BUY INDIAN ACT
The IHS Contracting Officer will give priority for all purchases, regardless of dollar value, by utilizing ISBEE set-aside to the maximum extent possible. Each acquisition of supplies, services or construction that is subject to commercial items (FAR 12.209) or Simplified Acquisition Procedures (SAP) (FAR 13.106) must be set-aside exclusively for ISBEEs.
Definition(s): INDIAN ECONOMIC ENTERPRISE (IEE) - Any business activity owned by one or more Indians, Federally Recognized Indian Tribes, or Alaska Native Corporations provided that: The combined Indian, Federally Recognized Indian Tribe or Alaska Native Corporation ownership of the enterprise constitutes not less than 51%; The Indian, Federal Recognized Indian Tribes, or Alaska Native Corporations must, together, receive at least 51% of the earnings from the contract; and The management and daily business operations must be controlled by one or more individuals who are Indians.
Definition: INDIAN SMALL BUSINESS ECONOMIC ENTERPRISE (ISBEE) – An IEE that is also a small business concern established in accordance with the criteria and size standards of 13 CFR Part 121.
DESCRIPTION OF REQUIREMENT
DYYWC is a 24-bed, 24-hour residential treatment facility and is accredited by The Joint Commission. The large footprint of the milieu garners upkeep, maintenance and emergency prevention, patient client injury prevention and safety. Freshwater is required to host patients, that meets or exceed EPA standards and fire suppression capabilities. Employees are not trained, certified to test and measure freshwater supply. In addition, solid waste removal is above the scope and equipment provided by the facility.
The objective of this contract is to ensure the provision of reliable, efficient, and sustainable water supply, solid waste management, and sewer services that meet all applicable regulatory standards. The contracted services shall:
• Water Services – Provide a safe, continuous, and high-quality water supply, ensuring compliance with health and environmental regulations while maintaining cost-effectiveness and efficiency.
• Sewer Services – Ensure proper wastewater collection, treatment, and disposal in accordance with local, state, and federal regulations to protect public health and the environment.
• Solid Waste Management – Implement a comprehensive waste collection, disposal, and recycling program that promotes environmental sustainability and minimizes landfill use. Service shall be schedule on a weekly occurrence.
The contractor shall be responsible for the planning, operation, maintenance, and reporting of these services, ensuring adherence to industry best practices, environmental sustainability, and cost efficiency.
