ITEM I
INVITATION TO BID
Sealed bids for Bid #26-013 Glenwood Road Storm Sewer System Improvements will be received by the City of
Hoover at the Office of the City Clerk, whose office is located in Hoover City Hall at 100 Municipal Lane, Third Floor,
Hoover, Alabama, 35216, no later than 2:00 pm CT on Wednesday, September 30, 2026, at which time they will be
publicly opened and read aloud within Hoover City Hall as soon thereafter as practicable. Bids received after the
specified date and time will not be considered.
The mandatory pre-bid meeting for this project will be on Wednesday September 16, 2026, at 8:30 am CT at the
Building Inspections Conference Room at the City of Hoover Public Safety Center, 2020 Valleydale Road, Hoover, AL
35244.
All bids must be submitted in SECURELY SEALED envelopes that are clearly marked on the outside with "SEALED
BID, Alabama General Contractor's License Number, Bid Number 26-013, Bid for Completion of Glenwood Road
Storm Sewer System Improvements, Bidder's Name, Bidder's Address, and the Bid Opening Date and Time. Each
bid must be in a separate envelope.
Sixty (60) working days are allowed for the construction of the project.
Bids must be mailed, shipped using a commercial shipping company, or hand delivered to the following address:

The successful bidder must possess a City of Hoover business license.
If sent by mail or shipping company, the securely sealed envelope containing the bid must be enclosed in another
envelope addressed as specified above. No responsibility will be attached to the City of Hoover for the premature
opening of a Bid not properly addressed and identified.
This project is being bid EXCLUDING TAXES and requires the Contractor to comply with the applicable provisions of
the Section 11-2A-14.1, Code of Alabama, 1975, as amended; applicable provisions of the Alabama Administrative
Code; and applicable requirements of the Alabama Department of Revenue (ADOR).
Each bid shall be accompanied by a cashier's check or bid bond for the sum of five percent (5%) of the amount bid
(maximum amount of bond $10,000), made payable to the CITY, and certified by a reputable banking institution.
These monies shall serve as assurance that within ten (10) days of the notice of contract award contemplated in the
contract, the successful bidder will enter into such contract and file a bond for the execution of same.

The performance bond required will be for the amount bid, and labor and material bond shall be 100% of the
amount of the contract and shall be made by a Surety licensed to do business in the State of Alabama, signed or
countersigned by a licensed Resident Agent of Alabama and have a minimum rating of A Class VI as reported in the
latest issue of Best's Key Rating Guide Property and Casualty. The Surety Company must be acceptable to the City
of Hoover and provided on the forms of bonds appended hereto.
In default of entering into such contract and the execution of such bond, the certified check required to accompany
such bid shall be forfeited to the City of Hoover, Alabama. These fees shall not be a penalty but damages for delays,
or for the additional cost or expenses that the CITY may incur by reason of such default.
In addition, the Contractor must furnish to the City at the time of signing of the Contract: a certificate(s) of insurance
coverage as provided herein which will include comprehensive insurance, Worker's Compensation and Employer's
Liability Insurance, Commercial General Liability Insurance, Commercial Automobile Liability Insurance, Commercial
Umbrella or Excess Liability Insurance. All policies of insurance shall be endorsed naming the City of Hoover, its
agents and employees as additionally insured, and where applicable, subcontractor's Public Liability and Property
Damage Insurance. The right is reserved to reject any and/or all bids and to waive informalities and to furnish any
item of material or work to change the amount of said Contract.
Liquidated damages for non-completion of the work within the time limit agreed upon will be assessed according
to Section 108.11 of Alabama Department of Transportation Standard Specifications for Highway Construction 2026
Edition.
Bidders must be licensed Contractors in the State of Alabama pursuant to Sections 34-8-1 through 34-8-27 of the
Code of Alabama of 1975 as amended and shall indicate State License Number on outside of bid envelope. Any
contractor that desires to bid as a prime contractor must possess a Municipal & Utility (MU) or a Highways &
Streets (HS) per Section 230-X-.27 of the State of Alabama Licensing Board for General Contractors Administrative
Code.
The awarding of a contract will require the Contractor to pay the prevailing wage rates that are applicable to the
trades engaged in this project in this area.
The City of Hoover reserves the right to reject any and all bids and waive informalities in the bidding.

