NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT
THIS IS NOT A REQUEST FOR QUOTE
The Bureau of Indian Education (BIE), Cheyenne Eagle Butte School, intends to enter into a sole source contract under the authority of FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, 41 U.S.C. 3304(a)(1).

The BIE has identified a need for residential placement of a student.
Residential setting rather than a traditional school and boarding dorm environment is imperative for addressing specific needs that cannot be adequately met by BIE in a standard educational framework. The alternative placement was determined based on several key factors. The child struggles with significant emotional or behavioral issues that hinder their ability to thrive in a conventional school setting. These challenges stem from conditions such as anxiety, depression, trauma history, or learning disabilities, which require specialized support not available in regular schools. The student currently attends the select facility for education support services. This request supports the continuation of services in alignment with the student's IEP. Failure to provide this specialized service will place BIE in violation of Individuals with Disabilities Education Act.
Due to the specialized nature of this requirement a competitive solicitation will not be issued. The select school is highly specialized and a limited resource for special needs students. The government does not anticipate a significant cost savings as a result of competition, only processing delays and disruption of service which may jeopardize student progress made to date. Technical questions will not be answered for this requirement being this is not a request for quote nor proposal and the government is not accepting quotes nor proposals in response to this notice. Any contractor information provided in response to this notice is strictly voluntary and shall be at no cost to the government.
