contract Documents shall be
submitted in writing to the Engineer, James Irvin, P.E., at jirvin@foothillsld.com.
Questions must be received no later than seven (7) calendar days prior to the bid opening.
Interpretations or clarifications considered necessary in response to such questions will

be issued by written Addendum to all known plan holders. Only written interpretations
issued by Addendum shall be binding. Oral statements shall not be relied upon and shall
not be binding on the OWNER or Engineer.
5. SITE VISIT
Bidders are strongly encouraged to visit the site and verify existing conditions prior to
submitting a bid. A formal pre-bid conference will not be held.
Site visits may be coordinated through Mark Musselwhite at (762) 228-1469. The
contractor shall assume responsibility for all conditions reasonably observable during site
inspection.
Trees and vegetation identified for removal are not specifically identified or quantified on
the construction drawings. Bidders shall field verify and determine the extent of tree and
vegetation removal required to complete the work shown within the limits of disturbance
and construction areas indicated on the plans. Submission of a bid shall constitute
acknowledgement that the bidder has visited the site and accounted for all clearing,
grubbing, tree removal, and vegetation removal necessary for completion of the project.
6. LOCAL PREFERENCE
In accordance with applicable Georgia law and City policy, the City of Demorest will apply
a preference for local bidders in the award of this Contract. For purposes of this
solicitation, a "local bidder" is a bidder whose office is located in Habersham County,
Georgia. Where a responsive, responsible local bidder's bid is within five percent (5%) of
the lowest responsive and responsible bid, the local bidder may be afforded the
opportunity to match the lowest bid and be awarded the Contract.
7. BID SECURITY
Each bid shall be accompanied by a Bid Bond or certified cashier's check in the amount of
five percent (5%) of the total bid.
8. CONTRACT TIME AND LIQUIDATED DAMAGES
Contract time shall be 120 consecutive calendar days from the date of the Notice to
Proceed. The Contractor shall achieve Substantial Completion within the Contract Time.
Should the Contractor fail to achieve Substantial Completion within the Contract Time, the
Contractor shall pay the OWNER liquidated damages in the amount of Five Hundred
Dollars ($500.00) per consecutive calendar day until Substantial Completion is achieved.
No early-completion incentive is offered.
9. PERFORMANCE AND PAYMENT BONDS
The successful bidder shall furnish Performance and Payment Bonds each in the amount
of one hundred percent (100%) of the Contract Sum, in accordance with O.C.G.A. 36-91-
70 et seq.

10. CONTRACTOR LICENSING
Contractor shall possess all licenses required by the State of Georgia and local authorities
having jurisdiction for the performance of the work.
11. GEORGIA OPEN RECORDS
Bid documents submitted in response to this solicitation may become public records
subject to disclosure pursuant to the Georgia Open Records Act after contract award.
12. INSURANCE
Contractor shall maintain insurance as required by Georgia law including:
* General Liability
* Automobile Liability
* Workers Compensation
* Umbrella Liability
Minimum coverage limits shall be as follows:
* General Liability: $1,000,000 per occurrence / $2,000,000 aggregate
* Automobile Liability: $1,000,000 combined single limit
* Workers Compensation: Statutory coverage as required by Georgia law, with
Employer's Liability limits of $100,000 each accident / $500,000 disease - policy
limit / $100,000 disease - each employee
* Umbrella Liability: $1,000,000
13. PERMITS
Contractor shall obtain and pay for all permits, inspections, licenses, and fees necessary
for completion of the work unless otherwise noted. The City of Demorest has obtained the
NPDES permit required by GA EPD to proceed with land disturbance. The required 7-day
erosion control inspection from the engineer-of-record is not included in this bid.
14. UTILITY VERIFICATION
Locations of existing underground and overhead utilities shown on the plans are
approximate and are based upon available information. Contractor shall verify all utility
locations prior to construction and shall coordinate with utility owners as required.
15. SAFETY
Contractor shall be solely responsible for jobsite safety and compliance with OSHA
requirements.

16. PROSECUTION OF WORK
Contractor shall prosecute the work continuously, diligently, and in good faith until
completion of the project within the contract time.