2. Bid Documents, including Addenda, will not be mailed or emailed to bidders. It will be the responsibility of
the bidder to frequently visit the City's website at http://www.hooveralabama.gov/bids.aspx to view or
download Bid Documents or Addenda, if issued.
3. Addenda will be posted to the City's website no later than 5:00 pm CT on Wednesday, September 23,
2026.

ITEM II
INSTRUCTIONS TO BIDDERS
1.0. INTRODUCTION
1.1. Bidders shall retain these instructions, conditions, and specifications for future reference. This
document, in its entirety, its attachments, and any addenda issued will become part of the contract
between the City of Hoover and the successful bidder.
1.2. Unaltered forms furnished in this document must be used. Strict compliance with the requirements
of the advertisement, these instructions, and the instructions printed on the forms is required.
1.3. Special care shall be exercised in preparation of Bids.
1.4. Bidders must make their own estimates of the facilities and difficulties attending the performance of
the proposed contract, including local conditions, uncertainty of weather, and all other
contingencies.
1.5. All designations and prices shall be fully and clearly set forth.
1.6. All bidders must use the enclosed Bid Package Forms, Items VII through XIII, (or copies thereof) to
submit their bid. No alternate or substitute pricing forms will be accepted, nor shall the "Proposal"
Form be altered. All Bid Package Forms, Items VII through XIII, must be submitted along with the
specified, required documents for a bid to be considered a responsive bid.
1.7. All bid responses must be typed or written in ink with an original wet ink signature.
1.8. All signatures must be hand signed in ink. Printed, typed, stamped, or digitally stamped signatures
are not acceptable.
1.9. Each and every item listed on the "Proposal" Form must be complete with a price or the bid may be
disqualified.
1.10. Bidders shall not attach any conditions or provisions to the Contract Documents or the "Proposal"
Form.
1.11. Be sure all initials, signatures, markings, etc. are provided in the proper location and completed in
their entirety on every document in this proposal.
1.12. The proper spaces in the "Proposal" form and all forms shall be suitably filled.
1.13. BID DOCUMENTS
1. All Contract documents, including Bid Specifications and Bid Package Forms, are
available for review and download from the City's website at
http://www.hooveralabama.gov/bids.aspx.
2. In making copies of the Contract Documents available on the above terms do so only for
the purpose of requesting and obtaining Bids on the project and do not imply to convey a
license or permission for any other use.
3. Records showing the successful bidder and prices will be kept on file within the City Clerk's
Office and are Public Record. The documents may be examined upon request.
2.0. RECEIPT AND OPENING OF BIDS
2.1. Sealed bids will be received by the office of The City Clerk of the City of Hoover, Alabama, 100
Municipal Lane, Hoover, AL 35216.

2.2. Bids will be received on or before the submittal deadline and then, at said office, shall be publicly
opened and read aloud as soon thereafter as practicable.
2.3. The City of Hoover may consider informal any bid not prepared and submitted in accordance with
the provisions hereof or may waive any informality in such submittal.
2.4. Any bid may be withdrawn prior to the scheduled time for the opening of bids or authorized
postponement thereof. However, no bidder may withdraw a bid within ninety (90) days after the
actual date of the bid opening thereof without forfeiture of Bid Security of Bid Bond.
2.5. Any bid received after the time and date specified shall not be opened nor considered to be eligible
for an award.
2.6. Bids will be free of alterations or erasures.
2.7. No responsibility will be attached to the City of Hoover for the premature opening of a Bid not
properly addressed and identified.
2.8. Bids received prior to the time of opening will be securely stored, unopened.
2.9. The City of Hoover is not responsible for delays caused by the US Postal Service or other means of
delivery. The bidder assumes responsibility for submitting bids by the date and time set forth in the
Invitation to Bid.
3.0. MARKING AND MAILING BIDS
3.1. The Bid Package Forms, Items VII through XIII, with their guaranty, must be securely sealed in suitable
envelopes, addressed and marked on the outside:

7. Bid Opening Date and Time".
4.0. SIGNATURE OF BIDDERS
4.1. Each bid must give the full business address of the Bidder and be signed by him with his usual
signature.
4.2. Bids by partnerships must furnish the full names of all partners and must be signed with the
partnership name by one of the members of the partnership or by an authorized representative,
followed by the signature and designation of the person signing.
4.3. Bids by Corporations must be signed with the legal name of the corporation, followed by the name
of State of Incorporation and by the signature of the president, secretary or other person authorized
to bind it in the matter.
4.4. The name of each person shall also be typed or printed below the signature. A Bid by a person who
affixes to his signature the work "President", "Secretary", "Agent", or other designation without
disclosing his principal may be held responsible for the Bid.
4.5. When requested by the City of Hoover, Alabama satisfactory evidence of the authority of the office
signing on behalf of the corporation shall be furnished.

