Addendum #1

Please note the following changes which have been made for clarification to this Invitation for Sealed Bid. This

addendum must be listed as Addendum #1 on Exhibit A, page 18 of the bid package as verification that you

have received and are aware of the information contained herein.

QUESTIONS/CLARIFICATION/CHANGES:

Question 1. In the Electrical Gauges, Suzuki has a digital gauge that will show trim, volt, and engine

hours, and much more. In order to get speed to read on that gauge it will require additional hardware

via NMEA, etc. GPS speed will display on a Hummingbird Xplore graph at the console without any

additional NMEA network, etc. Is GPS speed on a Hummingbird graph enough?

Answer 1. Yes, GPS speed on the sonar will work. A Hummingbird sonar will be mounted on the

front deck. We currently have two new Lowrance sonars that we will install on the boat when we

receive it. A Hummingbird and our Lowrance sonars will both provide speed via GPS.

Question 2. Two Millennium seats and pedestals are standard with this model. Do you want two

additional for a total of four?

Answer 2. Yes, two additional for a total of four.

Question 3. Where do you want those two seat base plates mounted?

Answer 3. We are unsure where they can be placed.

Question 4. The on-board charger listed is a MK 460PCL. We see often that 15 amps per bank ends

up with a bad bank at some point. We have had much better results from staying at 10 amps per

bank and the 440PCL. Is a 440PCL acceptable?

Answer 4. Yes, that would be acceptable.

Question 5. Is the preferred battery setup to have 1 cranking battery and 3 deep cycle/trolling motor

batteries?

Answer 5. Yes.

Question 6. The GatorHyde coating, deluxe trailer package and J-step options are not available on

the galvanized trailer. Do you prefer the galvanized trailer or the options on a painted trailer?

Answer 6. We prefer the options to the galvanized trailer. Please bid on the Painted trailer. We

would like the color to match the exterior color of the boat.

I. STATEMENT OF PURPOSE:

1. Overview and Goals

The goal of this solicitation is to secure a source to provide a 24 foot boat for use by the Police

Department Dive Team of the City of Tulsa.

2. Term of Contract

The City intends to award a one-year annual contract. The City may offer the Seller the opportunity

for additional one-year terms. The City also reserves the right to make multiple or partial awards.

To do business with the City, You must agree to the terms and conditions of the City’s standard

Purchase Agreement, indicated by Your Authorized Agent’s signature on the Purchase Agreement.

Capitalized terms used in this IFB and not defined in the Purchase Agreement shall have the

meanings as ascribed to them in Title 6, Chapter 4 of the Tulsa Revised Ordinances.

The entire Invitation for Bid (IFB), including any additional information submitted by Bidder and

Accepted by City will be included as part of the Agreement between Seller and City. All sheets of

this IFB (including Sections I-VI) must be submitted.

Authorized Agent

Several parts of the Bid (Affidavits, Purchase Agreement) must be signed by an “Authorized

Agent.” An Authorized Agent means an agent who is legally authorized to bind the Seller under the

law of the state in which the Seller is legally organized. For instance, under Oklahoma law, the

Authorized Agent for each of the following types of entities is as stated below:

o Corporations – the president, board chair or board vice chair (or the vice president if the corporation

was formed in Oklahoma) can sign; others can sign if they have and provide the City with (i) a corporate

resolution giving them authority to bind the Seller, and (ii) a recent certificate of secretary indicating

the authority is still valid and was in full force and effect on the date of the signature. (See IFB Section

VI for sample of a Certificate of Secretary)

o General Partnerships – any partner can sign to bind all partners.

o Limited Partnerships – the general partner must sign.

o Individuals – no additional authorization is required, but signatures must be witnessed and notarized.

o Sole Proprietorship – the owner can sign. Any other person can sign if s/he provides a recent Power

of Attorney, signed by the owner, authorizing him/her to bind the sole proprietorship.

o Limited Liability Company (LLC) – any manager of the LLC elected by the members of the LLC, or

any member signing as manager of the LLC. All other signers will need a Consent of Members signed

by all the Members of the LLC authorizing their signature on or up to 30 days before the date of their

signature. (See Section VI for sample of a Consent of Members)

Entities organized in states other than Oklahoma must follow the law of the state in which they are

organized.

It is recommended that Signatory Authorization Documentation for the

Authorized Agent is included at the time of Bid Submission.

II. SCOPE OF SERVICES AND SPECIFICATIONS

1. Scope of Services

The City of Tulsa is requesting Bids for a 24 foot boat for the Police Department Dive Team.

Delivery Requirements

All prices quoted shall be based on delivery F.O.B. Tulsa, Oklahoma or to any other points as may

be designated in the Specifications, with all charges prepaid by Seller to the actual point of delivery.

Bids must state the number of Days required for delivery under normal conditions.

Absolutely no items over 500lbs. may be directly shipped to the City requiring the City personnel to

unload from the shipping truck or trailer. The City carries no responsibility for any damages incurred

during an unloading occurrence. All unloading shall be the responsibility of the Seller and/or shipping

entity.

2. Specifications

The Bid must meet or exceed the following Specifications.

In the Specification Tables below, the Bidder shall respond in writing to each minimum requirement

listed in the Bidder’s Offering – Specification Description column. Written descriptions shall be

legible if handwritten and of a similar font size if typed. Whenever asked to “describe”, the written

description must include details such as size, capacities, dimensions, materials used in construction,

etc. A full and complete description is required to reasonably evaluate the Bid, so all pertinent

information is required. Your ability to present the City with sufficient information to reasonably

understand the item being bid and whether it meets the Minimum Specifications Desired relies on

the written information provided in this table.

You are required to describe Your proposed equipment in the Bidder’s Offering – Specification

Description column, in terms that correspond with the minimum Specifications shown. You may

not answer in the space provided as to whether You meet the Specifications by responding with

terms as “yes”, “meets”, “same as”, “complies”, “similar”, or “refer to attached” terms. If

these terms are utilized, it shall result in Your Bid being considered as non-responsive and it will

be rejected.

If bidding an equivalent, You must include descriptive manufacturer’s literature (technical

specification sheets) verifying the information You provided in the Bidder’s Offering –

Specification Description column with Your bid submission. Failure to provide such literature

when offering an equivalent shall result in Your Bid being considered as non-responsive and it will

be rejected.
