The APEX Accelerators program was formerly known as the Procurement Technical Assistance Program (opens in new window) (PTAP).
Under the authority of 10 USC 2304(c) and FAR 13.106-l(b)(l)(i), there is only one responsible source and no other supplies or services will satisfy the agency requirements. These preventative maintenance, and repair services can only be performed by the Original Equipment Manufacturer (OEM). The determination that the procurement for this service is a Sole Source requirement is based on the following excerpt from the Limited Source Justification form dated 12/09/24: "TRUMPF owns the software rights and requires a TRUMPF technician to perform the work and authenticate software. The TRUMPF laser cutter has capability that is not found in other equipment at PNSY, without this equipment x17 is either unable to perform work required or come up with inefficient alternatives that use up valuable material and unnecessary wasted man hours." Therefore, this requirement is to be solicited in accordance with Sole Source exclusive rights.