5.0. SPECIFICATIONS AND DOCUMENTS
5.1. Copies of these papers, together with a copy of the standard contract form, including authorized
additions or deletions, if any, will be furnished to or made available for the inspections of Bidders by
the office indicated in the advertisement of Invitation to Bid.
5.2. The current specifications to be used for this project will be the Alabama Department of
Transportation Standard Specifications for Highway Construction, 2026 edition, subject to any
amendments set forth in the Special Provisions or the Supplemental Specifications. The specifications
document can be obtained from ALDOT's website at Microsoft Word - 2026 Spec Book.
5.3. Bidders must provide all information and signatures on the "Proposal" form as requested. Bids may
be disqualified for non-compliance or may be deemed non-responsive if required bid documents are
not submitted as requested. Bids may be disqualified if additional documents or additional terms and
conditions are added to the bid documents.
5.4. To be considered a responsive bid, it is important that all terms, conditions, and specifications are
read and understood thoroughly.
6.0. INTERPRETATIONS AND ADDENDA
6.1. Any discrepancies, ambiguities, or omissions, and/or technical questions about the items specified
within the Bid Documents, must be submitted a written request no later than the date and time
specified in the Invitation to Bid.
6.2. Answers to questions, clarifications, corrections, and additions to the Bid Documents will be issued
in the form of Addenda to the Bid Specifications.
6.3. Addenda will be posted to the City's website no later than 72 hours prior to the bid opening or no
later than the date and time listed in the Invitation to Bid, if provided.
6.4. It shall be the responsibility of the bidder to frequently visit the City's website to view or download
Addenda, if any are issued.
6.5. Addenda shall not be mailed or emailed.
6.6. Addenda shall become part of the bid, and all bidders must acknowledge receipt of all Addenda and
include in their bid package.
7.0. BONDS, GUARANTY AND INSURANCE
7.1. All insurance and bonds must be furnished by a Surety licensed to do business in the State of
Alabama, signed or countersigned by a licensed Resident Agent of Alabama and have a minimum
rating of A Class VI as reported in the latest issue of Best's Key Rating Guide Property and Casualty.
7.2. See the instructions hereinafter contained and the applicable standard forms with respect to the
type, form, and the amounts of required bonds and insurance policies.
7.3. Security is required to ensure the execution of the Contract and bond for performance of the services;
no Bid will be considered unless it is so guaranteed.
7.4. The Bidder must furnish with his Bid, a guaranty bond or certified check in the amount of five percent
(5%) (maximum amount $10,000) of his Bid price payable to the City of Hoover, Alabama.
7.5. The successful bidder, upon his failure or refusal to execute and deliver the contract and bonds within
10 consecutive working days of written notice of award of the Contract, the Certified Check or Bid
Bond required to accompany such Bid shall be forfeited to the City of Hoover, Alabama, not as a
penalty but as liquidated damages for delays, or any additional cost or expenses which may be
incurred by the CITY by reason of such default.

