ADVERTISEMENT FOR BIDS
Notice is hereby given that the City of Buffalo will accept sealed bids for:
BUSTI AVENUE TRAFFIC CALMING AND BICYCLE IMPROVEMENTS
PIN #5763.48
The Owner is the City of Buffalo and the work site is located in the City of Buffalo. The project
limits are: Busti Avenue between Virginia Street and Massachusetts Avenue and Porter Avenue
between Lakeview Avenue and Niagara Street.
The work includes providing all labor, materials, machinery, tools, equipment and other means of
construction necessary and incidental to the completion of the work shown on the plans and
described in these specifications including, but not necessarily limited to the following: work zone
traffic control, traffic signal modifications, concrete sidewalks, granite curbs, granite curb ramps,
catch basin modifications and reconstruction, manhole adjustments, limited drainage and sewer
piping, underdrain reconstruction, limited areas of pavement reconstruction, flashing crosswalk
beacons, tree plantings, and signing and pavement striping.
This is a Federal Aid Project and NYSDOT Standard Specifications, officially finalized and
adopted on January 1, 2026 as posted on the New York State Department of Transportation’s
website must be followed by the successful bidder.
The DBE goal for this project is: 0%
NOTE: Bidders must submit their DBE Participation Commitments on Company Letterhead
with the bid.
The EEO Employment goals for this project are: 7.7 % Minority Employment Goal
6.9% Women Employment Goal
The use of the NYSDOT approved civil rights reporting software, Equitable Business
Opportunities (EBO), is required. Access authorization to EBO can be found at

Applicable Federal requirements take precedence over State and Local requirements unless
State and Local requirements are deemed to be more stringent.
The Proposal documents, including any Addenda, can be viewed and ordered through the
following website: https://www.avalonbuff-planroom.com in the Public Bid section. If you
do not have internet access or have questions on ordering from the site, please contact
Avalon Document Services at (716) 995-7777. Proposal documents can be picked up at
Avalon Document Printing at 40 La Riviere Dr, Suite 150, Buffalo, NY 14202, upon the non-
refundable deposit of FIFTY-EIGHT DOLLARS ($58.00) per set. Payment can be submitted
only by company check or money order made payable to the City of Buffalo, Dept. of Public
Works, Parks and Streets. NO CASH AND NO PERSONAL CHECKS.

No questions or inquiries regarding this bid will be accepted within three (3) business days prior
to the bid opening.
The City of Buffalo will not be responsible for full or partial set of Contract Documents, including
any Addenda obtained from any other source. The City of Buffalo reserves the right to reject any
and all bids and to waive any informalities therein.
Addenda will be emailed from Avalon Document Services to Bidders listed on the official Plan
Holders List. Bidders must acknowledge receipt of all Addenda by securely stapling in place all
addenda within the front or back covers of the proposal book. All Addenda so issued shall become
part of the Contract Documents.
Questions regarding the Contract Documents should be directed to Jessica Ross, P.E. at
jross@bergmannpc.com. Bidders shall promptly notify Jessica Ross, P.E., at
jross@bergmannpc.com of any errors, omissions, conflicts or ambiguity within the Contract
Documents prior to three (3) days of bid opening.
All bids must include the completed Bid Form, Non-Collusive Bidding and Disbarment
Certifications, and Lobbying Certifications. This is a unit price bid as described in the Instructions
to Bidders. No bidder may withdraw his/her bid within forty-five (45) calendar days after the actual
date of the opening thereof.
Pursuant to New York State Department of Labor (NYSDOL) requirements for public work
projects: Contractors and Subcontractors need to register before submitting any new bids
or commencing new work on a covered project on or after December 30, 2024. NYSDOL
encourages all contractors and subcontractors to register as soon as possible to obtain a
Certificate of Registration to avoid negatively impacting a bidding period or project schedule.
Proof of Certificate of Registration must be submitted with each bid.
Bids to be considered must be received by the Commissioner of Public Works, Parks & Streets
no later than: WEDNESDAY, APRIL 8, 2026, AT 11:00 AM.
It is the bidder’s responsibility to ensure the sealed proposal is delivered before the bid
opening and bidders must utilize one of the following methods:
1.) Drop off the sealed proposal to Room 502 of City Hall, Buffalo, New York, 14202 on
Wednesday, April 8, 2026 between the hours of 9:00 AM and 11:00 AM. The DPW will
set a bid box up just inside Room 502 for the bidder to deposit the sealed proposal. There
may be multiple bids on this date; it is the bidder’s responsibility to properly label the
sealed proposal and place the proposal inside the correct box.
2.) Mail the sealed proposals to Room 502, City Hall, Buffalo, New York, 14202 with ATTN to
the Commissioner of Public Works, Parks and Streets. Bidders should allow for delivery
before the bid opening (highly encouraged to schedule for delivery on or prior to Tuesday,
April 7, 2026). It is also highly encouraged that bidders track delivery of their mailed
proposals and use appropriate priority mail as necessary. City of Buffalo staff is available
to accept deliveries on standard business days Monday-Friday from 8:00 AM to 4:00 PM.

Bids will be opened by City of Buffalo Representatives on WEDNESDAY, APRIL 8, 2026 at
11:00 AM LOCAL TIME via video/phone conference call. Bidder representatives can view the
public bid opening by emailing Tom Duk at tduk@buffalony.gov by 5:00 PM on Tuesday, April
7, 2026 to be added to the meeting invitation. An updated meeting invitation will be sent prior to
the bid opening to all who request to be added.
BIDDERS SHALL COMPLY WITH ALL APPLICABLE LOCAL LAWS AND ORDINANCES.
The Bidder to whom the Contract is awarded will be required to furnish Performance, Payment
and Guarantee Bonds from an acceptable Surety Company for an amount not less than 100% of
the accepted bid. The successful Bidder and all subcontractors must have an approved CCA-2
on file with NYSDOT prior to being awarded a contract. If the successful Bidder does not currently
have a CCA-2 on file with NYSDOT, the Bidder may find the CCA-2 forms and instruction for
completion online at https://www.osc.state.ny.us/state-vendors/vendrep/vendrep-system.
The successful Bidder will be required to comply with all provisions of the Federal Government
Equal Employment Opportunity clauses issued by the Secretary of Labor on May 2, 1968 and
published in the Federal Register (41 CFR Part 60-1, 33 F.2 7804). Successful bidders will be
required to pay prevailing wage rates on this contract.
The City of Buffalo reserves the right to consider the bids for forty-five (45) days after receipt
before awarding any Contract, and to waive any minor informalities in, and to reject, any and all
bids. All bids are subject to final review and approval by the City of Buffalo Common Council
before any award of contract may be made. Receipt of bids by the City of Buffalo shall not be
construed as authority to bind the City of Buffalo.
The work will be substantially completed 100 working days from Notice to Proceed
