Foam and Additional Supplies for Eddy County Fire & Rescue

The County of Eddy, on behalf of the Fire & Rescue Department, seeks bids from companies qualified to do business in the State of New Mexico to provide Foam and Additional Supplies to the Fire & Rescue Departments throughout Eddy County.  Bidders may submit bids for any one or more items listed in the Bid Form. Awardee must be capable of delivering Foam within a 3-hour window to both Fire Stations and/or Fire Scenes throughout the county.

The resulting contracts will be indefinite quantity, per State Statute 13-1-63, and “awardees will furnish and indeterminate quantity of specified services, items of tangible personal property or construction services during a prescribed period of time (the life of any agreement) at definite unit price or at a specified discount from list or catalogue prices.” No yearly price increases will be considered.

Submitting a bid for this project implies agreement by the Bidder to these terms.

The use of a brand name is for the purpose of describing the desired standard of quality, performance, and characteristics, and is not intended to limit or restrict competition. When bidding an "or equal" the burden of persuasion is on the supplier or manufacturer who has not been specified to convince the procurement officer that their product is, in fact, equal to the one specified. The procurement officer retains authority and discretion to make the final determination as to whether a proposed substitution qualifies as an ‘or equal,’ in accordance with NMAC 1.4.24, subsection D.