7.6. In addition, the Contractor shall furnish a Maintenance Bond in the amount of twenty-five percent
(25%) of the Contract Price. The Maintenance Bond shall remain in effect for one (1) year from the
date of final acceptance and shall guarantee correction of defects in materials and workmanship.
7.7. All Bonds are subject to review and approval by the City Attorney. A valid, current Power of Attorney
for Corporate Surety must be attached.
7.8. Certified checks or bid bonds will be returned promptly after the City and the accepted bidder have
executed the contract, or if no award has been made within ninety (90) days after the date of the
opening of bids, upon demand of the bidder at any time thereafter, so long as he has not been
notified of the acceptance of his bid.
8.0. WITHDRAWAL OF BIDS
8.1. Bids may be withdrawn by written request received from Bidders prior to the time fixed for opening.
8.2. Negligence on the part of the Bidder in preparing the Bid confers no right for withdrawal of Bid after
it has been opened.
9.0. BIDDERS PRESENT
9.1. At the time fixed for opening Bids, Bid contents will be made public for the information of Bidders
and others properly interested, who may be present either in person or by representation.
10.0. OWNER
10.1. Where the word "Owner" appears herein, the same refers to the City of Hoover, Alabama, and
includes the Mayor acting through the City Council, its governing body.
11.0. AWARD OR REJECTION OF BIDS
11.1. The contract will be awarded to the lowest responsible Bidder, complying with the conditions of the
Invitation for Bids, provided his Bid is reasonable and in the best interest of the Owner for
acceptance.
11.2. The Bidder to whom the award is made will be notified at the earliest possible date.
11.3. The Owner, however, reserves the right to reject any and all Bids and to waive any informality in Bids
received whenever such rejection or waiver is in the best interest of the Owner.
11.4. The Owner reserves the right to reject the Bidder for any of the following reasons:
1. Failure to comply with any prequalification regulations of the Owner, if such regulations
are cited, or otherwise included, in the proposal as a requirement for bidding.
2. Previous failure to perform properly or complete projects on time.
3. Bidder Default, as defined in Article 108.12 of the Alabama Department of Transportation
Standard Specifications for Highway Construction, 2026 Edition, with all latest additional
and modifications of the Engineering Department for the City of Hoover, under a previous
contract(s) with the Owner.
4. Failure to pay, or satisfactorily settle, all bills due for labor and materials on former
contracts in force (with the Owner) at the time of the Invitation to Bid.
5. Unsatisfactory work of any nature, or failure to meet schedule on previous contracts with
the Owner.

6. Uncompleted work or work behind schedule, which, in the opinion of the Owner, might
hinder or prevent prompt completion of this work.
7. Lack of competent workmen and equipment to perform the paving work with the
contractor's own forces and equipment.
8. Previous failure to complete Contracts of a similar nature.
9. If in the judgment of the Owner, the contractor is not in a position to perform the Contract.
11.5. While the bid award may be made to the bidder who submits the lowest responsible bid meeting all
specifications, the City of Hoover may or may not award the bid to the bidder who submits the lowest
price. Other factors including, but not limited to, qualifications, experience, conformity with
specifications, and past service history are among the factors that may be considered in determining
the lowest responsible bidder. If the contract is awarded to someone other than the lowest price
bidder, a note of explanation will appear in the bid file.
11.6. In the event the lowest responsible bidder refuses to accept all bid requirements without deviation,
that bid will then be disqualified. After such refusal, the bid may be awarded to the next lowest
responsible bidder meeting all specifications.
11.7. Bids may be disqualified before the awarding of the contract for any reason including but not limited
to the following:
11.8. Failure to deliver the bid submittal as required.
1. Failure to sign or notarize the bid documents.
2. Failure to mark the outside of the envelope as required.
3. Failure to fully and properly complete the "Proposal" Form.
4. Failure to include requested information or other details of the bid.
5. Excessive errors in calculating prices or total.
6. Failure to include bid bond.
7. Failure to attend mandatory pre-bid meeting, if required.
11.9. Bids may be disqualified for any other reason that may be deemed appropriate by Hoover City
officials.
11.10. The City reserves the right to award the bid in any manner that is in the best interest of the City of
Hoover.
12.0. QUALIFICATIONS OF BIDDERS
12.1. The bidder must not be disqualified from bidding on ALDOT projects at the time of the Invitation to
Bid.
12.2. Any contractor that desires to bid as a prime contractor must possess a Municipal & Utility (MU) or
a Highways & Streets (HS) per Section 230-X-.27 of the State of Alabama Licensing Board for General
Contractors Administrative Code.
12.3. The City may make such investigations as deemed necessary to determine the ability of the bidder
to perform the work, and the bidder shall furnish to the City all such information and data for this
purpose as the City may request.
12.4. The City reserves the right to reject any bid if the evidence submitted by, or investigation of such
bidder fails to satisfy the City that such bidder is properly qualified to carry out the obligations of the
contract and to complete the work contemplated therein.
