    B27000094 Tree/Vegetation Clearing and Trimming Instructions
    • VENDOR COMPLIANCE – PAPER DOCUMENTS : Vendors not utilizing HCE shall provide paper certificates that must be valid at the time of award. All applications for applicable clearances are the responsibility of the vendor, who must be compliant pursuant to HRS§103D-310(c) with the chapters 1) Chapter 237, General Excise Tax Laws; 2) Chapter 382, Hawaii Employment Security Law; 3)Chapter 386, Worker’s Compensation Law; 4) Chapter 392, Temporary Disability Insurance; 5)Chapter 393, Prepaid Health Care Act; and 6) §103D-310(c), Certificate of Good Standing (COGS) for entities doing business in the State. Upon receipt of compliance paper documents (A-6, LIR#27, COGS), the purchasing agency reserves the right to verify their validity with the respective issuing agency.
    • ADDITIONAL FEES AND CHARGES: Vendors shall include all applicable fees, charges, surcharges, shipping/handling, delivery, or any other charges associated with this solicitation in the price submitted.
    • RESPONSE TO THIS SOLICITATION: Only responses submitted through HIePRO shall be considered for award.
    • QUESTIONS ABOUT THIS SOLICITATION: Unless otherwise indicated, questions regarding this solicitation must be directed to the Buyer listed.
    • TRANSACTION FEES: The awarded vendor shall pay a transaction fee of 0.75% (.0075) of the award, not to exceed $5,000 for each award. This transaction fee shall be based on the original award amount and the awarded vendor shall be responsible for payment of the fee to Tyler Hawaii, the vendor administering the HIePRO. Payment must be made to Tyler Hawaii within thirty (30) days of receipt of invoice. The invoice is generated based on the date the award is posted.
    • OFFER DEEMED FIRM/AUTHORITY TO SUBMIT OFFER: Submission of an electronic response to the State of Hawaii constitutes and shall be deemed an offer to sell the specified goods and/or services to the State of Hawaii at the price shown in the response and under the State's Terms and Conditions.

      The electronic response submitter certifies that he/she is authorized to sign the response for the submitting vendor and that the response is made without connection with any person, firm, or corporation making a response for the same goods and/or services and is in all respects fair and without collusion or fraud.
    • COMPLIANCE AND DOCUMENTATION: Vendors are required to be compliant with all appropriate state and federal statutes. Proof of compliance is required through HCE or via paper documentation.
    • VENDOR REGISTRATION IN HAWAII COMPLIANCE EXPRESS (HCE) : Vendors can register at https://vendors.ehawaii.gov/hce via an annual subscription fee and should subscribe prior to responding to a solicitation.     • VENDOR NON-COMPLIANCE : NON-COMPLIANCE may result in a vendor not receiving an award, delay of payment, or cancellation of award. If the vendor does not maintain timely compliance, which is the vendor’s responsibility, an offer otherwise deemed responsive and responsible may not be awarded. State agencies may check for compliance at any time.
    • HAWAII GENERAL EXCISE TAX (GET): Unless otherwise stated in this solicitation, vendors shall include all applicable taxes in the price submitted. The Hawaii General Excise Tax (GET) shall not exceed 4.712% for the islands of Oahu, Kauai , Hawaii, and Maui.

    The table below contains the State's current estimate of the schedule and significant dates. All times are Hawaii Standard Time (HST). If a component of this schedule, such as "Bid quotes Due Date and Time" is delayed, the rest of the schedule may likely be shifted by the same number of days. Any change to the IFB Schedule and Significant Dates prior to the bid quote due date shall be issued by addendum.

    A. SCOPE OF WORK (SOW)

    To reduce the risk to public health and safety, proposed work in the designated stream and drainage areas includes removing debris, trash, and unwanted vegetation to keep waterways open and accommodate drainage requirements.

    Item 1: Clearing of vegetation in the designated area of the stream bed by cutting down vegetation to the root from embankment to embankment, including mid-channel sediment bars formed within or to the edges of the stream channel. Remove all debris and trash from stream areas. All work will be done to the satisfaction of the ODLO. All vegetation and debris shall be disposed of off-site at an authorized facility.

    State of Hawaii registered herbicides for use in streams shall be applied to the freshly cut surfaces. All herbicide applications shall be conducted in compliance with the label directions and comply with all Federal and State laws and regulations. The applicator shall be solely responsible for the efficacy of the application, control, and any off-target damage caused by any herbicide application. Contractors will fill out and submit to ODLO the Herbicide Form if herbicide is used.

    Item 2. Two maintenance clearings to begin at six (6) month intervals after work is completed satisfactorily. Maintenance will be conducted in the designated area of the stream bed with the same scope of work as Item 1.

    B. GENERAL NOTES:

    All work shall be done between 8:00 a.m. to 4:30 p.m., Monday through Friday (excluding State holidays) except with the prior approval of ODLO.

    The Contractor shall be responsible for verifying the location of all utilities and structures. Any damage, injury, and/or loss to any property resulting from the performance of the work shall be the sole responsibility of the Contractor, and shall be remedied promptly by the Contractor at his own expense.

    The Contractor will be provided contact information for the sites to coordinate physical access to the site, if needed.

    The Contractor shall provide safety signs, barricade, and other devices necessary for the safety and convenience of the general public.

    The Contractor shall observe all applicable Federal, State, and Municipal acts, statutes, ordinance, and rules pertaining to the performance of this job.

    The bid award shall be based on the availability of funds.

    Submission of bid shall be the evidence that the Contractor understands the scope of the job described herein.

    If erosion and sediment control measures are needed, they will be in place before earth-moving and dredging activities begin. Functionality of erosion and sediment control devices will be maintained throughout the construction period.
